]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature Second Regular Session - 2006IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 870 BY APPROPRIATIONS COMMITTEE 1 AN ACT 2 DIRECTING THE STATE CONTROLLER TO TRANSFER MONEYS FROM THE GENERAL FUND TO THE 3 ECONOMIC RECOVERY RESERVE FUND; AND DIRECTING THE STATE CONTROLLER TO 4 TRANSFER MONEYS FROM THE ECONOMIC RECOVERY RESERVE FUND TO THE IDAHO WATER 5 RESOURCE BOARD REVOLVING DEVELOPMENT FUND. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. On July 1, 2006, or as soon thereafter as possible, the State 8 Controller shall transfer the sum of $5,000,000 from the General Fund to the 9 Economic Recovery Reserve Fund. 10 SECTION 2. On July 1, 2006, or as soon thereafter as possible, the State 11 Controller shall transfer the sum of $5,000,000 from the Economic Recovery 12 Reserve Fund to the Idaho Water Resource Board Revolving Development Fund. 13 Such moneys shall be used by the Idaho Water Resource Board to permanently 14 retire water rights within the Eastern Snake Plain Aquifer Conservation 15 Reserve Enhancement Program area.

The Conservation Reserve Enhancement Program (CREP) is a 15 year $253 million proposal to take 100,000 acres of irrigated farmlands out of production in an effort to increase spring flows in the vicinity of Hagerman. Idaho submitted its proposal to the U.S.D.A. Farm Service Agency in December of 2005 which included $10.7 million in cash contributions and $59.3 million of in-kind contributions over 15 years. The proposal also included language that, “the State will seek an appropriation of $5 million over the term of the agreement from the Idaho Legislature for permanent retirement of water rights within the Eastern Snake Plain Aquifer CREP area”.

This bill transfers $5 million from the General Fund through the Economic Recovery Reserve Fund to the continuously appropriated Revolving Development Fund. These moneys will be used by the Idaho Water Resource Board for the CREP program to permanently retire water rights to the benefit of the management of the Eastern Snake Plain Aquifer.
