H0558|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 558 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO LIMITATIONS ON CAMPAIGN CONTRIBUTIONS; AMENDING SECTION 67-6610A, 3 IDAHO CODE, TO PROVIDE FOR THE RETURN OR REFUND OF ANY FUNDS RECEIVED IN 4 VIOLATION OF THE SECTION AND TO PROVIDE FOR REPORTING OF THE REFUND OR 5 RETURN TO THE SECRETARY OF STATE. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 67-6610A, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 67-6610A. LIMITATIONS ON CONTRIBUTIONS. (1) Except as provided in subsec- 10 tion (2) of this section, aggregate contributions for a primary election or a 11 general election made by a corporation, political committee, other recognized 12 legal entity or an individual, other than the candidate, to a candidate for 13 the state legislature, and political committees organized on the candidate's 14 behalf shall be limited to an amount not to exceed one thousand dollars 15 ($1,000) for the primary election and an amount not to exceed one thousand 16 dollars ($1,000) for the general election. Aggregate contributions for a pri- 17 mary election or a general election by a corporation, political committee, 18 other recognized legal entity or an individual, other than the candidate, to a 19 candidate for statewide office and political committees organized on the 20 candidate's behalf shall be limited to an amount not to exceed five thousand 21 dollars ($5,000) for the primary election and an amount not to exceed five 22 thousand dollars ($5,000) for the general election. 23 (2) Aggregate contributions for a primary election or for a general elec- 24 tion made by the state central committee of the political parties qualified 25 under section 34-501, Idaho Code, to a candidate for the state legislature, 26 and political committees organized on the candidate's behalf shall be limited 27 to an amount not to exceed two thousand dollars ($2,000) for the primary elec- 28 tion and an amount not to exceed two thousand dollars ($2,000) for the general 29 election. Aggregate contributions for the primary election or the general 30 election by the state central committee of the political parties qualified 31 under section 34-501, Idaho Code, to a candidate for statewide office and 32 political committees organized on the candidate's behalf shall be limited to 33 an amount not to exceed ten thousand dollars ($10,000) for the primary elec- 34 tion and an amount not to exceed ten thousand dollars ($10,000) for the gen- 35 eral election. 36 (3) For purposes of this section "statewide office" shall mean an office 37 in state government which shall appear on the primary or general election bal- 38 lot throughout the state. 39 (4) Contributions other than money or its equivalent are deemed to have a 40 monetary value equivalent to the fair market value of the contribution. Ser- 41 vices or property or rights furnished at less than their fair market value for 42 the purpose of assisting any candidate or political committee are deemed a 43 contribution. A contribution of this kind shall be reported as an in-kind con- 2 1 tribution at its fair market value and counts toward any applicable contribu- 2 tion limit of the contributor. Contributions shall not include the personal 3 services of volunteers. 4 (5) The contribution limits for the state legislature shall apply to 5 judicial district offices, city offices and county offices regulated by this 6 chapter. 7 (6) Any candidate or committee receiving funds which are in viola- 8 tion of this section shall return or refund said funds or any portion thereof 9 to the donor to the extent necessary to comply with the provisions of this 10 section. Any such refund or return shall be reported to the secretary of 11 state. 12 (7) The provisions of this section are hereby declared to be sev- 13 erable and if any provision of this section or the application of such provi- 14 sion to any person or circumstance is declared invalid for any reason, such 15 declaration shall not affect the validity of the remaining portions of this 16 section.
