]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature Second Regular Session - 2006IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 774 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO THE IDAHO BEAN COMMISSION; AMENDING SECTION 22-2919, IDAHO CODE, 3 TO REVISE PROVISIONS RELATING TO THE DISBURSEMENT OF MONEYS FROM THE 4 ACCOUNTS OF THE IDAHO BEAN COMMISSION, TO PROVIDE FOR A SYSTEM OF INTERNAL 5 ACCOUNTING CONTROLS AND TO MAKE TECHNICAL CORRECTIONS. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 22-2919, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 22-2919. DEPOSIT AND DISBURSEMENT OF FUNDS. (1) Immediately upon receipt, 10 all moneys received by the commission shall be deposited in one (1) or more 11 separate accounts in the name of the commission in one (1) or more banks or 12 trust companies approved under chapter 27, title 67, Idaho Code, as state 13 depositories. The commission shall designate such banks or trust companies. 14 All funds so deposited are hereby continuously appropriated for the purpose of 15 carrying out the provisions of this chapter. 16 (2)Funds canNo moneys shall be withdrawn or paid out of such accounts 17onlyexcept upon order of the commission and upon checks or other orders upon 18 such accounts signed bytwo (2) officers designated by thesuch member of the 19 commission as the commission designates. The commission shall establish and 20 maintain an adequate and reasonable system of internal accounting controls. 21 The internal accounting controls shall be written, approved and periodically 22 reviewed by the commission. 23 (3) The right is reserved to the state of Idaho to audit the funds of the 24 commission at any time. 25 (4) On or before January 15 of each year, the commission shall file with 26 the senate agricultural affairs committee, the house of representatives agri- 27 cultural affairs committee, the legislative services office, the state con- 28 troller, and the division of financial management, a report showing the annual 29 income and expenses by standard classification of the commission during the 30 preceding fiscal year. The report shall also include an estimate of income to 31 the commission for the current and next fiscal year and a projection of antic- 32 ipated expenses by category for the current and next fiscal year. From and 33 after January 15, 1989, the report shall also include a reconciliation between 34 the estimated income and expenses projected and the actual income and expenses 35 of the preceding fiscal year. 36 (5) All moneys received or expended by the commission shall be audited 37 biennially by a certified public accountant designated by the commission, who 38 shall furnish a copy of such audit to the director of legislative services and 39 to the senate agricultural affairs committee and the house of representatives 40 agricultural affairs committee. The audit shall be completed within ninety 41 (90) days following the close of the fiscal year. 42 (6) The expenditures of the commission are expressly exempted from the 43 provisions of sections 67-2007 and 67-2008, Idaho Code.
STATEMENT OF PURPOSE RS 16218 Legislative auditors have indicated that it is no longer necessary for small agricultural commodity commissions to require two (2) signatures on checking accounts. These Idaho Bean Commission accounts are audited by legislative auditors every two years with the state reserving the right to audit the funds at any time. The audits will address each year separately. Commission members often live some distance apart and it is difficult to obtain two (2) signatures on checks.
