                             IN THE HOUSE OF REPRESENTATIVES

                            HOUSE CONCURRENT RESOLUTION NO. 34

                     BY JUDICIARY, RULES AND ADMINISTRATION COMMITTEE

 1                               A CONCURRENT RESOLUTION
 2    STATING FINDINGS OF THE LEGISLATURE AND REJECTING CERTAIN RULES OF THE DEPART-
 3        MENT OF JUVENILE CORRECTIONS RELATING  TO  STAFF  REQUIREMENTS  AND  STAFF
 4        DEVELOPMENT AND RULES AND DISCIPLINE.

 5    Be It Resolved by the Legislature of the State of Idaho:

 6        WHEREAS,  the  Legislature  is  vested  with authority to reject executive
 7    agency rules under the provisions of Section 67-5291, Idaho Code, in the event
 8    that the Legislature finds that the rules are not consistent with  legislative
 9    intent; and
10        WHEREAS,  it  is  the finding of the Legislature that certain rules of the
11    Department of Juvenile Corrections relating to staff  requirements  and  staff
12    development  and  rules  and  discipline  are  not consistent with legislative
13    intent and should be rejected.
14        NOW, THEREFORE, BE IT RESOLVED by the members of the Second  Regular  Ses-
15    sion  of  the Fifty-fourth Idaho Legislature, the House of Representatives and
16    the Senate concurring therein, that IDAPA 05.01.01.412, rule of the Department
17    of Juvenile Corrections relating to staff requirements and staff  development,
18    adopted  as  a  pending  rule  under  Docket  number  05-0101-9701,  and IDAPA
19    05.01.01.455, rule of the Department of Juvenile Corrections relating to rules
20    and discipline, adopted as a pending rule under  Docket  number  05-0101-9701,
21    be,  and  the same are hereby rejected and declared null, void and of no force
22    and effect.
