H0565|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 565, As Amended BY TRANSPORTATION AND DEFENSE COMMITTEE 1 AN ACT 2 RELATING TO MOTOR VEHICLES; AMENDING SECTION 49-802, IDAHO CODE, TO PROVIDE A 3 CODE REFERENCE, TO PROVIDE THAT A DRIVER FACING A STEADY RED LIGHT SHALL 4 REMAIN STOPPED BEHIND THE MARKED LIMIT LINE OR IF THERE IS NO MARKED LIMIT 5 LINE SHALL NOT BLOCK THE CROSSWALK AND TO MAKE TECHNICAL CORRECTIONS; AND 6 AMENDING SECTION 49-113, IDAHO CODE, TO ADD A DEFINITION AND TO MAKE A 7 TECHNICAL CORRECTION. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Section 49-802, Idaho Code, be, and the same is hereby 10 amended to read as follows: 11 49-802. TRAFFIC-CONTROL SIGNAL LEGEND. Whenever traffic is controlled by 12 traffic-control signals exhibiting different colored lights, or colored 13 lighted arrows, successively one (1) at a time or in combination, 14 only the colors green, red and yellow shall be used, except for 15 pedestrian - control signals and the lights shall indicate and 16 apply to drivers of vehicles and pedestrians as follows: 17 (1) Green indication: 18 (a) A driver facing a circular green signal shall proceed straight 19 through or turn right or left unless a sign prohibits a right or left 20 turn. Any driver, including one turning, shall yield the right-of-way to 21 other traffic and to pedestrians lawfully within the intersection , 22 as defined in section 49-110, Idaho Code, or an adjacent crosswalk. 23 (b) A driver facing a green arrow signal, shown alone or in combination 24 with another indication, shall enter the intersection only to make the 25 movement indicated by the green arrow, or other movement that is permitted 26 by other indications shown at the same time. A driver facing a left turn 27 green arrow shall yield the right-of-way to other traffic and to pedes- 28 trians lawfully within the intersection or an adjacent crosswalk. 29 (c) A pedestrian facing a circular green signal, unless prohibited by a 30 sign or otherwise direction by a pedestrian-control signal, as provided in 31 section 49-803, Idaho Code, may proceed across the highway within any 32 marked or unmarked crosswalk, but shall yield the right-of-way to vehicles 33 lawfully within the intersection at the time that signal is first shown. 34 (d) A pedestrian facing a green arrow turn signal unless otherwise 35 directed by a pedestrian - control signal as provided in sec- 36 tion 49-803, Idaho Code, shall not enter the highway. 37 (2) Steady yellow indication: 38 (a) A driver facing a steady circular yellow or yellow arrow signal is 39 being warned that the related green movement is ending, or that a red 40 indication will be shown immediately after it. 41 (b) A pedestrian facing a steady circular yellow or yellow arrow signal, 42 unless otherwise directed by a pedestrian-control signal as provided in 43 section 49-803, Idaho Code, is being warned that there is insufficient 2 1 time to cross the highway. 2 (3) Steady red indication: 3 (a) A driver facing a steady circular red signal alone shall stop4at a marked limit line or crosswalk, or if none,before entering 5 the intersection, as defined in section 49-110, Idaho Code, 6 and shall remain stopped until an indication to proceed is shown except as 7 provided in paragraph (b) of this subsection. While stopped at the 8 intersection the driver shall remain stopped behind the marked limit line, 9 as defined in section 49-113, Idaho Code, or if there is no marked limit 10 line, shall not block the crosswalk. 11 (b) Except when a sign is in place prohibiting a turn, a driver after 12 stopping, facing a steady circular red signal, may turn right, or turn 13 left from a highway onto a one-way highway after stopping. Vehicular traf- 14 fic shall yield the right-of-way to pedestrians lawfully within an adja- 15 cent crosswalk and to other traffic lawfully using the intersection. 16 (c) A driver facing a steady red arrow indication shall not enter the 17 intersection to make the movement indicated by the arrow and, unless 18 entering the intersection to make a movement permitted by another signal 19 shall stop at a clearly marked limit line, but if none, before entering 20 the crosswalk on the near side of the intersection, or if none, then 21 before entering the intersection and shall remain stopped until an indica- 22 tion permitting movement is shown. 23 (d) Unless otherwise directed by a pedestrian-control signal, a pedes- 24 trian facing a steady circular red or red arrow signal shall not enter the 25 traffic lanes of a highway. 26 (4) When an official traffic-control signal is erected and maintained at 27 a place other than an intersection, the provisions of this section shall be 28 applicable except as to those provisions which by their nature can have no 29 application. Any stop required shall be made at a sign or crosswalk or limit 30 line indicating where the stop shall be made, but in the absence of a sign or 31 marking the stop shall be made at the signal. 32 SECTION 2. That Section 49-113, Idaho Code, be, and the same is hereby 33 amended to read as follows: 34 49-113. DEFINITIONS -- L. 35 (1) "Laned highway" means a highway which is divided into two (2) or more 36 clearly marked lanes for vehicular traffic. 37 (2) "Lane of travel." (See "Traffic lane", section 49-121, Idaho Code) 38 (3) "Legal owner" means any person notated as "lienholder" of a vehicle, 39 the notation appearing on the title records of the department and on the 40 respective certificate of title. 41 (4) "License" or "license to operate a motor vehicle" means any driver's 42 license or any other license or permit to operate a motor vehicle issued 43 under, or granted by, the laws of this state, including: 44 (a) Any temporary license or instruction permit; 45 (b) Any nonresident's operating privilege; 46 (c) Any special permit issued by the department. 47 (5) "Licensing authority" as used in chapter 20 of this title with refer- 48 ence to Idaho, means the department. 49 (6) "Lien" or "encumbrance" means every security interest in any vehicle 50 other than security interests in vehicles held in inventory for sale. 51 (7) "Lienholder" means a person holding a security interest in a vehicle. 52 (8) "Light weight" or "unladen weight" means the scale weight of a vehi- 53 cle equipped for operation, but without any cargo on it. 3 1 (9) "Limit line" or "stop line" means a solid white line extending 2 across a highway indicating the point behind which vehicles are required to 3 stop, which must conform to the manual and specifications adopted by the board 4 pursuant to section 49-201, Idaho Code. 5 (10) "Local authorities" mean s every county, 6 highway district, municipal and other local board or body having authority to 7 enact regulations, resolution and/or ordinances relating to traffic on the 8 highways, public rights-of-way and streets under their jurisdiction under the 9 constitution and laws of this state.
STATEMENT OF PURPOSE RS07613 This bill clarifies language under the current law. The current law's wording makes it difficult to determine at what point a red light violation has occurred. The current language is being interpreted to not consider a driver in violation if the vehicle has crossed over either the limit line or cross walk before the light turns to red. This interpretation allows a large variance within the same intersection in determining a violation. Establishing a clearer definition is important when considering the exactness required in determining who might be a fault in an intersection accident. FISCAL NOTE No negative impact to the general fund. The only impact on the city or county level should be positive in that a savings of officer investigative time should be reduced. CONTACT: Rep.
