HUMAN RIGHTS COMMISSION - Amends and adds to existing law to allow the
administering of oaths and affirmations, to allow the receiving of
testimony under oath by the Human Rights Commission and to provide for
perjury when a person makes any false statement as to material matter in
any oath or affidavit provided to the Human Rights Commission or its
authorized representative.

                                   SENATE BILL NO. 1361

                                BY STATE AFFAIRS COMMITTEE

 1                                        AN ACT
 2    RELATING TO THE HUMAN RIGHTS COMMISSION; AMENDING SECTION 67-5906, IDAHO CODE,
 3        TO ALLOW THE ADMINISTERING OF OATHS AND  AFFIRMATIONS  AND  TO  ALLOW  THE
 4        RECEIVING  OF  TESTIMONY UNDER OATH AND TO MAKE TECHNICAL CORRECTIONS; AND
 5        AMENDING CHAPTER 9, TITLE 67, IDAHO CODE, BY THE ADDITION OF A NEW SECTION
 6        67-5906A, IDAHO CODE, TO PROVIDE FOR PERJURY WHEN A PERSON MAKES ANY FALSE
 7        STATEMENT AS TO MATERIAL MATTER IN ANY OATH OR AFFIDAVIT PROVIDED  TO  THE
 8        HUMAN RIGHTS COMMISSION OR ITS AUTHORIZED REPRESENTATIVE.

 9    Be It Enacted by the Legislature of the State of Idaho:

10        SECTION  1.  That  Section 67-5906, Idaho Code, be, and the same is hereby
11    amended to read as follows:

12        67-5906.  POWERS AND DUTIES OF COMMISSION. The Idaho commission  on  human
13    rights shall have the following powers and duties:
14        (1)  To  investigate  complaints  of alleged violation of this act and act
15    upon its findings pursuant to the provisions contained in this chapter;
16        (2)  To make bylaws for its own government and procedure not  inconsistent
17    with the laws of this state;
18        (3)  To  maintain  an office in the city of Boise and other offices within
19    the state as it may deem necessary;
20        (4)  To meet and exercise its powers at any place within the state;
21        (5)  To appear in court and before other administrative bodies;
22        (6)  To cooperate or contract with individuals and state, local and  other
23    agencies,  both  public and private, including agencies of the federal govern-
24    ment and of other states;
25        (7)  To accept public grants or private gifts,  bequests,  or  other  pay-
26    ments;
27        (8)  To receive and act on complaints;
28        (9)  To  furnish technical assistance requested by persons subject to this
29    act to further compliance with the act or an order issued thereunder;
30        (10) To make studies appropriate to effectuate the purposes  and  policies
31    of this act and to make the results thereof available to the public;
32        (11) To  render  at  least  annually a comprehensive written report to the
33    governor and to the legislature. The report may contain recommendations of the
34    commission for legislative or other action to effectuate the purposes and pol-
35    icies of this act.
36        (12) In accordance with chapter 52, title 67, Idaho Code, to  adopt,  pro-
37    mulgate,  amend  and  rescind rules  and regulations  to effectuate
38    the purposes and policies of this  act,  including    regulations  
39      rules  requiring the posting or inclusion in advertising material
40    of notices prepared or approved by the commission.
41         (13) The staff director or  the  authorized  representative  of  the
42    staff director may administer oaths and affirmations and may receive testimony
43    under oath.

 1        SECTION  2.  That  Chapter  59,  Title 67, Idaho Code, be, and the same is
 2    hereby amended by the addition thereto of a  NEW SECTION  ,  to  be
 3    known and designated as Section 67-5906A, Idaho Code, and to read as follows:

 4        67-5906A.  PERJURY.  The willful making of any false statement as to mate-
 5    rial matter in any oath or affidavit provided to the human  rights  commission
 6    or  the  commission's  authorized  representative is perjury and punishable as
 7    such.
