S1515|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE SENATE SENATE BILL NO. 1515, As Amended BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO THE PERSONNEL COMMISSION; AMENDING SECTION 67-5307, IDAHO CODE, TO 3 PROVIDE THAT THE CHAIRMAN OF THE PERSONNEL COMMISSION SHALL BE APPOINTED 4 BY THE GOVERNOR PRIOR TO THE COMMISSION'S FIRST MEETING OF EACH CALENDAR 5 YEAR; AND AMENDING SECTION 67-5308, IDAHO CODE, TO PROVIDE THAT A PERSON- 6 NEL DIRECTOR SHALL BE APPOINTED WITH THE WRITTEN APPROVAL OF THE GOVERNOR 7 AND TO MAKE A TECHNICAL CORRECTION; AND DECLARING AN EMERGENCY. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Section 67-5307, Idaho Code, be, and the same is hereby 10 amended to read as follows: 11 67-5307. ORGANIZATION OF COMMISSION. (1) The Idaho personnel commission 12 created by this act shall consist of five (5) members, not more than three (3) 13 of which at any time may belong to the same political party. The members of 14 the commission shall be appointed by the governor on the basis of experience 15 in personnel management, business or governmental management and their known 16 sympathy with merit principles for the impartial selection of efficient state 17 government employees; provided, however, that at least two (2) of the members 18 shall have had at least five (5) years of personnel management experience. 19 (2) Members of the commission shall be appointed for overlapping terms of 20 six (6) years, except that in the first instance one (1) member shall be 21 appointed for two (2) years, one (1) member for four (4) years and one (1) 22 member for six (6) years. Initial members shall be appointed to take office 23 within thirty (30) days after the effective date of this act. The members of 24 the personnel commission serving on the effective date of this act shall con- 25 tinue in office subject to the provisions of this act. The additional members 26 of the commission shall be appointed one (1) for four (4) years and one (1) 27 for six (6) years, the term of each to be designated by the governor. Their 28 successors shall be appointed for terms of six (6) years. If, for any reason, 29 a member should leave the commission before his term expires, the governor 30 shall appoint another member to fill out the unexpired term. 31 (3) No member of the commission shall hold political office or be an 32 officer of a political organization during his term, nor shall any member have 33 held political office or have been an officer of a political organization dur- 34 ing the twelve (12) months preceding his appointment. No member of the commis- 35 sion shall have been employed as an official or employee of the state of Idaho 36 during the twelve (12) months preceding his appointment, nor be so employed 37 during his term.At its first meeting the commission shall elect one (1)38of the members as chairman. Thereafter, tT he chairman 39 shall beelected duringappointed by the governor prior to 40 the first meeting of each calendar year. 41 (4) Any department aggrieved by any action or inaction of the commission 42 shall be afforded an opportunity for a hearing before the commission upon 43 request therefor in writing. Minutes or summary of the proceedings of all 2 1 hearings shall be made and filed with the commission, together with findings 2 of fact and conclusions of law made by the commission. 3 (5) The governor may remove a commissioner for inefficiency, neglect of 4 duty or misconduct in office after first giving him a copy of charges against 5 him and an opportunity to be heard publicly before the governor. A copy of 6 the charges and a transcript of the record of the hearing shall be filed with 7 the secretary of state. 8 (6) The commission shall meet at regularly scheduled intervals or on call 9 of the chairman. Three (3) members shall constitute a quorum for the transac- 10 tion of business. Members shall each be compensated as provided by section 11 59-509(n), Idaho Code. 12 SECTION 2. That Section 67-5308, Idaho Code, be, and the same is hereby 13 amended to read as follows: 14 67-5308. AUTHORITY AND DUTIES OF THE PERSONNEL COMMISSION -- SELECTION OF 15 PERSONNEL DIRECTOR. (1) It shall be the duty of the Idaho personnel commission 16 to administer this act. The commission shall have the duty, power and author- 17 ity to employ such persons, make such expenditures, require such reports, make 18 investigations, perform such travel pursuant to the provisions of this act, 19 and to take such other actions as it deems necessary or suitable to that end. 20 (2) A personnel director shall be appointed by the commission , with 21 the written approval of the governor, from a register of eligibles 22 established from an unassembled examination pursuant to section 67-5309, 23 Idaho Code, who shall be experienced in personnel administration, and 24 who shall be the executive secretary and administrative officer of the commis- 25 sion. 26 SECTION 3. An emergency existing therefor, which emergency is hereby 27 declared to exist, this act shall be in full force and effect on and after its 28 passage and approval.
STATEMENT OF PURPOSE RS08109 E1 This legislation results from a recommendation of the Governor's Task Force on Personnel. This legislation provides that the Chairman of the Personnel Commission shall be appointed by the Governor. The legislation also provides that the Personnel Commission shall appoint the personnel director with the written approval of the Governor. The citizens and the legislature hold the Governor accountable for the efficient and effective administration of state government. However, under current law as it relates to .. personnel administration, the governor has limited direct authority. This legislation gives the Governor reasonable authority in this important area.
