 1                                        AN ACT
 2    RELATING TO SPECIAL MOTOR VEHICLE LICENSE PLATE  PROGRAMS;  AMENDING  SECTIONS
 3        49-404,  49-404A,  49-405, 49-407, 49-408, 49-409, 49-410, 49-414, 49-415,
 4        49-415A, 49-415B, 49-416, 49-417, 49-417A, 49-418 AND 49-418A, IDAHO CODE,
 5        TO PROVIDE FOR THE ISSUANCE OF SPECIAL LICENSE PLATES FOR COMMERCIAL, NON-
 6        COMMERCIAL AND FARM VEHICLES WITH A REGISTERED MAXIMUM GROSS WEIGHT OF NOT
 7        MORE THAN SIXTEEN THOUSAND POUNDS; AND PROVIDING AN EFFECTIVE DATE.

 8    Be It Enacted by the Legislature of the State of Idaho:

 9        SECTION 1.  That Section 49-404, Idaho Code, be, and the  same  is  hereby
10    amended to read as follows:

11        49-404.  NATIONAL  GUARD  MEMBERS  --  DISTINCTIVE PLATES. (1) In order to
12    enhance  visibility  and  identification  of  national  guard  members  during
13    mobilizations and emergencies, any active member of the Idaho  national  guard
14    residing in the state of Idaho may, upon application to the department, regis-
15    ter  not  more  than two (2)  passenger  motor vehicles and receive
16    for each vehicle distinctive national guard license plates in lieu of  regular
17    license  plates.    The provisions of this section shall not apply to any
18    vehicle with a registered maximum gross weight over sixteen thousand  (16,000)
19    pounds.  The national guard license plates shall be designed, subject to
20    the  approval  of  the  department, by the adjutant general. Proof of being an
21    active member in the Idaho national guard must be furnished to the  department
22    before plates will be issued.
23        The  Idaho  national  guard shall, prior to an individual's discharge from
24    active duty in the national guard, require that  the  national  guard  license
25    plates  either  be  turned  in to the department or exchanged for other proper
26    license plates as a condition of discharge.
27        (2)  Whenever a member of the Idaho national guard  transfers  or  assigns
28    his  title or interest to a vehicle especially registered under the provisions
29    of this section, the registration shall expire but the  member  may  hold  his
30    national  guard license plates which he may have reissued to him upon the pay-
31    ment of the required transfer fees. He  may  only  display  the  plates  after
32    receipt of new registration from the department.
33        (3)  In addition to the regular registration fee s  required in
34    section  49-402(1)    or 49-434(1) , Idaho Code, the national guard
35    member shall pay the plate fee specified in section 49-450, Idaho Code.

36        SECTION 2.  That Section 49-404A, Idaho Code, be, and the same  is  hereby
37    amended to read as follows:

38        49-404A.  MEMBERS  OF  THE ARMED FORCES RESERVE -- SPECIAL PLATES. (1) Any
39    active member of the armed forces reserves of the United  States  who  is  the
40    owner  of  a  vehicle    required  to  be  registered under section
41    49-402(1)  or section 49-434(1) , Idaho Code, may, upon application

 1    to the department, register not more than two (2)  passenger  motor
 2    vehicles and  receive for each vehicle special license plates in lieu of regu-
 3    lar numbered plates.  The provisions of this section shall not  apply  to
 4    any  vehicle  with  a  registered  maximum  gross weight over sixteen thousand
 5    (16,000) pounds.  The special license plates shall be designated by  the
 6    department  with  the  word  "RESERVIST" centered along the bottom edge and be
 7    numbered in sets of two (2) with a different number following appropriate let-
 8    ters as follows: United States Army Reserve: Army (number); United States Navy
 9    Reserve: Navy (number); United States Marine  Corps  Reserve:  USMC  (number);
10    United  States Air Force Reserve: USAF (number); and United States Coast Guard
11    Reserve: USCG (number). Proof of being an active member in the  United  States
12    armed  forces  reserves  must  be  furnished  to the department before special
13    plates will be issued. Special license plates issued under this section  shall
14    be  issued  under  the  staggered registration process provided for in section
15    49-402(1), Idaho Code , or the annual registration in section  49-434(1),
16    Idaho Code .
17        (2)  Any  branch  of the armed forces reserves of the United States shall,
18    prior to an individual's discharge from duty  in  that  branch  of  the  armed
19    forces  reserve,  require that the special armed forces reserve license plates
20    either be turned back to the department or exchanged for other proper  license
21    plates as a condition of discharge.
22        (3)  In addition to the regular registration fee s  required in
23    section  49-402(1)   or 49-434(1) , Idaho Code, the applicant shall
24    pay the initial program fee and the annual program fee  specified  in  section
25    49-402(8),  Idaho  Code.  The  initial  program fee and the annual program fee
26    shall be deposited in the state highway account and shall be used to fund  the
27    cost of administration of this special license plate program which is provided
28    to the public as a personal alternative to the standard license plate require-
29    ment.  When  a  plate holder transfers or assigns his title or interest in the
30    vehicle registered under this section, the registration shall expire, but  the
31    special  plates  may  be  transferred  to  another vehicle upon payment of the
32    required transfer fee. Special plates shall only be displayed after receipt of
33    the new registration.
34        (4)  The design and numbering scheme of  the  military  reservist  special
35    plate shall be coordinated by the department with representatives of the armed
36    forces  reserves. However, the department shall have the final approval of the
37    plate design and numbering scheme to ensure conformity within existing  issues
38    of  plates  and  to  contain  costs within the limit of the fees received from
39    applicants.

40        SECTION 3.  That Section 49-405, Idaho Code, be, and the  same  is  hereby
41    amended to read as follows:

42        49-405.  RADIO AMATEURS -- SPECIAL LICENSE PLATES. (1) In order to enhance
43    visibility  and identification of radio amateurs during times of emergency any
44    radio amateur residing in the state of Idaho, may,  upon  application  to  the
45    department,  register  one  (1)  motor vehicle per radio license issued by the
46    federal government and receive for that vehicle special license plates in lieu
47    of regular license plates.  The provisions  of  this  section  shall  not
48    apply to any vehicle with a registered maximum gross weight over sixteen thou-
49    sand (16,000) pounds.  The number on the plates shall be the same combi-
50    nation  of figures and letters that make up the radio call sign of the amateur
51    radio operator.
52        (2)  Proof of holding an amateur license from the  federal  communications
53    commission  must  be  furnished  to  the  department before the plates will be

 1    issued. Should the amateur's radio license expire during any  given  year  and
 2    not  be renewed, the special license plates must be surrendered to the depart-
 3    ment and regular license plates obtained.
 4        (3)  Radio amateurs will notify the department at a time to be set by  the
 5    department  of  their  intention  to  procure special license plates under the
 6    terms specified in this section. Failure to do so will result in  the  amateur
 7    being  required  to  accept  regular  license  plates should the department be
 8    unable to procure the special plates. Special plates  may  still  be  procured
 9    when available but amateurs will be subject to the usual transfer fee.
10        (4)  Whenever  an  amateur transfers or assigns his title or interest to a
11    vehicle especially registered the registration shall expire, but  the  amateur
12    may hold his special license plates which he may have reissued to him upon the
13    payment  of  the  required transfer fees. He may only display the plates after
14    receipt of new registration from the department.
15        (5)  In addition to the regular registration fee s  required in
16    section 49-402(1)  or 49-434(1) , Idaho Code, the  applicant  shall
17    pay the plate fee specified in section 49-450, Idaho Code.

18        SECTION  4.  That  Section  49-407, Idaho Code, be, and the same is hereby
19    amended to read as follows:

20        49-407.  YEAR OF MANUFACTURE PLATE. Pursuant to rules of  the  department,
21    any  person  who  is  the  owner of a motor vehicle thirty (30) years or older
22    which is registered under section 49-402(1) or (2), Idaho Code,  or  sec-
23    tion  49-434(1),  Idaho Code,  may display on the rear of the vehicle an
24    authentic Idaho plate manufactured in the same year as the vehicle.   The
25    provisions  of  this  section shall not apply to any vehicle with a registered
26    maximum gross weight over sixteen thousand (16,000) pounds. 
27        In addition to the regular registration  fee  s    required  in
28    section  s    49-402(1)  and (2),  and 49-434(1),  Idaho
29    Code, the applicant shall pay the initial program fee and the  annual  program
30    fee specified in section 49-402(8), Idaho Code.

31        SECTION  5.  That  Section  49-408, Idaho Code, be, and the same is hereby
32    amended to read as follows:

33        49-408.  STREET ROD. (1) Any motor vehicle manufactured prior to the  year
34    1949,  or  designed  and manufactured to resemble such a vehicle and which has
35    been certified as a street rod may be registered as a  street  rod  under  the
36    provisions  of  this  section.    However, the provisions of this section
37    shall not apply to any vehicle with a registered  maximum  gross  weight  over
38    sixteen thousand (16,000) pounds. 
39        (2)  Any  street rod shall have all equipment in operating condition which
40    was specifically required by law as a condition for its first sale after manu-
41    facture. No law requiring any particular equipment or specifying any standards
42    to be met by motor vehicles shall apply to street rods unless it  so  specifi-
43    cally states.
44        (3)  Upon receipt of an application on a form prescribed by the department
45    for  a special street rod automobile plate, accompanied by other documentation
46    required in this section, the department shall issue to the applicant  a  spe-
47    cial  street  rod automobile plate which shall be displayed on the rear of the
48    vehicle. The registration certificate need  not  specify  the  weight  of  the
49    street  rod,  and  the  plate  issued  shall  bear  no date but shall bear the
50    inscription "Street Rod," "Idaho," a picture of a 1929 highway  roadster,  and
51    the  registration  number  issued  for  the street rod, and the plate shall be

 1    valid upon annual renewal under section  49-402    or  49-434(1)  ,
 2    Idaho  Code,  as long as the vehicle is in existence. The plate will be issued
 3    for the applicant's use only for the particular vehicle, and in the event of a
 4    transfer of title, the transferor may  hold  the  plate  and  transfer  it  to
 5    another qualifying street rod.
 6        (4)  In addition to the regular registration fee s  required in
 7    section  49-402(1)   or 49-434(1) , Idaho Code, the applicant shall
 8    pay the initial program fee and the annual program fee  specified  in  section
 9    49-402(8), Idaho Code.
10        (5)  The  department has the power to revoke any registration issued under
11    this section for cause shown for failure of the applicant to comply  with  the
12    provisions of this section.

13        SECTION  6.  That  Section  49-409, Idaho Code, be, and the same is hereby
14    amended to read as follows:

15        49-409.  PERSONALIZED LICENSE PLATES. (1) Any person who is the  reg-
16    istered  owner of a vehicle  registered  under  section  49-402  or
17    49-434(1),  Idaho  Code,    may apply to the department for personalized
18    license plates in lieu of regular numbered  plates  except    for  
19     that this provision shall not apply to  a vehicle registered under
20    section  49-434 (1), Idaho Code, with a maximum gross weight over sixteen
21    thousand (16,000) pounds  or  any vehicle registered under  section
22      49-435,  Idaho  Code.  In  addition  to  the regular registration fees
23    required in section 49-402(1), (2), (3) and (4) ,   and 
24    section 49-422,  and section 49-434(1),  Idaho Code, the  applicant
25    shall pay the initial program fee and the annual program fee specified in sec-
26    tion  49-402(8),  Idaho  Code. The personalized license plates shall be of the
27    same color and design as other license plates, and shall consist of numbers or
28    letters, or any combination thereof, not exceeding  seven  (7)  positions.  No
29    more  than  one  (1) particular combination of letters and numbers shall be in
30    existence at any one (1) time. The form for application of the plates will  be
31    as  prescribed by the director and, in his discretion, may refuse to issue the
32    plates.
33        (2)  When personalized license plates are issued for a vehicle, the  regu-
34    lar license plates for that vehicle belong to the registrant and may be trans-
35    ferred to another vehicle owned by the personalized plate applicant.

36        SECTION  7.  That  Section  49-410, Idaho Code, be, and the same is hereby
37    amended to read as follows:

38        49-410.  SPECIAL LICENSE PLATES AND CARDS FOR PERSONS WITH A DISABILITY --
39    PARKING PRIVILEGES -- CARDS FOR CERTAIN TEMPORARILY DISABLED PERSONS. (1)  Any
40    person with a disability as defined in section 49-117, Idaho Code, or any par-
41    ent  or  guardian of a dependent child with a disability as defined in section
42    49-117, Idaho Code, without regard to the age of the dependent child, shall be
43    eligible for the use of  special  license  plates  bearing  the  international
44    accessible  symbol,  for any vehicle owned by such person or owned by a quali-
45    fied parent or guardian,  provided the vehicle does not weigh  in  excess
46    of  eight    but excluding any commercial vehicle with a registered
47    maximum gross weight over sixteen   thousand  (  8    16
48    ,000) pounds .   and is not used in the furtherance of a
49    business. 
50        (2)  Registration  and  license  plate fees for vehicles owned by a person
51    with a disability or qualified parent or guardian of a dependent child with  a

 1    disability,  shall  be  as  provided,  respectively, in sections 49-402 ,
 2    49-434(1)  and 49-450, Idaho Code , for vehicles not in  excess  of
 3    eight thousand (8,000) pounds gross weight, and as provided in section 49-434,
 4    Idaho  Code,  for  noncommercial  vehicles in excess of eight thousand (8,000)
 5    pounds gross weight . Nothing in this  section  shall  be  construed  as
 6    abrogating  provisions  of  section 49-445, Idaho Code. The use of the special
 7    card issued under the provisions of subsection (4) of this section, shall  not
 8    exempt  the  owner  of a motor vehicle from otherwise properly registering and
 9    licensing the motor vehicle.
10        (3)  Special license plates for persons with a disability and for the par-
11    ent or guardian of a dependent child with a disability, shall be the same size
12    and color as other license plates, and shall have displayed upon them the reg-
13    istration numbers assigned to the vehicle and to the owner. The  plates  shall
14    be  numbered  in  a  manner prescribed by the department, but the plates shall
15    display the international accessible symbol.

17        (4)  The department shall issue a special card bearing  the  international
18    accessible symbol and other information the department may require, to:
19        (a)  Any qualified person with a disability who does not own a motor vehi-
20        cle;
21        (b)  Any  qualified  person  with  a  disability who owns a motor vehicle,
22        without regard to weight or use of the vehicle;
23        (c)  Any parent or guardian of a dependent child  with  a  disability  who
24        owns a motor vehicle without regard to weight or use of the vehicle;
25        (d)  Any  business  entity  which  is engaged in transportation of persons
26        with a disability, which business  shall  not  be  required  to  submit  a
27        physician's  certification. In addition to other application requirements,
28        a business applicant shall sign a declaration that he is  engaged  in  the
29        transportation of persons with a disability. A business entity may include
30        but  not  be limited to hospitals, nursing homes, federal, state and local
31        governmental agencies and taxicabs.
32        (5)  The fee for a special accessible card shall be five  dollars  ($5.00)
33    which  shall  be deposited in the state highway account established in section
34    40-702, Idaho Code.
35        (6)  Any person or business issued a special card shall affix the  special
36    card  to  a motor vehicle in a conspicuous place designated by the department.
37    The card shall bear distinguishing marks, letters or numerals  indicating  the
38    vehicle is utilized by a permanently disabled person. When the card is affixed
39    to  a motor vehicle and the motor vehicle is transporting a person with a dis-
40    ability, special parking privileges are granted as provided in subsection  (8)
41    of this section.
42        (7)  Application  for  special  license plates, a special card, or both as
43    applicable and at the option of the applicant, shall be made upon a form  fur-
44    nished  by  the  department  and  shall  include  a written certification by a
45    licensed physician verifying that the applicant's stated impairment  qualifies
46    as a disability according to the provisions of section 49-117, Idaho Code.
47        (8)  Any motor vehicle displaying special license plates for a person with
48    a  disability, without regard to the state of residence or displaying the spe-
49    cial card provided in subsection (5) and (9) of this section, shall be allowed
50    to park for unlimited periods of time in parking  zones  or  areas  which  are
51    otherwise  restricted  as  to  the length of time parking is permitted, and to

 1    park in any public parking space with metered parking without  being  required
 2    to  pay  any parking meter fee. The provisions of this subsection shall not be
 3    applicable to those zones or areas in which the stopping, parking, or standing
 4    of all vehicles is prohibited or which are reserved for special types of vehi-
 5    cles.
 6        (9)  Any person who shall submit satisfactory proof to the department that
 7    he is so temporarily disabled as to be unable  to  move  without  the  aid  of
 8    crutches or a wheelchair, shall be entitled to receive for one (1) motor vehi-
 9    cle  only,  a  special card to be affixed  to a motor vehicle in a conspicuous
10    place designated by the department, bearing distinguishing marks,  letters  or
11    numerals  indicating  that  the  vehicle is utilized by a temporarily disabled
12    person. This special temporary card shall expire six (6) months from the  date
13    of issuance, or sooner as specified by the department on the card. The fee for
14    a  temporary  card shall be five dollars ($5.00), two dollars ($2.00) of which
15    shall be retained by the county and credited to  the  county  current  expense
16    fund,  and  three  dollars  ($3.00) of which shall be transmitted to the state
17    treasurer for deposit in the state highway account. When the card is issued by
18    the department the five dollars ($5.00) shall be deposited in the state  high-
19    way account.
20        (10) Any unauthorized use of the plate or card shall constitute an infrac-
21    tion  punishable by a fine of fifty dollars ($50.00). The second offense shall
22    be punishable by a fine of fifty dollars ($50.00) and loss of  parking  privi-
23    leges for the registered owner of the vehicle displaying the plates or for the
24    person to whom the card was issued, for a period of one (1) year.
25        Law enforcement officials shall enforce the provisions of this section and
26    are  empowered,  using reasonable discretion, to check personal identification
27    to determine if the user of the plate or placard is authorized to use accessi-
28    ble parking privileges. Any fines collected shall be retained by the  city  or
29    county whose law enforcement official issued the citation.

30        SECTION  8.  That  Section  49-414, Idaho Code, be, and the same is hereby
31    amended to read as follows:

32        49-414.  LEGISLATIVE LICENSE  PLATES  --  FEES.  (1)  Special  legislative
33    license  plates shall be issued by the department upon application and payment
34    of the required fees. Each legislator is eligible  for      to
35    register  and  receive  special license plates  for one (1) vehicle
36    whose registered  maximum  gross  weight  does  not  exceed  sixteen  thousand
37    (16,000)  pounds  .  The  registration period shall be for one (1) year,
38    from January 1 through December 31, and may be renewed, as long as the  legis-
39    lator  holds  office.  The plates shall bear either the inscription "House" or
40    "Senate", shall contain a consecutive numbering from one (1) through the maxi-
41    mum number of members in each body with the numbers  to  be  assigned  by  the
42    speaker  of  the house of representatives and the president pro tempore of the
43    senate, and shall otherwise comply with  the  provisions  of  section  49-443,
44    Idaho Code.
45        (2)  In addition to the regular registration fee s  required in
46    section  49-402(1)   or 49-434(1) , Idaho Code, the applicant shall
47    pay the initial program fee and the annual program fee as specified in section
48    49-402(8), Idaho Code.

49        SECTION 9.  That Section 49-415, Idaho Code, be, and the  same  is  hereby
50    amended to read as follows:

51        49-415.  FORMER PRISONER OF WAR LICENSE PLATES. (1) Any veteran, who was a

 1    prisoner  of  war  (POW)  of an armed enemy of the United States during active
 2    service in the armed forces of the United States, that service occurring  dur-
 3    ing any portion of a recognized war period enumerated in this section, and who
 4    has been released or discharged from the armed forces under other than dishon-
 5    orable  conditions,  may  upon  application  to  the  department, register and
 6    receive for not more than two (2) motor vehicles, special former  prisoner  of
 7    war  license plates in lieu of regular license plates.  The provisions of
 8    this section shall not apply to any vehicle with a  registered  maximum  gross
 9    weight over sixteen thousand (16,000) pounds. 
10        (2)  In addition to the regular registration fee s  required in
11    section  49-402(1)   or 49-434(1) , Idaho Code, the applicant shall
12    pay the plate fee required in section 49-450, Idaho Code.  Whenever  a  former
13    prisoner of war transfers or assigns his title or interest to a vehicle regis-
14    tered  under  this section the registration shall expire, but the former pris-
15    oner of war may hold the special plates  and  may  have  them  transferred  to
16    another  vehicle upon payment of the required transfer fee provided in section
17    49-431, Idaho Code. He may only display the plates after receipt  of  the  new
18    registration document from the department.
19        (3)  Former  prisoner  of  war license plates shall bear the words "Former
20    Prisoner of War" and a declaration of the period of service, and shall in  all
21    other respects be as provided by law.
22        (4)  Recognized  war  periods for the purpose of this section shall be any
23    period of war recognized by the United States department of  veterans  affairs
24    for  the  purpose  of  awarding federal veterans benefits as may be defined in
25    title 38, U.S. code, chapter 1, section 101(11).

26        SECTION 10.  That Section 49-415A, Idaho Code, be, and the same is  hereby
27    amended to read as follows:

28        49-415A.  CONGRESSIONAL  MEDAL  OF HONOR LICENSE PLATES. (1) Congressional
29    medal of honor license plates are available to applicants who furnish proof of
30    entitlement by certification from the United  States  Veterans  Administration
31    attesting to their status as a congressional medal of honor recipient.
32        (2)  The  license  plates  shall be provided free of charge. The applicant
33    shall pay the regular annual registration  fees  required  by  section  49-402
34      or  49-434(1)  , Idaho Code.  The provisions of this section
35    shall not apply to any vehicle with a registered  maximum  gross  weight  over
36    sixteen  thousand  (16,000)  pounds.   If the plate holder transfers his
37    title or interest to a vehicle registered under this section, the  plates  may
38    be transferred to another vehicle owned by the plate holder. If the plates are
39    unexpired, the plate holder shall be given credit for the unexpired portion of
40    the registration fee against the new registration fee. The transfer fee speci-
41    fied by section 49-431(1), Idaho Code, shall apply.
42        (3)  These  provisions shall apply to the vehicle to which the plates were
43    originally issued and to any vehicle subsequently purchased and owned  by  the
44    medal  of  honor recipient, except that the privilege shall not extend to more
45    than two (2) vehicles at a time.

46        SECTION 11.  That Section 49-415B, Idaho Code, be, and the same is  hereby
47    amended to read as follows:

48        49-415B.  PEARL HARBOR SURVIVOR SPECIAL PLATES. (1) Any veteran who was on
49    active duty in the armed forces of the United States and assigned or stationed
50    at  Pearl  Harbor,  Hawaii, or within three (3) miles of the island of Oahu on
51    December 7, 1941, and who has been  released  or  discharged  from  the  armed

 1    forces  under  other than dishonorable conditions, may upon application to the
 2    department, register and receive for not more than  two  (2)  motor  vehicles,
 3    special  Pearl Harbor survivor number plates in lieu of regular number plates.
 4     The provisions of this section shall not apply to  any  vehicle  with  a
 5    registered maximum gross weight over sixteen thousand (16,000) pounds. 
 6        (2)  In addition to the regular registration fee s  required in
 7    section  49-402(1)   or 49-434(1) , Idaho Code, the applicant shall
 8    be charged the plate fee required in section 49-450, Idaho  Code.  Whenever  a
 9    qualifying  survivor  of  the  Japanese  attack on Pearl Harbor on December 7,
10    1941, transfers or assigns his title or interest to a vehicle especially  reg-
11    istered  under this section, the registration shall expire, but the Pearl Har-
12    bor survivor may hold his special plates which he may  have  reissued  to  him
13    upon  the  payment  of  the  required transfer fees. He may only display those
14    plates after receipt of a new registration from the department.
15        (3)  Pearl Harbor survivor plates shall bear the characters: "Pearl Harbor
16    Survivor" and shall in all other respects be as provided by law.

17        SECTION 12.  That Section 49-416, Idaho Code, be, and the same  is  hereby
18    amended to read as follows:

19        49-416.  STATEHOOD  CENTENNIAL  LICENSE  PLATES.  (1) Statehood centennial
20    license plates are available to owners of motor vehicles required to be regis-
21    tered under section 49-402(1) or section 49-402(3)  or section  49-434(1)
22    ,  Idaho  Code, upon application at a county assessor's office or at the
23    department.  The provisions of this section shall not apply to any  vehi-
24    cle  with  a  registered  maximum  gross weight over sixteen thousand (16,000)
25    pounds.  Availability of statehood centennial plates for  other  classes
26    of vehicle registrations shall be as authorized by rule s and regulations
27      of  the department. In addition to the regular registration fee s
28     required in section 49-402(1)  or 49-434(1)  ,  Idaho  Code,
29    the  applicant shall pay the initial program fee and the annual program fee as
30    specified in section 49-402(8), Idaho Code. All  revenues  from  such  initial
31    registration and annual renewal fees shall be deposited in the highway distri-
32    bution account.
33        (2)  The  statehood  centennial  license  plates  shall  be of a color and
34    design approved by the department, utilizing a numbering  system  approved  by
35    the  board.  The  statehood centennial license plates must be surrendered upon
36    failure to pay the annual special fee and renewal fees.
37        (3)  Any person who applies for statehood centennial license  plates,  may
38    also  apply  for  personalized numbers and/or letters on those plates, as pro-
39    vided for in section 49-409, Idaho Code.

40        SECTION 13.  That Section 49-417, Idaho Code, be, and the same  is  hereby
41    amended to read as follows:

42        49-417.  IDAHO  WILDLIFE  SPECIAL  PLATES.  (1)  On and after July 1,
43    1993, a  A ny person who is the owner of a vehicle registered
44    under the provisions of section 49-402  or 49-434(1) , Idaho  Code,
45    may  apply  for Idaho wildlife special license plates.  The provisions of
46    this section shall not apply to any vehicle with a  registered  maximum  gross
47    weight over sixteen thousand (16,000) pounds. 
48        (2)  In  addition  to  the  regular  operating fee, the applicant shall be
49    charged a fee of thirty-five dollars ($35.00) for the initial issuance of  the
50    plates, and twenty-five dollars ($25.00) upon each succeeding annual registra-
51    tion.  Twenty-five  dollars  ($25.00)  of  the initial fee and fifteen dollars

 1    ($15.00) of the renewal fee shall be deposited in the  state  highway  account
 2    and  shall  be used to fund the cost of administration of this special license
 3    plate program. Ten dollars ($10.00)  of  each  initial  fee  and  ten  dollars
 4    ($10.00)  of each renewal fee shall be deposited by the state treasurer in the
 5    fish and game set-aside account pursuant to section 36-111,  Idaho  Code,  for
 6    use in the nongame management and protection program.
 7        Whenever title or interest in a vehicle registered under the provisions of
 8    this  section  is  transferred or assigned, the owner may transfer the special
 9    plates to another vehicle upon payment of the required transfer fees.  He  may
10    only display the plates after receipt of new registration from the department.
11        (3)  The  Idaho  wildlife  license  plate  shall  be of a color and design
12    acceptable to the board of directors of the Idaho fish and wildlife foundation
13    and approved by the department, utilizing a numbering system as determined  by
14    the  department.  Initial  costs of the plate program including costs of plate
15    design shall be paid by the board of directors of the Idaho fish and  wildlife
16    foundation.
17        (4)  Sample  Idaho  wildlife  plates  may be purchased for a fee of thirty
18    dollars ($30.00), twelve dollars ($12.00) of which shall be deposited  in  the
19    state  highway  account and eighteen dollars ($18.00) of which shall be depos-
20    ited in the fish and game set-aside account pursuant to section 36-111,  Idaho
21    Code, for use in the nongame management and protection program.

22        SECTION  14.  That Section 49-417A, Idaho Code, be, and the same is hereby
23    amended to read as follows:

24        49-417A.  IDAHO TIMBER SPECIAL PLATES. (1)   On  and  after  July  1,
25    1995, a  A ny person who is the owner of a vehicle registered
26    under  the provisions of section 49-402  or 49-434(1) , Idaho Code,
27    may apply for Idaho timber special license plates.    The  provisions  of
28    this  section  shall  not apply to any vehicle with a registered maximum gross
29    weight over sixteen thousand (16,000) pounds. 
30        (2)  In addition to the regular operating  fee,  the  applicant  shall  be
31    charged  a fee of thirty-five dollars ($35.00) for the initial issuance of the
32    plates, and twenty-five dollars ($25.00) upon each succeeding annual registra-
33    tion. Twenty-five dollars ($25.00) of the  initial  fee  and  fifteen  dollars
34    ($15.00)  of  the  renewal fee shall be deposited in the state highway account
35    and shall be used to fund the cost of administration of this  special  license
36    plate  program.  Ten  dollars  ($10.00)  of  each  initial fee and ten dollars
37    ($10.00) of each renewal fee shall be deposited by the state treasurer in  the
38    department  of  lands fund for use in reforestation activities on state lands,
39    provided however, that prior to the beginning of any fiscal  year,  the  state
40    board  of  land  commissioners  may agree that funds made available under this
41    section to the department of lands for the coming year  would  better  further
42    reforestation   objectives  of  the  management  and  conservation  of  forest
43    resources on public and private lands in the state if expended for educational
44    efforts set forth in this section.
45        Whenever title or interest in a vehicle registered under the provisions of
46    this section is transferred or assigned, the owner may  transfer  the  special
47    plates  to  another vehicle upon payment of the required transfer fees. He may
48    only display the plates after receipt of new registration from the department.
49        (3)  The Idaho timber license plate shall be of a color and design accept-
50    able to the members of the Idaho forest products commission  and  approved  by
51    the  department, utilizing a numbering system as determined by the department.
52    Initial costs of the plate program, including costs of plate design, shall  be
53    paid  by  the  director  of the department of lands from funds appropriated to

 1    that department.
 2        (4)  Sample Idaho timber plates may be purchased for a fee of thirty  dol-
 3    lars  ($30.00),  twelve  dollars  ($12.00)  of which shall be deposited in the
 4    state highway account  and eighteen dollars ($18.00) of which shall be  depos-
 5    ited  in  the  department of lands fund for use in reforestation activities or
 6    educational efforts as set forth in this section.
 7        (5)  Ten dollars ($10.00) of each initial fee and ten dollars ($10.00)  of
 8    each  renewal  fee  of each timber special license plate, and eighteen dollars
 9    ($18.00) for each sample timber special license plate, shall be deposited with
10    the state treasurer and credited to the department of lands. Funds  so  depos-
11    ited  and  subsequently  directed by the state board of land commissioners for
12    educational efforts as set forth in this section shall be expended  as  agreed
13    by  the  state   board  of  land  commissioners upon recommendations developed
14    jointly by the department of lands and the Idaho forest  products  commission.
15    Such  efforts  may  include  signs or other appropriate means designed to help
16    build public understanding of reforestation or the management and conservation
17    of forest resources on public and private lands in Idaho.

18        SECTION 15.  That Section 49-418, Idaho Code, be, and the same  is  hereby
19    amended to read as follows:

20        49-418.  VETERANS  PLATES.  (1)    On  and  after  January 1, 1997, a
21     A ny person who is the owner of a vehicle  registered  under
22    the  provisions  of  section 49-402  or 49-434(1) , Idaho Code, may
23    apply for and upon department approval receive special veterans license plates
24    in lieu of regular license plates.  The provisions of this section  shall
25    not  apply  to any vehicle with a registered maximum gross weight over sixteen
26    thousand (16,000) pounds.  Availability of  veterans  plates  for  other
27    vehicles shall be subject to the rules, policies and procedures of the depart-
28    ment.
29        (2)  Proof  of being a current or former member of the United States armed
30    forces must be furnished to the department before special veterans plates will
31    be issued. Acceptable proof shall be a copy of form  DD214  or  an  equivalent
32    document or statement from the department of veterans affairs.
33        (3)  In addition to the regular registration fee s  required in
34    section  49-402(1)   or 49-434(1) , Idaho Code, the applicant shall
35    pay the initial program fee and the annual program fee  specified  in  section
36    49-402(8),  Idaho  Code,  and the plate fee specified in section 49-450, Idaho
37    Code.
38        (4)  Whenever title or interest in a vehicle registered under  the  provi-
39    sions  of  this section is transferred or assigned, the owner may transfer the
40    special plates to another vehicle upon payment of the required transfer  fees.
41    The  owner  may only display the plates on another vehicle upon receipt of the
42    new registration from the department.
43        (5)  The veterans license plate design shall include the colors red, white
44    and blue, shall designate one (1) of the five (5) branches  of  military  ser-
45    vice, and display either:
46        (a)  The word "VETERAN" or
47        (b)  The  name of a conflict or war period recognized by the United States
48        department of veterans affairs for the purpose of  awarding  federal  vet-
49        erans benefits as defined in 38 U.S.C. 101(11).
50    The license plate design shall comply with all applicable rules of the depart-
51    ment,  and shall include a separate and distinct numbering system. The design,
52    color, and numbering system shall be subject to approval of the department.

 1        SECTION 16.  That Section 49-418A, Idaho Code, be, and the same is  hereby
 2    amended to read as follows:

 3        49-418A.  IDAHO  PUBLIC  COLLEGE  AND  UNIVERSITY PLATES. (1)  On and
 4    after January 1, 1998, a  A ny person who is the owner  of  a
 5    vehicle  registered  under the provisions of section 49-402  or 49-434(1)
 6    , Idaho Code, may apply for special plates featuring one (1) of  Idaho's
 7    public  colleges  or  universities.  The provisions of this section shall
 8    not apply to any vehicle with a registered maximum gross weight  over  sixteen
 9    thousand (16,000) pounds.  Availability of Idaho public college and uni-
10    versity special license plates for other vehicles may be authorized by rule of
11    the board.
12        (2)  In  addition  to  the  regular  operating fee, the applicant shall be
13    charged a fee of fifty dollars  ($50.00)  for  the  initial  issuance  of  the
14    plates,  and  fifty dollars ($50.00) upon each succeeding annual registration.
15    Twenty-five dollars ($25.00) of the initial fee and fifteen  dollars  ($15.00)
16    of  the renewal fee shall be deposited in the state highway account to be used
17    by the department to fund highway, road and bridge construction  projects  and
18    to  fund the cost of administration of this special license plate program. The
19    department shall transfer twenty-five dollars ($25.00) of the initial fee  and
20    thirty-five dollars ($35.00) of the renewal fee for deposit to the institution
21    designated on the license plate.
22        (3)  Whenever  title  or interest in a vehicle registered under the provi-
23    sions of this section is transferred or assigned, the owner may  transfer  the
24    special  plates to another vehicle upon payment of the required transfer fees.
25    The owner may only display the plates after receipt of new  registration  from
26    the department.
27        (4)  All  special  college  and  university plates shall be of a color and
28    design comparable to the standard issue of license plates with  blue  numerals
29    on  a  red,  white  and  blue  background and shall indicate the participating
30    institution.
31        (a)  The standard red, white and blue graphic shall be used,  except  that
32        the  word  "Idaho"  and "Famous Potatoes" shall appear on every plate, the
33        identification of county shall be omitted,  and  the  inscription  "Scenic
34        Idaho" may be omitted.
35        (b)  Each public college or university that chooses to participate in this
36        program  shall  provide that portion of the design which features the par-
37        ticular institution and such design shall be acceptable to  the  president
38        of  the  institution and the state board of education and board of regents
39        of the university of Idaho.
40        Each version of the special public college and university plate  featuring
41    the  participating  public  college  or  university  shall  be approved by the
42    department, utilizing a numbering system as determined by the department. Ini-
43    tial costs of the plate program, including the cost of plate design, shall  be
44    paid by the participating public college or university.
45        (5)  The  state  board of education and board of regents of the university
46    of Idaho shall adopt rules to account for receipt and distribution of revenues
47    accruing to participating public colleges and universities  from  the  special
48    license  plate  program. Revenues from the special plate program shall be used
49    to:
50        (a)  Fund scholarships for Idaho residents attending that college or  uni-
51        versity.
52        (b)  Match  funds  contributed  in equal amounts from nonstate sources for
53        academic programs, provided that such expenditures  shall  be  subject  to
54        prior approval by the state board of education and board of regents of the

 1        university of  Idaho.
 2        (6)  Sample  public college and university license plates may be purchased
 3    from the department for a fee of thirty-five dollars ($35.00), twelve  dollars
 4    ($12.00) of which shall be retained by the department for deposit to the state
 5    highway  account and twenty-three dollars ($23.00) shall be transferred by the
 6    department to the college or university designated on the  license  plate.  No
 7    additional fee shall be charged for personalizing sample plates.

 8        SECTION 17.  This act shall be in full force and effect on and after Janu-
 9    ary 1, 1999.

Statement of Purpose / Fiscal Impact


    





                           STATEMENT OF PURPOSE
                                 RS 07430
    
    The purpose of this legislation is to allow for issuance of 
    special license plates when registering vehicles with a gross 
    vehicle weight of 8,001 pounds through 16,000 pounds. This 
    will allow large pickup trucks and utility vehicles, when 
    registered at that weight, to legally pull a loaded trailer 
    and to display a special license plate of the owner's choice.
    
    FISCAL NOTE Based on current trends, 
    about 2,000 owners of trucks in this weight range are 
    expected to purchase special plates. This will create 
    additional revenues of $50,000 for the State Highway Account 
    in the first year, and $30,000 in succeeding years.
    
    
    Reprogramming computers to provide for this change is 
    expected to take 1,oOo to 1,440 hours. Hiring outside 
    programmers to complete the task will cost approximately 
    $42,750 to $61,560.
