                                   SENATE BILL NO. 1289

 1                                        AN ACT
 2    RELATING TO COSMETOLOGY; AMENDING SECTION 54-805, IDAHO CODE, TO PROVIDE ADDI-
 3        TIONAL OPTIONS FOR TRAINING AS A NAIL TECHNICIAN  OR  ESTHETICIAN  AND  TO
 4        MAKE  TECHNICAL  CORRECTIONS;  AND AMENDING SECTION 54-807, IDAHO CODE, TO
 5        PROVIDE ADDITIONAL APPLICATIONS FOR PRACTICE OF AN APPRENTICE.

 6    Be It Enacted by the Legislature of the State of Idaho:

 7        SECTION 1.  That Section 54-805, Idaho Code, be, and the  same  is  hereby
 8    amended to read as follows:

 9        54-805.  REQUIREMENTS  FOR  LICENSE.  Except as herein otherwise provided,
10    the following shall be considered minimum  requirements  for  license  in  the
11    respective  categories,  and  all applicants shall be  of good moral character
12    and temperate habits:
13        1.  As a registered cosmetologist:
14        (a)  Completion of two (2) years' high school education or its equivalent.
15        (b)  Graduation from and completion of two thousand (2  ,  000)
16        hours'  training  in  a  school of cosmetology, or four thousand (4 ,
17        000) hours' training as an apprentice covering  all  phases  of  the
18        practice of cosmetology.
19        (c)  Successful  passage  of the examination for cosmetologist given under
20        the direction of the board.
21        2.  As an instructor: twelve (12) semester college credit hours or equiva-
22    lent as approved by the board or  successful  completion  of  the  examination
23    required by board rules, and
24        (a)  One (1) year's experience as a licensed cosmetologist in a registered
25        cosmetological  establishment  or  school  and six (6) months of teacher's
26        training in a school of cosmetology, or
27        (b)  Two (2) years' experience as a licensed cosmetologist in a registered
28        cosmetological establishment and three (3) months of teacher's training in
29        a school of cosmetology, or
30        (c)  Five (5) years' experience as a licensed  cosmetologist,  immediately
31        preceding the application for license, and
32        3.  As a student:
33        (a)  Be sixteen and one-half (16 1/2) years of age.
34        (b)  Have completed at least two (2) years of high school education or its
35        equivalent.
36        4.  As an apprentice:
37        (a)  Be sixteen and one-half (16 1/2) years of age.
38        (b)  Have completed at least two (2) years of high school education or its
39        equivalent.
40        5.  As a nail technician:
41        (a)  Be sixteen and one-half (16 1/2) years of age.
42        (b)  Have completed at least two (2) years of high school education or its
43        equivalent.

 1        (c)  Have  completed and graduated from at least three hundred (300) hours
 2        of training and graduated from such training in a  board  approved  school
 3         or any cosmetological establishment .
 4        (d)  Successful passage of the examination for nail technician given under
 5        the direction of the board.
 6        6.  As an electrologist/esthetician:
 7        (a)  Be sixteen and one-half (16 1/2) years of age.
 8        (b)  Have completed at least two (2) years of high school education or its
 9        equivalent.
10        (c)  Have  completed and graduated from at least eight hundred (800) hours
11        of training  for  such  in  a  school  approved  by  the  board  to  teach
12        electrology/esthetics  or sixteen hundred (1 , 600) hours as an
13        apprentice  under  the  direct  personal   supervision   of   a   licensed
14        electrologist/esthetician instructor as established by board  regula-
15        tions   rules .
16        (d)  Successfully passed the examination for electrologist and esthetician
17        given under the direction of the board.
18        7.  As an esthetician:
19        (a)  Be sixteen and one-half (16 1/2) years of age.
20        (b)  Have completed at least two (2) years of high school education or its
21        equivalent.
22        (c)  Have  completed  and graduated from at least five hundred (500) hours
23        of training for such in a school approved by the board to teach  esthetics
24         or any cosmetological establishment .
25        (d)  Successfully  passed  the examination for esthetician given under the
26        direction of the board.
27        8.  As an electrologist/esthetician instructor: twelve (12) semester  col-
28    lege  credit hours or equivalent, as approved by the board, or successful com-
29    pletion of an examination required by board rules, and:
30        (a)  Five (5) years' experience as a  licensed  electrologist/esthetician;
31        or
32        (b)  Fewer    than    five   (5)   years'   experience   as   a   licensed
33        electrologist/esthetician and completion of an adequate  training  program
34        to be established by board rule.

35        SECTION  2.  That  Section  54-807, Idaho Code, be, and the same is hereby
36    amended to read as follows:

37        54-807.  PRACTICE OF APPRENTICE. No licensed apprentice may practice inde-
38    pendently, but he may do any and all acts necessary  for  his  training  as  a
39    cosmetologist , nail technician, electrologist or esthetician  pro-
40    viding the same is done under the immediate personal supervision of a licensed
41    registered  cosmetologist,  nail technician, electrologist or esthetician
42     in an establishment where one (1) of said registered cosmetologists  is
43    a  licensed instructor, and only one (1) such apprentice shall be employed for
44    each two (2)  licensed  registered  cosmetologists  ,  nail  technicians,
45    electrologists  or  estheticians    in any cosmetological establishment.
46    Cosmetological establishments employing apprentices shall keep  a  daily  work
47    record  of  the attendance of such apprentices and shall, upon the termination
48    of such apprenticeship, certify to the board the total number of hours  worked
49    and the types of instruction given the apprentice.

    This legislation provides additional options for becoming a 
    nail technician or an esthetic Ian by allowing cosmetological 
    establishments to provide the training required for licensure.
    
    It also provides an apprenticeship program for nail 
    technicians and estheticians like the one that currently 
    exists for cosmetologists.
