]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature Second Regular Session - 2006IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 770 BY EDUCATION COMMITTEE 1 AN ACT 2 RELATING TO PUBLIC SCHOOL FUNDING; AMENDING SECTION 33-1004, IDAHO CODE, TO 3 PROVIDE ADDITIONAL INSTRUCTIONAL STAFF ALLOWANCE FOR EACH SEPARATE SECOND- 4 ARY SCHOOL AND TO MAKE TECHNICAL CORRECTIONS; AND AMENDING SECTION 5 33-1004E, IDAHO CODE, TO MAKE TECHNICAL CORRECTIONS AND TO PROVIDE PROPER 6 CODE REFERENCES. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Section 33-1004, Idaho Code, be, and the same is hereby 9 amended to read as follows: 10 33-1004. STAFF ALLOWANCE. For each school district, a staff allowance 11 shall be determined as follows: 12 (1.) Using the daily attendance reports that have been submitted for com- 13 puting the February 15th apportionment of state funds as provided in section 14 33-1009, Idaho Code, determine the total support units for the district in the 15 manner provided in section 33-1002 8.b., Idaho Code; 16 (2.) Determine the instructional staff allowance by multiplying the sup- 17 port units by 1.1. A district must demonstrate that it actually employs the 18 number of certificated instructional staff allowed. If the district does not 19 employ the number allowed, the staff allowance shall be reduced to the actual 20 number employed; 21 (3.) Determine the administrative staff allowance by multiplying the sup- 22 port units by .075; 23 (4.) Determine the classified staff allowance by multiplying the support 24 units by .375; 25 (5.) Additional conditions governing staff allowance: 26 (a.) In determining the number of staff in subsections (2.), (3.) and 27 (4.) of this section, a district may contract separately for services to 28 be rendered by nondistrict employees and such employees may be counted in 29 the staff allowance. A "nondistrict employee" means a person for whom the 30 school district does not pay the employer's obligations for employee bene- 31 fits. When a district contracts for the services of a nondistrict 32 employee, only the salary portion of the contract shall be allowable for 33 computations. 34 (b.) If there are circumstances preventing eligible use of staff allow- 35 ance to which a district is entitled as provided in subsections (2.) and 36 (3.) of this section, an appeal may be filed with the state department of 37 education outlining the reasons and proposed alternative use of these 38 funds, and a waiver may be granted. 39 (c.) For any district with less than forty (40) support units: 40 (1i) The instructional staff allowance shall be calculated applying 41 the actual number of support units. If the actual instructional staff 42 employed in the school year is greater than the instructional staff 43 allowance, then the instructional staff allowance shall be increased 2 1 by one-half (1/2) staff allowance; and 2 (2ii) The administrative staff allowance shall be calculated apply- 3 ing the actual number of support units. If the actual administrative 4 staff employed in the school year is greater than the administrative 5 staff allowance, then the administrative staff allowance shall be 6 increased by one-half (1/2) staff allowance. 7 (3iii) Additionally, for any district with less than twenty (20) 8 support units, the instructional staff allowance shall be calculated 9 applying the actual number of support units. If the number of 10 instructional staff employed in the school year is greater than the 11 instructional staff allowance, the staff allowance shall be increased 12 as provided in paragraphs (1i) and (2ii) of this subsection, and by 13 an additional one-half (1/2) instructional staff allowance. 14 (d.) For any school district with one (1) or more separate secondary 15 schools, the instructional staff allowance shall be increased by two (2) 16 additional instructional staff allowances for each separate secondary 17 school. 18 (e) Only instructional, administrative and classified personnel compen- 19 sated by the school district from the general maintenance and operation 20 fund of the district shall be included in the calculation of staff allow- 21 ance or in any other calculations based upon staff, including determina- 22 tion of the experience and education multiplier, the reporting require- 23 ments, or the district's salary-based apportionment calculation. No food 24 service staff or transportation staff shall be included in the staff 25 allowance. 26 (6.) In the event that the staff allowance in any category is insuffi- 27 cient to meet accreditation standards, a district may appeal to the state 28 board of education, demonstrating the insufficiency, and the state board may 29 grant a waiver authorizing sufficient additional staff to be included within 30 the staff allowance to meet accreditation standards. Such a waiver shall be 31 limited to one (1) year, but may be renewed upon showing of continuing justi- 32 fication. 33 SECTION 2. That Section 33-1004E, Idaho Code, be, and the same is hereby 34 amended to read as follows: 35 33-1004E. DISTRICT'S SALARY-BASED APPORTIONMENT. Each district shall be 36 entitled to a salary-based apportionment calculated as provided in this sec- 37 tion. 38 (1.) To determine the apportionment for instructional staff, first deter- 39 mine the district average experience and education index by placing all eligi- 40 ble district certificated instructional employees on the statewide index pro- 41 vided in section 33-1004A, Idaho Code. The resulting average is the district 42 index. Districts with an index above the state average index shall receive 43 their actual index but not more than the state average plus .03 for the 44 1994-95 school year, and shall receive their actual index but not more than 45 the state average plus .06 for the 1995-96 school year, and thereafter shall 46 receive their actual district index. The district instructional staff index 47 shall be multiplied by the instructional base salary of twenty-three thousand 48 two hundred ten dollars ($23,210). The amount so determined shall be multi- 49 plied by the district staff allowance for instructional staff determined as 50 provided in section 33-1004(2.), Idaho Code. The instructional salary alloca- 51 tion shall be increased by the amount necessary for each full-time equivalent 52 instructional staff member placed on the experience and education index to be 53 allocated at least the minimum salary mandated by this section. Full-time 3 1 instructional staff salaries shall be determined from a salary schedule devel- 2 oped by each district and submitted to the state department of education. No 3 full-time instructional staff member shall be paid less than twenty-seven 4 thousand five hundred dollars ($27,500). If an instructional staff member has 5 been certified by the national board for professional teaching standards, the 6 staff member shall be designated as a master teacher and receive two thousand 7 dollars ($2,000) per year for five (5) years. The instructional salary shall 8 be increased by two thousand dollars ($2,000) for each master teacher. The 9 resulting amount is the district's salary-based apportionment for instruc- 10 tional staff. For purposes of this section, teachers qualifying for the salary 11 increase as master teachers shall be those who have been recognized as 12 national board certified teachers as of July 1 of each year. 13 (2.) To determine the apportionment for district administrative staff, 14 first determine the district average experience and education index by placing 15 all eligible certificated administrative employees on the statewide index pro- 16 vided in section 33-1004A, Idaho Code. The resulting average is the district 17 index. Districts with an index above the state average index shall receive 18 their actual index but not more than the state average plus .03 for the school 19 year 1994-95, and shall receive their actual index but not more than the state 20 average index plus .06 for the 1995-96 school year, and thereafter shall 21 receive their actual district index. The district administrative staff index 22 shall be multiplied by the base salary of thirty-three thousand seven hundred 23 sixty dollars ($33,760). The amount so determined shall be multiplied by the 24 district staff allowance for administrative staff determined as provided in 25 section 33-1004(3.), Idaho Code. The resulting amount is the district's 26 salary-based apportionment for administrative staff. 27 (3.) To determine the apportionment for classified staff, multiply eigh- 28 teen thousand six hundred forty-eight dollars ($18,648) by the district clas- 29 sified staff allowance determined as provided in section 33-1004(4.), Idaho 30 Code. The amount so determined is the district's apportionment for classified 31 staff. 32 (4.) The district's salary-based apportionment shall be the sum of the 33 apportionments calculated in subsections (1.), (2.) and (3.), of this section, 34 plus the benefit apportionment as provided in section 33-1004F, Idaho Code.

No food 22 service staff or transportation staff shall be included in the staff 23 allowance. 24 (6.)
