]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature Second Regular Session - 2006IN THE SENATE SENATE BILL NO. 1373 BY COMMERCE AND HUMAN RESOURCES COMMITTEE 1 AN ACT 2 RELATING TO LEAVES OF ABSENCE FOR ORGAN DONATIONS; AMENDING CHAPTER 53, TITLE 3 67, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 67-5343, IDAHO CODE, TO 4 PROVIDE A LEAVE OF ABSENCE FOR ORGAN DONATION BY A FULL-TIME STATE 5 EMPLOYEE, TO PROVIDE LIMITATIONS AND TO PROVIDE PROCEDURES; AND AMENDING 6 CHAPTER 16, TITLE 59, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 7 59-1608, IDAHO CODE, TO PROVIDE A LEAVE OF ABSENCE FOR ORGAN DONATION BY A 8 FULL-TIME NONCLASSIFIED OFFICER OR NONCLASSIFIED EMPLOYEE, TO PROVIDE LIM- 9 ITATIONS AND TO PROVIDE PROCEDURES. 10 Be It Enacted by the Legislature of the State of Idaho: 11 SECTION 1. That Chapter 53, Title 67, Idaho Code, be, and the same is 12 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 13 ignated as Section 67-5343, Idaho Code, and to read as follows: 14 67-5343. LEAVE OF ABSENCE FOR ORGAN DONATION. (1) A full-time employee 15 shall be granted a leave of absence for the time specified for the following 16 purposes: 17 (a) Five (5) workdays to serve as a bone marrow donor if the employee 18 provides the appointing authority written verification that the employee 19 is to serve as a bone marrow donor; and 20 (b) Thirty (30) workdays to serve as a human organ donor if the employee 21 provides the appointing authority written verification that the employee 22 is to serve as a human organ donor. 23 (2) An employee who is granted a leave of absence pursuant to the provi- 24 sions of this section shall receive his compensation without interruption dur- 25 ing the leave of absence. For purposes of determining longevity, performance, 26 pay advancement and performance awards and for receipt of any benefit that may 27 be affected by a leave of absence, the service of the employee shall be con- 28 sidered uninterrupted by the leave of absence. 29 (3) The appointing authority shall not penalize an employee for request- 30 ing or obtaining a leave of absence pursuant to the provisions of this sec- 31 tion. 32 (4) The leave authorized by this section may be requested by the employee 33 only if the employee is the person who is serving as the donor. 34 SECTION 2. That Chapter 16, Title 59, Idaho Code, be, and the same is 35 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 36 ignated as Section 59-1608, Idaho Code, and to read as follows: 37 59-1608. LEAVE OF ABSENCE FOR ORGAN DONATION. (1) A full-time nonclassi- 38 fied officer or full-time nonclassified employee shall be granted a leave of 39 absence for the time specified for the following purposes: 40 (a) Five (5) workdays to serve as a bone marrow donor if the officer or 41 employee provides the appointing authority written verification that the 2 1 employee is to serve as a bone marrow donor; and 2 (b) Thirty (30) workdays to serve as a human organ donor if the officer 3 or employee provides the appointing authority written verification that 4 the employee is to serve as a human organ donor. 5 (2) An officer or employee who is granted a leave of absence pursuant to 6 the provisions of this section shall receive his compensation without inter- 7 ruption during the leave of absence. For purposes of determining longevity, 8 performance, pay advancement and performance awards and for receipt of any 9 benefit that may be affected by a leave of absence, the service of the officer 10 or employee shall be considered uninterrupted by the leave of absence. 11 (3) The appointing authority shall not penalize an officer or employee 12 for requesting or obtaining a leave of absence pursuant to the provisions of 13 this section. 14 (4) The leave authorized by this section may be requested by the officer 15 or employee only if the officer or employee is the person who is serving as 16 the donor.
STATEMENT OF PURPOSE RS 15853 This Bill provides a paid leave of absence for any state employee for a period of five(5) days for bone marrow donation and thirty(30) days for live organ donation. Under this provision, a person shall be granted a paid leave of absence for organ or marrow donation purposes only once. FISCAL IMPACT The estimated cost of paid leaves of absence for state employees is $3,100 annually. Increased organ donations would create cost savings in the medicaid program and increase income tax revenue from organ donor recipients.
