]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature Second Regular Session - 2006IN THE SENATE SENATE CONCURRENT RESOLUTION NO. 131 BY JUDICIARY AND RULES COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING LEGISLATIVE FINDINGS AND REQUESTING THE IDAHO DEPARTMENT OF ENVIRON- 3 MENTAL QUALITY TO PREPARE A REPORT ASSESSING THE NATURE AND EXTENT OF MER- 4 CURY CONTAMINATION IN THE ENVIRONMENT OF THE STATE OF IDAHO AND THE POTEN- 5 TIAL ENVIRONMENTAL IMPACTS FROM THE ADDITION OF ANY NEW SOURCES OF MER- 6 CURY. 7 Be It Resolved by the Legislature of the State of Idaho: 8 WHEREAS, the Legislature recognizes that the presence of mercury contami- 9 nation in the environment is a concern to the public health, environment and 10 economy of the state of Idaho; and 11 WHEREAS, mercury contamination has been detected at levels of concern in 12 the waters of the state; and 13 WHEREAS, it is in the best interests of the citizens of the state for 14 Idaho's elected officials to make informed decisions regarding pollutants 15 released into our environment and their effect on the health and safety of our 16 citizens; and 17 WHEREAS, the Idaho Department of Environmental Quality's task is specifi- 18 cally to adopt and implement programs to protect Idaho's air and water quality 19 and public health, and to ensure proper disposal of waste. 20 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses- 21 sion of the Fifty-eighth Idaho Legislature, the Senate and the House of Repre- 22 sentatives concurring therein, that the Idaho Department of Environmental 23 Quality is requested to compile and assess the available information, conduct 24 relevant studies, and prepare a report to: 25 (1) Identify existing sources of mercury contamination in the Idaho envi- 26 ronment, including in-state sources, sources in surrounding states, 27 national sources and global sources; 28 (2) Delineate the nature and extent of any known existing mercury contam- 29 ination in the environment in the state of Idaho, including the status of 30 all major water bodies in Idaho; 31 (3) Describe the potential effect of the existing mercury contamination 32 on public health and the environment; and 33 (4) Assess the potential impacts of air pollution, water pollution and 34 waste from the addition of any new sources of mercury in the state. 35 BE IT FURTHER RESOLVED that the report is requested to be submitted to 36 the Governor and the Legislature not later than January 7, 2007. After the 37 date this Resolution is adopted, the Idaho Department of Environmental Quality 38 is requested to promulgate an administrative rule specifically opting out of 39 the mercury cap and trade program in 40 CFR Part 60, Subpart HHHH. Upon review 40 of the report's findings, the Legislature may request the Idaho Department of 41 Environmental Quality to take no action with regard to the administrative 42 rule. In the alternative, the Legislature may request the Idaho Department of 43 Environmental Quality to revise the administrative rule to opt in to the cap 44 and trade program, and may further request the Idaho Department of Environmen- 2 1 tal Quality to promulgate a rule that, among other things, establishes spe- 2 cific limitation and monitoring requirements on mercury emissions.
