  1                                        AN ACT
  2    RELATING TO THE IDAHO MINT COMMISSION; AMENDING SECTION 22-3811,  IDAHO  CODE,
  3        TO  REVISE  PROVISIONS  RELATING  TO  THE  DISBURSEMENT OF MONEYS FROM THE
  4        ACCOUNTS OF THE IDAHO MINT COMMISSION, TO PROVIDE FOR A SYSTEM OF INTERNAL
  5        ACCOUNTING CONTROLS AND TO MAKE TECHNICAL CORRECTIONS.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  That Section 22-3811, Idaho Code, be, and the same  is  hereby
  8    amended to read as follows:
                                                                        
  9        22-3811.  DISPOSITION OF RECEIPTS AND USE OF MONEYS COLLECTED. (1) As soon
 10    as  possible  after  receipt,  all  moneys received by the commission from the
 11    assessment levied under section 22-3806, of this act Idaho Code, and all other
 12    moneys received by the commission shall be deposited in one (1) or more  sepa-
 13    rate  accounts in the name of the commission in one (1) or more banks or trust
 14    companies approved under chapter 27, title 67, Idaho Code, as state  deposito-
 15    ries. The commission shall designate such accounts at such banks or trust com-
 16    panies.
 17        (2)  (a) No  moneys  shall  be withdrawn from or paid out of such accounts
 18        except upon order of the commission, and upon checks or other orders  upon
 19        such  accounts  signed  by such member of the commission as the commission
 20        designates. and countersigned by such other member, officer or employee of
 21        the commission as the commission designates The commission shall establish
 22        and maintain an adequate and reasonable system of internal accounting con-
 23        trols. The internal accounting controls shall  be  written,  approved  and
 24        periodically reviewed by the commission. A receipt, voucher or other writ-
 25        ten  record, showing clearly the nature and items covered by each check or
 26        other order, shall be kept.
 27        (b)  All moneys referred to in subsection (1) of  this  section  shall  be
 28        used  by the commission only for the payment of expenses of the commission
 29        in carrying out the powers conferred on the commission.
 30        (c)  The commission may require any commission member or agent or employee
 31        appointed by the commission, to give a bond payable to the  commission  in
 32        the  amount, and with the security and containing the terms and conditions
 33        the commission prescribes. The cost of such bond is an administrative cost
 34        under this act chapter.
 35        (3)  The right is reserved to the state of Idaho to audit all funds of the
 36    commission at any time.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE

                             RS 16216

Legislative auditors have indicated that it is no longer
necessary for small commodity commissions to require two (2)
signatures on checking accounts. The commissions require action
by the commission to withdraw or pay out of accounts. These
accounts are audited by legislative auditors. In some instances
members of the commissions are some distance apart and it is
difficult to obtain two (2) signatures.
