                              HOUSE BILL NO. 599, As Amended

 1                                        AN ACT
 2    RELATING TO PERSONAL CARE SERVICES; AMENDING CHAPTER 13, TITLE 39, IDAHO CODE,
 3        BY THE ADDITION OF A NEW SECTION 39-1301a, IDAHO CODE, TO PROVIDE THAT THE
 4        DEPARTMENT OF HEALTH AND WELFARE MAY GRANT WAIVERS TO PERSONAL  CARE  SER-
 5        VICES  HOMES FROM CERTAIN PROVISIONS OF SECTION 39-1301, IDAHO CODE, UNDER
 6        SPECIFIED CIRCUMSTANCES; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE
 7        DATE.

 8    Be It Enacted by the Legislature of the State of Idaho:

 9        SECTION 1.  That Chapter 13, Title 39, Idaho Code, be,  and  the  same  is
10    hereby  amended  by  the addition thereto of a  NEW SECTION , to be
11    known and designated as Section 39-1301a, Idaho Code, and to read as follows:

12        39-1301a.  WAIVERS FOR PERSONAL CARE SERVICES HOMES FROM NURSING  FACILITY
13    AND INTERMEDIATE CARE FACILITY DEFINITIONS. The Idaho department of health and
14    welfare  shall  have  the authority to grant personal care services homes that
15    have been approved pursuant to IDAPA 16.03.09.146.06.f.ix, a waiver from  sec-
16    tions  39-1301(b) and (c) (1), Idaho Code, to permit no more than two (2) per-
17    sons, both of whom meet the level of care defined in those sections, to reside
18    in the same personal care services home, regardless of  payor  source.  Before
19    granting  a waiver under this section, the department shall require, when fea-
20    sible, written statements from each of the two (2) persons or their legal rep-
21    resentatives evidencing their desire to reside in the same personal care  ser-
22    vices home.
23        The  department  shall  revoke any waiver granted pursuant to this section
24    where it is determined there is a threat to the life or safety of either  per-
25    son  or  where  one  (1) of the persons leaves the personal care services home
26    permanently or notifies the department in writing that they  do  not  wish  to
27    reside  in  the  personal  care  services  home with the other individual. Any
28    waiver granted under this section shall be reviewed annually.

29        SECTION 2.  An emergency existing  therefor,  which  emergency  is  hereby
30    declared  to  exist,  this  act  shall be in full force and effect thirty days
31    after its passage and approval.
