]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature Second Regular Session - 2006IN THE SENATE SENATE BILL NO. 1390 BY HEALTH AND WELFARE COMMITTEE 1 AN ACT 2 RELATING TO MEDICAID; AMENDING CHAPTER 2, TITLE 56, IDAHO CODE, BY THE ADDI- 3 TION OF A NEW SECTION 56-234, IDAHO CODE, TO STATE LEGISLATIVE FINDINGS 4 AND TO REQUIRE THE DIRECTOR OF THE DEPARTMENT OF HEALTH AND WELFARE TO 5 ESTABLISH A MEDICAID BENEFIT FOR CAREGIVERS AND A CAREGIVER BENEFIT SCALE. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Chapter 2, Title 56, Idaho Code, be, and the same is 8 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 9 ignated as Section 56-234, Idaho Code, and to read as follows: 10 56-234. CAREGIVER SUPPORT. (1) The legislature finds that Idaho medicaid 11 could avoid costs of premature institutional care and ensure delivery of 12 patient-preferred noninstitutional care. Idaho medicaid should support family 13 caregivers who care for elders at risk for nursing home levels of care. 14 (2) The director of the department of health and welfare shall: 15 (a) Establish a medicaid benefit for caregivers of persons who do not 16 currently meet criteria for nursing facility levels of care but whose 17 informal caregivers have a demonstrated state of physical, emotional or 18 mental fatigue; and 19 (b) Use an established scale to measure caregiver capacity and vulner- 20 ability and to determine eligibility for respite benefits.

STATEMENT OF PURPOSE RS 16053 This legislation relating to Medical Assistance establishes a Medicaid respite care benefit for family caregivers of persons at risk of nursing home levels of care. It is the intent of this Legislature that use of this benefit is limited to situations wherein the expected overall cost of services for nursing facilities and services for aged and disabled, as defined in federal code, will be budget neutral. FISCAL NOTE This Medicaid caregiver support benefit will require use of Medicaid Trustee & Benefit (T&B) funds to fund services for targeted persons. These services will be designed to divert nursing facility admissions and should therefore simultaneously reduce Medicaid (T&B) expenditures in FY2007 and thereafter. The precise fiscal impact of this legislation cannot be determined at this time and will depend on the design of the caregiver assessment instrument by the Department of Health and Welfare. At a current cost of $4,000 person per month for nursing facility care, one nursing home diversion would offset the cost for 20 persons receiving respite care at an estimated cost of $200 per person per month.
