HJM015|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE HOUSE OF REPRESENTATIVES HOUSE JOINT MEMORIAL NO. 15 BY WAYS AND MEANS COMMITTEE 1 A JOINT MEMORIAL 2 TO THE SENATE AND HOUSE OF REPRESENTATIVES OF THE UNITED STATES IN CONGRESS 3 ASSEMBLED, AND TO THE CONGRESSIONAL DELEGATION REPRESENTING THE STATE OF 4 IDAHO IN THE CONGRESS OF THE UNITED STATES. 5 We, your Memorialists, the House of Representatives and the Senate of the 6 State of Idaho assembled in the Second Regular Session of the Fifty-fourth 7 Idaho Legislature, do hereby respectfully represent that: 8 WHEREAS, Congressional enactment of the 1991 Intermodal Surface Transpor- 9 tation Efficiency Act (ISTEA) did not allow the Idaho Legislature state's 10 rights authority to adjust motor carrier weight limits on the federal inter- 11 state and defense highway system within the borders of Idaho; and 12 WHEREAS, Montana, Utah, Nevada, Arizona, Wyoming, South Dakota and Iowa 13 have interstate motor carrier weight limits above those of Idaho; and 14 WHEREAS, the lower Idaho motor carrier weight limit between these inter- 15 connecting states can produce inefficiencies in the movement of commercial 16 traffic into, out of and through Idaho; and 17 WHEREAS, the Idaho Legislature has authorized weight limits to 129,000 18 pounds on selected Idaho highways; and 19 WHEREAS, the 1991 Intermodal Surface Transportation Act has expired and 20 replacement legislation is under consideration by the Congress. 21 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses- 22 sion of the Fifty-fourth Idaho Legislature, the House of Representatives and 23 the Senate concurring therein, that the Congress enact legislation allowing 24 the Idaho Legislature to exercise state's rights authority in establishing 25 motor carrier weight limits up to 129,000 pounds on the federal interstate and 26 defense highway system within the borders of the state of Idaho. 27 BE IT FURTHER RESOLVED that the Chief Clerk of the House of Representa- 28 tives be, and she is hereby authorized and directed to forward a copy of this 29 Memorial to the President of the Senate and the Speaker of the House of Repre- 30 sentatives of Congress, and the congressional delegation representing the 31 State of Idaho in the Congress of the United States.
STATEMENT OF PURPOSE RS08170 This House Joint Memorial is a "trailer" to House Bill 623aa,aa passed by the House on 2127198. The proposed memorial becomes void if House Bill 623aa,aa is held in the Senate. The purpose of the memorial to Congress and the Idaho Congressional Delegation is to request that Congress allow the Idaho Legislature state's rights authority to establish truck weights up to 129,000 pounds on the federal interstate and defense highway system within the boundaries of the state of Idaho. FISCAL NOTE There is no known negative fiscal impact to the general fund, the budget of the Idaho Transportation Department or the budgets of local highway jurisdictions. The authority of the Idaho Legislature to establish truck weight limits up to 129,000 pounds on the federal interstate and defense highway system within the boundaries of the state of Idaho will allow the Idaho Legislature to be directly involved in decisions involving interstate and intrastate transportation efficiencies.
