S1466|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE SENATE SENATE BILL NO. 1466 BY TRANSPORTATION COMMITTEE 1 AN ACT 2 RELATING TO MOTOR VEHICLE REGISTRATION; AMENDING SECTION 49-426, IDAHO CODE, 3 TO PROVIDE AN EXEMPTION FROM REGISTRATION FOR CERTAIN DEVICES USED FOR 4 TRANSPORTATION BY PERSONS WITH DISABILITIES. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 49-426, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 49-426. EXEMPTIONS FROM OPERATING FEES. The provisions of this chapter 9 with respect to operating fees shall not apply to: 10 (1) Motor vehicles owned or leased by the United States, the state, a 11 city, a county, any department thereof, any political subdivision or municipal 12 corporation of the state, any taxing district of the state, or any organiza- 13 tion, whether incorporated or unincorporated, organized for the operation, 14 maintenance, or management of an irrigation project or irrigation works or 15 system or for the purpose of furnishing water to its members or shareholders, 16 but in other respects shall be applicable. 17 (2) Farm tractors, implements of husbandry, road rollers, wheel mounted 18 tar buckets, portable concrete and/or mortar mixers, wheel mounted compres- 19 sors, tow dollies, portable toilet trailers, street sweepers, and similar 20 devices as determined by the department which are temporarily operated or 21 moved upon the highways need not be registered under the provisions of this 22 chapter, nor shall implements of husbandry be considered towed units under 23 registration of vehicle combinations as defined in section 49-108(2), Idaho 24 Code. In addition, self-propelled wheelchairs,invalids' tricycles, and25three-wheeled bicycles, wheelchair conveyances , golf 26 carts, lawn mowers, and scooters operated by persons who by reason of 27 physical disability are otherwise unable to move about as pedestrians shall be 28 exempt from registration requirements under the provisions of this chapter. 29 Motorcycles and all-terrain vehicles, as defined in section 67-7101, Idaho 30 Code, need not be registered under the provisions of this chapter while being 31 used exclusively in connection with agricultural, horticultural, dairy and 32 livestock growing and feeding operations or used exclusively for snow removal 33 purposes. Travel upon the public highways shall be limited to travel between 34 farm or ranch locations. Motorcycles and all-terrain vehicles used for this 35 purpose shall meet the requirements of section 49-619, Idaho Code.
STATEMENT OF PURPOSE RS 07921 This legislation would make changes to the Motor Vehicle Code as now written to exempt from licensing requirements conveyances such as three-wheeled bicycles, scooters, golf carts, lawn mowers, etc., which are used by people with disabilities to access their community. People with disabilities using these conveyances have been ticketed in the past for not licensing the above described vehicles.
