                                    HOUSE BILL NO. 644

 1                                        AN ACT
 2    RELATING TO TERM LIMITATIONS; PROVIDING A STATEMENT OF  LEGISLATIVE  FINDINGS,
 3        SUBMITTING  AN  ADVISORY VOTE TO THE ELECTORS, DIRECTING THE ATTORNEY GEN-
 4        ERAL AND SECRETARY OF STATE TO SUBMIT THE QUESTION, DECLARING THE ADVISORY
 5        QUESTION A MEASURE AND MAKING THE PROVISIONS  OF  CHAPTER  66,  TITLE  67,
 6        IDAHO  CODE,  GOVERNING  ELECTION  CAMPAIGN CONTRIBUTIONS AND EXPENDITURES
 7        APPLICABLE THERETO.

 8    Be It Enacted by the Legislature of the State of Idaho:

 9        SECTION 1.  The Legislature finds and declares that the issue of term lim-
10    itations for elected officials is of importance to the citizens of  the  state
11    of  Idaho.   As a representative body, members of the Legislature desire to be
12    responsive and responsible to these citizens. For this reason, the Legislature
13    herewith submits an advisory ballot to the electors of the state of Idaho, and
14    the results will guide the Legislature as to whether Idaho laws providing term
15    limitations for state, county and city elected officials and  school  district
16    trustees should be retained or repealed.
17        At  the  election  to  be  held on November 3, 1998, the question provided
18    herein shall be placed on the ballot as an advisory  vote.  The  Secretary  of
19    State  and  the Attorney General shall perform the duties as prescribed for an
20    initiative in Chapter 18, Title 34, Idaho Code. The question shall be as  fol-
21    lows:
22        "Since  the  United  States Supreme Court has ruled that Idaho's 1994 term
23    limits law does not apply to members of Congress, shall term limits for  state
24    elected  officials,  state legislators, county elected officials, city elected
25    officials and school district trustees remain in place?"
26        The advisory question provided for in this act is hereby declared to be  a
27    "measure" for purposes of Chapter 66, Title 67, Idaho Code, and the provisions
28    of Chapter 66, Title 67, Idaho Code, shall apply thereto.

    This legislation would put an advisory question on the 
    ballot in the November general election. The question would 
    relate to whether Idaho's term limits statute should be 
    retained or repealed.
    
                               FISCAL NOTE
    
    The only fiscal impact is the cost of adding this question 
    to the ballot in November.
