]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature Second Regular Session - 2006IN THE HOUSE OF REPRESENTATIVES HOUSE CONCURRENT RESOLUTION NO. 48 BY STATE AFFAIRS COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING FINDINGS OF THE LEGISLATURE AND ENCOURAGING THE DEPARTMENT OF HEALTH 3 AND WELFARE TO ELIMINATE PARTIAL CARE SERVICES FOR LOW-INCOME CHILDREN AND 4 ADULTS WITHOUT SERIOUS MENTAL HEALTH DISORDERS AND TO LIMIT MEDICAID MEN- 5 TAL HEALTH BENEFITS FOR LOW-INCOME CHILDREN WITHOUT SERIOUS EMOTIONAL DIS- 6 TURBANCE AND WORKING-AGE ADULTS WITHOUT SEVERE AND PERSISTENT MENTAL ILL- 7 NESS, ENCOURAGING THE ESTABLISHMENT OF A HEALTH RISK ASSESSMENT FOR CER- 8 TAIN INDIVIDUALS, ENCOURAGING CONTINUING THE PROVISION OF INTENSIVE MENTAL 9 HEALTH TREATMENT BENEFITS FOR CERTAIN INDIVIDUALS, ENCOURAGING THE EXPLO- 10 RATION OF MODIFICATIONS OF MENTAL HEALTH BENEFITS FOR INDIVIDUALS WITH 11 DISABILITIES OR SPECIAL HEALTH NEEDS AND REQUESTING A REPORT TO THE LEGIS- 12 LATURE. 13 Be It Resolved by the Legislature of the State of Idaho: 14 WHEREAS, the Medicaid Program in the state of Idaho is unsustainable in 15 its current form and should be reformed so that eligibility, benefits and 16 delivery systems match client health needs; and 17 WHEREAS, the United States Congress has indicated its support for addi- 18 tional flexibility in state management of Medicaid Programs as evidenced by 19 the Medicaid-related provisions in the Deficit Reduction Omnibus Reconcilia- 20 tion Act of 2005; and 21 WHEREAS, the First Regular Session of the Fifty-eighth Idaho Legislature 22 directed the Department of Health and Welfare to develop appropriate levels of 23 mental health services to meet client needs, which may include limiting hours 24 of service; and 25 WHEREAS, Idaho has existing systems of care for children with serious emo- 26 tional disturbances and adults with severe and persistent mental illness that 27 should be supported by Medicaid through design of appropriate benefits. 28 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses- 29 sion of the Fifty-eighth Idaho Legislature, the House of Representatives and 30 the Senate concurring therein, that the Legislature of the State of Idaho 31 encourages the Department of Health and Welfare to eliminate partial care ser- 32 vices for low-income children and adults without serious mental health disor- 33 ders, and to limit the Medicaid mental health benefits for low-income children 34 without serious emotional disturbance and working-age adults without severe 35 and persistent mental illness to twenty-six hours per year of outpatient men- 36 tal health therapy services and to ten days per year of inpatient mental 37 health care. 38 BE IT FURTHER RESOLVED that the Legislature encourages the Department of 39 Health and Welfare to establish a health risk assessment that provides mean- 40 ingful diagnostic information about whether Medicaid-eligible children have 41 serious emotional disturbances and whether Medicaid-eligible adults have 42 severe and persistent mental illness. 43 BE IT FURTHER RESOLVED that the Legislature encourages the Department of 44 Health and Welfare to continue the provision of intensive mental health treat- 2 1 ment benefits, without regard to the limitations set forth above, for 2 Medicaid-eligible children diagnosed as having serious emotional disturbances 3 and Medicaid-eligible adults diagnosed as having severe and persistent mental 4 illness. 5 BE IT FURTHER RESOLVED that the Legislature encourages the Department of 6 Health and Welfare to continue to explore modifications of mental health bene- 7 fits for individuals with disabilities or special health needs in order to be 8 consistent with best clinical practices. 9 BE IT FURTHER RESOLVED that the Department of Health and Welfare is 10 requested to report the results of such benefit changes to the First Regular 11 Session of the Fifty-ninth Idaho Legislature along with recommendations for 12 any further legislative actions.
STATEMENT OF PURPOSE RS 16132 This House Concurrent Resolution requests that the Legislature encourage the Department of Health and Welfare to match mental health benefits to client needs to ensure that resources are directed to those Idahoans who most need Medicaid services. The resolution provides for specific benefits limitations for Medicaid clients who do not need intensive mental health treatment services currently provided under the Idaho Medicaid program. FISCAL NOTE The implementation of these benefit limitations will result in savings to the General Fund of $3,000,000 in fiscal year 2007.
