]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature Second Regular Session - 2006IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 607 BY TRANSPORTATION AND DEFENSE COMMITTEE 1 AN ACT 2 RELATING TO SPECIAL MOTOR VEHICLE LICENSE PLATES; AMENDING SECTION 49-402, 3 IDAHO CODE, TO PROVIDE A CODE REFERENCE; AMENDING CHAPTER 4, TITLE 49, 4 IDAHO CODE, BY THE ADDITION OF A NEW SECTION 49-416E, IDAHO CODE, TO 5 ESTABLISH A BREAST CANCER EDUCATION AND SCREENING SPECIAL LICENSE PLATE 6 PROGRAM; AND PROVIDING AN EFFECTIVE DATE. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Section 49-402, Idaho Code, be, and the same is hereby 9 amended to read as follows: 10 49-402. ANNUAL REGISTRATION. (1) The annual fee for operating each pickup 11 truck, each neighborhood electric vehicle and each other motor vehicle having 12 a maximum gross weight not in excess of eight thousand (8,000) pounds shall 13 be: 14 Vehicles one (1) and two (2) years old ............................ $48.00 15 Vehicles three (3) and four (4) years old ......................... $36.00 16 Vehicles five (5) and six (6) years old ........................... $36.00 17 Vehicles seven (7) and eight (8) years old ........................ $24.00 18 Vehicles over eight (8) years old ................................. $24.00 19 There shall be twelve (12) registration periods, starting in January for 20 holders of validation registration stickers numbered 1, and proceeding consec- 21 utively through December for holders of validation registration stickers num- 22 bered 12, each of which shall start on the first day of a calendar month and 23 end on the last day of the twelfth month from the first day of the beginning 24 month. Registration periods shall expire midnight on the last day of the reg- 25 istration period in the year designated by the validation registration 26 sticker. The numeral digit on the validation registration stickers shall, as 27 does the registration card, fix the registration period under the staggered 28 plate system of Idaho for the purpose of reregistration and notice of expira- 29 tion. 30 A vehicle that has once been registered for any of the above designated 31 periods shall, upon reregistration, be registered for the period bearing the 32 same number, and the registration card shall show and be the exclusive proof 33 of the expiration date of registration and licensing. Vehicles may be ini- 34 tially registered for less than a twelve (12) month period, or for more than a 35 twelve (12) month period, and the fee prorated on a monthly basis if the frac- 36 tional registration tends to fulfill the purpose of the monthly series regis- 37 tration system. 38 (2) For all school buses operated either by a nonprofit, nonpublic school 39 or operated pursuant to a service contract with a school district for trans- 40 porting children to or from school or in connection with school approved 41 activities, the annual fee shall be twenty-four dollars ($24.00). 42 (3) For all motorcycles and all-terrain vehicles operated upon the public 43 highways the annual fee shall be nine dollars ($9.00). For operation of an 2 1 all-terrain vehicle or motorcycle off the public highways, the fee specified 2 in section 67-7122, Idaho Code, shall be paid. Registration exemptions pro- 3 vided in section 49-426(2), (3) and (4), Idaho Code, apply to all-terrain 4 vehicles and motorcycles used for the purposes described in subsections (2), 5 (3) and (4) of section 49-426, Idaho Code. 6 (4) For all motor homes the fee shall be as specified in subsection (1) 7 of this section and shall be in addition to the fees provided for in section 8 49-445, Idaho Code. 9 (5) Registration fees shall not be subject to refund. 10 (6) A financial institution or repossession service contracted to a 11 financial institution repossessing vehicles under the terms of a security 12 agreement shall move the vehicle from the place of repossession to the finan- 13 cial institution's place of business on a repossession plate. The repossession 14 plate shall also be used for demonstrating the vehicle to a prospective pur- 15 chaser for a period not to exceed ninety-six (96) hours. The registration fees 16 for repossession plates shall be as required in subsection (1) of this section 17 for a vehicle one (1) and two (2) years old. All other fees required under 18 chapter 4, title 49, Idaho Code, shall be in addition to the registration fee. 19 The repossession plate shall be issued on an annual basis by the department. 20 (7) In addition to the annual registration fee in this section, there 21 shall be an initial program fee of twenty-five dollars ($25.00) and an annual 22 program fee of fifteen dollars ($15.00) for all special license plate programs 23 for those license plates issued pursuant to sections 49-404A, 49-407, 49-408, 24 49-409, 49-414, 49-416, 49-418 and 49-418D, Idaho Code. For special plates 25 issued pursuant to sections 49-406 and 49-406A, Idaho Code, there shall be an 26 initial program fee of twenty-five dollars ($25.00) but there shall be no 27 annual renewal fee. For special plates issued pursuant to sections 49-416A, 28 49-416B, 49-416C, 49-416E, 49-417, 49-417A, 49-417B, 49-417C, 49-418A, 29 49-418B, 49-418C, 49-419, 49-419A, 49-419B, 49-419C, 49-419D, 49-420, 49-420A, 30 49-420B, 49-420C, 49-420D, 49-420E and 49-420G, Idaho Code, there shall be an 31 initial program fee of thirty-five dollars ($35.00) and an annual program fee 32 of twenty-five dollars ($25.00). The fees contained in this subsection shall 33 be applicable to all new special plate programs. The initial program fee and 34 the annual program fee shall be deposited in the state highway account and 35 shall be used to fund the cost of administration of special license plate pro- 36 grams, unless otherwise specified by law. 37 SECTION 2. That Chapter 4, Title 49, Idaho Code, be, and the same is 38 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 39 ignated as Section 49-416E, Idaho Code, and to read as follows: 40 49-416E. BREAST CANCER EDUCATION AND SCREENING PLATES. (1) On and after 41 January 1, 2007, any person who is the owner of a vehicle registered under the 42 provisions of section 49-402, Idaho Code, or registered under any other sec- 43 tion of law for which the purchase of special plates is allowed, may apply for 44 and, upon department approval, receive special breast cancer education and 45 screening license plates in lieu of regular license plates. The provisions of 46 this section shall not apply to any vehicle with a registered maximum gross 47 weight over twenty-six thousand (26,000) pounds. Availability of breast cancer 48 education and screening license plates for other vehicles shall be subject to 49 the rules, policies and procedures of the department. 50 (2) In addition to the regular registration fee required in chapter 4, 51 title 49, Idaho Code, the applicant shall be charged a fee of thirty-five dol- 52 lars ($35.00) for the initial issuance of plates, and twenty-five dollars 53 ($25.00) upon each succeeding annual registration. Ten dollars ($10.00) of the 3 1 initial fee and ten dollars ($10.00) of the renewal fee shall be deposited in 2 the state highway account and shall be used to fund the cost of administration 3 of this special license plate program. Twenty-five dollars ($25.00) of each 4 initial fee and fifteen dollars ($15.00) of each renewal fee shall be trans- 5 ferred by the state treasurer for deposit to the Idaho primary care associa- 6 tion located in Boise, Idaho, and shall be distributed by the Idaho primary 7 care association as administrator of the funds, to Idaho community health cen- 8 ters to be used for breast cancer education and screening of women who lack 9 insurance coverage or funds to pay for services related to breast cancer edu- 10 cation and screening. 11 (3) Whenever title or interest in a vehicle registered under the provi- 12 sions of this section is transferred or assigned, the owner may transfer the 13 special plates to another vehicle upon payment of the required transfer fees. 14 The owner may only display the plates on another vehicle upon receipt of the 15 new registration from the department. 16 (4) The breast cancer education and screening license plate shall be of a 17 color and design in accordance with the provisions of section 49-402C, Idaho 18 Code. The design and any slogan on the plate shall be acceptable to the gov- 19 erning board of the Idaho primary care association and shall be approved by 20 the Idaho transportation department utilizing a numbering system as determined 21 by the department. Initial costs of the plate program, including costs of 22 plate design, shall be paid by the Idaho primary care association. 23 (5) Sample breast cancer education and screening license plates may be 24 purchased for a fee of thirty dollars ($30.00), ten dollars ($10.00) of which 25 shall be deposited in the state highway account and twenty dollars ($20.00) of 26 which shall be transferred to the Idaho primary care association located in 27 Boise, Idaho, and shall be distributed by the association to Idaho community 28 health centers to be used for breast cancer education and screening of women 29 who lack insurance coverage or funds to pay for services related to breast 30 cancer education and screening. 31 SECTION 3. This act shall be in full force and effect on and after Janu- 32 ary 1, 2007.
STATEMENT OF PURPOSE RS 15813 This legislation will establish a Breast Cancer Education and Screening special license plate. Funds raised from the sale of the plate will be used for breast cancer education and screening of women who lack insurance coverage or funds to pay for services related to breast cancer education and screening.* FISCAL IMPACT This bill has no fiscal impact on the general fund. Fees for the special plates cover all costs and are entirely voluntary on the part of the purchasers.
