]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature Second Regular Session - 2006IN THE SENATE SENATE BILL NO. 1375 BY COMMERCE AND HUMAN RESOURCES COMMITTEE 1 AN ACT 2 RELATING TO LEAVE OF ABSENCE BY STATE EMPLOYEES AND OFFICERS FOR MILITARY 3 DUTY; AMENDING SECTION 46-216, IDAHO CODE, TO PROVIDE THAT ALL OFFICERS 4 AND EMPLOYEES OF THE STATE OF IDAHO WHO SHALL BE MEMBERS OF THE NATIONAL 5 GUARD OR WHO SHALL BE RESERVISTS IN THE ARMED FORCES OF THE UNITED STATES, 6 SHALL BE ENTITLED EACH CALENDAR YEAR TO FIFTEEN DAYS OF MILITARY LEAVE OF 7 ABSENCE FROM THEIR RESPECTIVE DUTIES WITHOUT LOSS OF PAY, TIME, OR EFFI- 8 CIENCY RATING DURING WHICH THEY SHALL BE ENGAGED IN MILITARY DUTY 9 ORDERED OR AUTHORIZED UNDER THE PROVISIONS OF LAW. 10 Be It Enacted by the Legislature of the State of Idaho: 11 SECTION 1. That Section 46-216, Idaho Code, be, and the same is hereby 12 amended to read as follows: 13 46-216. LEAVE OF ABSENCE FROM REGULAR DUTIES FORFIELD TRAINING -- EXCEP-14TIONSMILITARY DUTY. All officers and employees of the state of Idaho who 15 shall be members of the national guard or who shall be reservists in the armed 16 forces of the United States, shall be entitled each calendar year to fifteen 17 (15) days of military leave of absence from their respective duties without 18 loss of pay, time, or efficiency ratingon all daysduring which they shall be 19 engaged infield trainingmilitary duty ordered or authorized under the provi- 20 sions of law.the national defense act; provided that this shall not apply to21any period of time spent in active service of the United States, except that a22period of fifteen (15) days or less in reserve training in any one (1) calen-23dar year shall not be considered time spent in active service of the United24States, for the purposes of this act.
STATEMENT OF PURPOSE RS 16017 The intent of this legislation is to cover a loophole in Idaho Code. Idaho Code currently permits Idaho National Guard Members to take two weeks of paid leave for "field training". However, in the case of deployment, as many recently faced with Iraq, Afghanistan and Hurricane Katrina, Guard members were not permitted to take this leave because such absence was not considered "field training." Since Guard Members will not require "field training" during times of active deployment, this bill changes the language in Idaho code to permit "active deployment" and "field training" to be referred to as "military duty". This will guarantee Guard members their two weeks paid leave regardless of the situation that requires them to leave their regular duties. FISCAL IMPACT None. Contact Name: Sen.
