]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature Second Regular Session - 2006IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 681 BY EDUCATION COMMITTEE 1 AN ACT 2 RELATING TO PUBLIC SCHOOLS; AMENDING CHAPTER 1, TITLE 33, IDAHO CODE, BY THE 3 ADDITION OF A NEW SECTION 33-131, IDAHO CODE, TO RESTRICT VENDING MACHINES 4 AND VENDING MACHINE PRODUCTS IN PUBLIC SCHOOLS, TO DEFINE TERMS AND TO 5 LIMIT APPLICATION. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Chapter 1, Title 33, Idaho Code, be, and the same is 8 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 9 ignated as Section 33-131, Idaho Code, and to read as follows: 10 33-131. VENDING MACHINES. (1) Except as otherwise provided in subsection 11 (4) of this section, vending machines shall not be located in public elemen- 12 tary schools in areas accessible to students. 13 (2) Except as otherwise provided in subsection (4) of this section, only 14 vending machines offering products complying with the standards set forth in 15 paragraphs (a) and (b) of this subsection shall be located in public secondary 16 schools in areas accessible to students: 17 (a) Food products may contain: 18 (i) A maximum of three (3) grams of fat per one hundred (100) calo- 19 ries, provided this provision shall not apply to packages of nuts 20 and/or seeds; 21 (ii) A maximum of four hundred (400) milligrams of sodium per serv- 22 ing; 23 (iii) A minimum of twelve (12) grams of complex carbohydrates per 24 serving, provided the product does not contain more than thirty-five 25 percent (35%) sugar by weight. 26 (b) Beverages may consist of: 27 (i) Drinking water that is not carbonated, sweetened or otherwise 28 flavored; 29 (ii) Lowfat or skim milk; 30 (iii) One hundred percent (100%) fruit juice. 31 (3) As used in this section, the terms "elementary school" and "secondary 32 school" are as defined in section 33-119, Idaho Code. 33 (4) The provisions of this section shall not apply to contracts entered 34 into prior to July 1, 2006.
STATEMENT OF PURPOSE RS 15778 This legislation proposes to add a new section to Chapter 1 of Title 33 of the Idaho Code to restrict vending machine location and vending machine products in public schools, to define terms and to limit application.
