]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature Second Regular Session - 2006IN THE SENATE SENATE BILL NO. 1399 BY JUDICIARY AND RULES COMMITTEE 1 AN ACT 2 RELATING TO HOMESTEADS; AMENDING SECTION 55-1003, IDAHO CODE, TO INCREASE THE 3 MAXIMUM PERMITTED HOMESTEAD EXEMPTION AMOUNT; AND DECLARING AN EMERGENCY. 4 Be It Enacted by the Legislature of the State of Idaho: 5 SECTION 1. That Section 55-1003, Idaho Code, be, and the same is hereby 6 amended to read as follows: 7 55-1003. HOMESTEAD EXEMPTION LIMITED. A homestead may consist of lands, 8 as described in section 55-1001, Idaho Code, regardless of area, but the home- 9 stead exemption amount shall not exceed the lesser of (i) the total net value 10 of the lands, mobile home, and improvements as described in section 55-1001, 11 Idaho Code; or (ii) the sum offiftyone hundred thousand dollars 12 ($50100,000). 13 SECTION 2. An emergency existing therefor, which emergency is hereby 14 declared to exist, this act shall be in full force and effect on and after its 15 passage and approval.
STATEMENT OF PURPOSE RS 15890C1 The purpose of this legislation is to adjust the limitation on the homestead exemption allowed in collections and bankruptcy proceedings. This bill raises the exemption from $50,000.00 to $100,000.00. This homestead exemption has not been adjusted since 1992. FISCAL NOTE There is no fiscal impact on the state general fund.
