]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature Second Regular Session - 2006IN THE HOUSE OF REPRESENTATIVES HOUSE CONCURRENT RESOLUTION NO. 55 BY STATE AFFAIRS COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING FINDINGS OF THE LEGISLATURE AND REJECTING PENDING RULES OF THE DIVI- 3 SION OF BUILDING SAFETY GOVERNING ELECTRICAL SPECIALTY LICENSING. 4 Be It Resolved by the Legislature of the State of Idaho: 5 WHEREAS, the Legislature is vested with authority to reject executive 6 agency rules under the provisions of Section 67-5291, Idaho Code, in the event 7 that the Legislature finds that the rules are not consistent with legislative 8 intent; and 9 WHEREAS, it is the finding of the Legislature that certain rules of the 10 Division of Building Safety governing electrical specialty licensing are not 11 consistent with legislative intent and should be rejected. 12 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses- 13 sion of the Fifty-eighth Idaho Legislature, the House of Representatives and 14 the Senate concurring therein, that IDAPA 07.01.04, rules of the Division of 15 Building Safety governing electrical specialty licensing, adopted as a pending 16 rule under Docket Number 07-0104-0502, the entire rulemaking docket, be, and 17 the same is hereby rejected and declared null, void and of no force and 18 effect.
STATEMENT OF PURPOSE RS 16154 This concurrent resolution would reject a pending rule of the Division of Building Safety governing electrical specialty licensing. The effect of this resolution, if adopted by both houses, would be to prevent the agency rule from going into effect. FISCAL NOTE This concurrent resolution has no fiscal impact. Contact Name: Rep.
