]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature Second Regular Session - 2006IN THE SENATE SENATE BILL NO. 1492 BY JUDICIARY AND RULES COMMITTEE 1 AN ACT 2 RELATING TO MEETINGS; PROVIDING LEGISLATIVE INTENT; AND REPEALING SECTION 3 67-2346, IDAHO CODE, RELATING TO OPEN LEGISLATIVE MEETINGS. 4 Be It Enacted by the Legislature of the State of Idaho: 5 SECTION 1. LEGISLATIVE FINDINGS -- INTENT. The Legislature finds that 6 there is a need to repeal a section of the Idaho Code that has been superseded 7 by rules of the Senate and the House of Representatives that govern certain 8 legislative procedures as authorized by the Constitution of the State of Idaho 9 and that provide for the meetings of any standing, special or select committee 10 to be open to the public. 11 SECTION 2. That Section 67-2346, Idaho Code, be, and the same is hereby 12 repealed.

That Section 67-2346, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 67-2346. OPEN LEGISLATIVE MEETINGS REQUIRED. All meetings of any stand- 9 ing, special or select committee of either house of the legislature of the 10 state of Idaho shall be open to the public at all times, except in extraordi- 11 nary circumstances as provided specifically in the rules of procedure in 12 either house, and any person may attend any meeting of a standing, special or 13 select committee, but may participate in the committee only with the approval 14 of the committee itself.". 15 CORRECTION TO TITLE 16 On page 1, in line 2, delete "REPEALING" and insert: "AMENDING"; and 17 delete line 3 and insert: "67-2346, IDAHO CODE, TO PROVIDE THAT ALL MEETINGS 18 OF ANY STANDING, SPECIAL OR SELECT COMMITTEE OF EITHER HOUSE OF THE LEGISLA- 19 TURE SHALL BE OPEN TO THE PUBLIC AT ALL TIMES, EXCEPT IN EXTRAORDINARY CIRCUM- 20 STANCES AS PROVIDED SPECIFICALLY IN THE RULES OF PROCEDURE IN EITHER HOUSE.".

STATEMENT OF PURPOSE RS 16314 Article III, Section 9 of Idaho's Constitution gives both houses of the Legislature the power to determine their own rules of proceeding. This bill would delete a code section that has been superseded by other provisions of the Senate rules that have been found to be constitutional by the Idaho Supreme Court.
