BY APPROPRIATIONS COMMITTEE
1 AN ACT
2 APPROPRIATING MONEYS TO THE OFFICE OF THE STATE APPELLATE PUBLIC DEFENDER FOR
3 FISCAL YEAR 2007; LIMITING THE NUMBER OF AUTHORIZED FULL-TIME EQUIVALENT
4 POSITIONS; AND DIRECTING THE ALLOCATION OF SALARY SAVINGS.
5 Be It Enacted by the Legislature of the State of Idaho:
6 SECTION 1. There is hereby appropriated to the Office of the State Appel-
7 late Public Defender the following amounts to be expended according to the
8 designated expense classes from the listed fund for the period July 1, 2006,
9 through June 30, 2007:

11 Personnel Costs $1,417,200
12 Operating Expenditures 548,300
13 TOTAL $1,965,500
14 FROM:
15 General Fund $1,965,500
16 SECTION 2. In accordance with Section 67-3519, Idaho Code, the Office of
17 the State Appellate Public Defender is authorized no more than twenty-one (21)
18 full-time equivalent positions at any point during the period July 1, 2006,
19 through June 30, 2007, for the program specified in Section 1 of this act,
20 unless specifically authorized by the Governor. The Joint Finance-
21 Appropriations Committee will be notified promptly of any increased positions
22 so authorized.
23 SECTION 3. The State Appellate Public Defender is hereby directed to
24 allocate salary savings, based on performance, to provide for employee salary
25 needs before other operational budget priorities are considered. Where appli-
26 cable, employees whose salaries are below the midpoint of their pay grade or
27 occupational groups with significant turnover rates shall be considered first
28 in the order of salary savings distributions.
