S1516|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fourth Legislature Second Regular Session - 1998IN THE SENATE SENATE BILL NO. 1516 BY JUDICIARY AND RULES COMMITTEE 1 AN ACT 2 RELATING TO ESCAPE FROM A JAIL OR PRISON; AMENDING SECTION 18-2505, IDAHO 3 CODE, TO PROVIDE THAT ESCAPE FROM A PRIVATE PRISON SHALL CONSTITUTE A 4 CRIME. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 18-2505, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 18-2505. ESCAPE BY ONE CHARGED WITH, CONVICTED OF, OR ON PROBATION FOR A 9 FELONY -- ESCAPE BY JUVENILE. (1) Every prisoner charged with, convicted of, 10 or on probation for a felony who is confined in any jail or prison including 11 the state penitentiary or any private prison , or who while out- 12 side the walls of such jail or prison in the proper custody of any officer or 13 person, or while in any factory, farm or other place without the walls of such 14 jail or prison, who escapes or attempts to escape from such officer or person, 15 or from such jail or prison, or from such factory, farm or other place without 16 the walls of such jail or prison, shall be guilty of a felony, and upon con- 17 viction thereof, any such second term of imprisonment shall commence at the 18 time he would otherwise have been discharged. 19 (2) Any person under the age of eighteen (18) charged with, found to have 20 committed, or on probation for an offense which would be a felony if committed 21 by an adult who is confined in a juvenile detention facility or other secure 22 or nonsecure facility for juveniles and who escapes or attempts to escape from 23 the facility or from the lawful custody of any officer or person shall be sub- 24 ject to proceedings under chapter 5, title 20, Idaho Code, for an offense 25 which would be a felony if committed by an adult. If the juvenile is or has 26 been proceeded against as an adult, pursuant to sections 20-508 or 20-509, 27 Idaho Code, the juvenile shall be guilty of a felony for a violation of this 28 section and shall be subject to adult criminal proceedings.
STATEMENT OF PURPOSE RS 08115 This legislation establishes that an escape or escape attempt committed in a private prison housing juvenile offenders would be punishable as if committed in a public facility. FISCAL IMPACT No fiscal impact. CONTACT: Senator Denton Darrington Phone 332-1317 S1516
