HR004|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE HOUSE OF REPRESENTATIVES HOUSE RESOLUTION NO. 4 BY JUDICIARY, RULES AND ADMINISTRATION COMMITTEE 1 A HOUSE RESOLUTION 2 PROVIDING FOR AMENDMENT OF RULE 9 OF THE RULES OF THE HOUSE OF REPRESENTATIVES 3 AS ADOPTED IN THE ORGANIZATIONAL SESSION OF THE FIFTY-FOURTH IDAHO LEGIS- 4 LATURE AND PROVIDING FOR ADOPTION OF A NEW RULE 78 OF THE RULES OF THE 5 HOUSE OF REPRESENTATIVES. 6 Be It Resolved by the House of Representatives of the State of Idaho: 7 WHEREAS, the House of Representatives deems it desirable and necessary to 8 expedite the process by which bills, memorials and resolutions of a 9 noncontroversial nature can be identified and considered by the body in a 10 timely manner; and 11 WHEREAS, the amendment of a current rule and the adoption of a new rule 12 creating an uncontested calendar provide a process by which uncontested bills, 13 memorials and resolutions can be expedited. 14 NOW, THEREFORE, BE IT RESOLVED by the members of the House of Representa- 15 tives, assembled in the Second Regular Session of the Fifty-fourth Idaho Leg- 16 islature, that Rule 9 of the Rules of the House of Representatives as adopted 17 in the Organizational Session of the Fifty-fourth Idaho Legislature, be, and 18 the same is hereby amended to read as follows: 19 RULE 9 20 Calendar.--(1) The Speaker shall cause the Clerk of the House 21 to make a list of all bills, memorials, resolutions, reports of com- 22 mittees and other proceedings of the House, which are committed to a 23 Committee of the Whole House for amendment, and which are not made 24 the order of the day for any particular day. Such list shall be 25 called the "General Orders of the Day," and items on the General 26 Orders Calendar shall be taken up in the order in which they are com- 27 mitted, unless otherwise ordered by the House by majority vote of the 28 members present. 29 (2) The Speaker shall cause the Clerk of the House to make a 30 list of all bills, memorials and resolutions which may be on second 31 reading regular calendar , entering them in order in 32 which they are placed upon their second reading, unless the House 33 shall otherwise direct by majority vote of the members present, which 34 list shall be called the "Second Reading Regular Calen- 35 dar." 36 (3) The Speaker shall cause the Clerk of the House to make a 37 list of all bills, memorials and resolutions which may be on third 38 reading regular calendar , entering them in order in 39 which they are placed upon their third reading, unless the House 40 shall otherwise direct by majority vote of the members present, which 41 list shall be called the "Third Reading Regular Calen- 42 dar." 43 (4) The Speaker shall cause the Clerk of the House to 2 1 make a list of all bills, memorials and resolutions which may be on 2 the uncontested calendar, which list shall be called the "Uncontested 3 Calendar." Assignment of a bill, memorial or resolution to the uncon- 4 tested calendar, transfer of a bill, memorial or resolution from the 5 uncontested calendar to a regular reading calendar and the voting 6 procedure used for bills, memorials and resolutions on the uncon- 7 tested calendar shall be conducted according to the provisions of 8 Rule 78. 9 (5) The Clerk shall keep a book showing the situa- 10 tion and progress of bills, memorials, and resolutions. 11 NOW, THEREFORE, BE IT FURTHER RESOLVED by the members of the House of Rep- 12 resentatives assembled in the Second Regular Session of the Fifty-fourth Idaho 13 Legislature, that the Rules of the House of Representatives be, and the same 14 are hereby amended by the addition thereto of a NEW RULE , to be 15 known and designated as Rule 78, and to read as follows: 16 RULE 78 17 Uncontested Calendar.--(1) Any standing committee may report a 18 bill, memorial or resolution, but not a joint resolution, to the 19 House with the recommendation that it be placed on the second reading 20 uncontested calendar if the document has received the unanimous vote 21 of the committee when a quorum is present. 22 (2) Upon objection of any member, a bill, memorial or resolu- 23 tion on the uncontested calendar, either on second reading or on 24 third reading, shall be removed from the uncontested calendar and 25 placed on the regular calendar at the same reading. 26 (3) At the Eleventh Order of business the majority leader shall 27 move the third reading uncontested calendar. No debate shall be 28 allowed on any document on the third reading uncontested calendar. 29 The presiding officer shall then call for the roll call vote on the 30 uncontested calendar. The resulting vote shall be used to establish 31 the roll call vote for each document on the third reading uncontested 32 calendar and shall be considered as a separate vote upon each such 33 document.
STATEMENT OF PURPOSE RS 07405C1 This proposed rule change will allow uncontested bills to move through the calendar on an expedited schedule. The ability of a member to simply object in order to remove a bill from the uncontested calendar provides a necessary safeguard. FISCAL NOTE None. May shorten the session.
