]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature Second Regular Session - 2006IN THE SENATE SENATE BILL NO. 1495 BY FINANCE COMMITTEE 1 AN ACT 2 DIRECTING THE STATE CONTROLLER TO TRANSFER MONEYS FROM THE GENERAL FUND TO THE 3 ECONOMIC RECOVERY RESERVE FUND; AND APPROPRIATING ADDITIONAL MONEYS TO THE 4 DEPARTMENT OF ENVIRONMENTAL QUALITY FOR FISCAL YEAR 2007 THROUGH FISCAL 5 YEAR 2008. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. On July 1, 2006, or as soon thereafter as possible, the State 8 Controller shall transfer the sum of $54,200 from the General Fund to the Eco- 9 nomic Recovery Reserve Fund. 10 SECTION 2. In addition to any other appropriation provided by law, there 11 is hereby appropriated to the Department of Environmental Quality $54,200 12 from the Economic Recovery Reserve Fund for the Water Quality Program to be 13 expended for operating expenditures for the period July 1, 2006, through June 14 30, 2008. Such appropriation shall be expended to provide for water quality 15 monitoring activities to establish baseline water quality conditions in the 16 Clark Fork River and Lake Pend Oreille.

The Department of Environmental Quality recently entered into a contract with the Tri-State Implementation Council for one year to expand water quality monitoring activities in the Clark Fork River and Lake Pend Oreille (Idaho, Montana, Washington) . This was a result of ongoing Idaho citizen concern over the potential effects of the Rock Creek Mine development and the Milltown Dam removal on Idaho water quality. The overall objective of the expanded monitoring is to establish a more comprehensive baseline of water quality conditions in the river and key areas of the lake, prior to development of the mine and removal of the dam. Expanded monitoring includes: 1) additional metals and nutrient monitoring in the Clark Fork River and Lake Pend Oreille, 2) chemistry, sediment and flow monitoring in Rock Creek near the vicinity of the proposed mine and 3) biological monitoring in the Clark Fork River and Lake Pend Oreille. Funding from DEQ’s 2006 budget could only be provided for one year of monitoring. Additional funding will provide for an additional year of monitoring and will greatly increase our understanding of baseline water quality conditions.

The bill transfers $54,200 from the General Fund to the Economic Recovery Reserve Fund. It then appropriates that amount to the Department of Environmental Quality to be used one-time for water quality monitoring of the Clark Fork River and Lake Pend Oreille.
