SPEAKER Requested by: Department of Fish and Game 1 AN ACT 2 RELATING TO FISH AND GAME; AMENDING SECTION 36-107, IDAHO CODE, TO DELETE THE 3 REQUIREMENT THAT THERE BE AN ANNUAL TRANSFER OF FUNDS FROM THE FISH AND 4 GAME ACCOUNT TO THE UNIVERSITY OF IDAHO CAINE VETERINARY TEACHING AND 5 RESEARCH CENTER. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 36-107, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 36-107. FISH AND GAME ACCOUNT. (a) The director shall promptly transmit 10 to the state treasurer all moneys received by him, from the sale of hunting, 11 fishing and trapping licenses, tags and permits or from any other source con- 12 nected with the administration of the provisions of the Idaho fish and game 13 code or any law or regulation for the protection of wildlife, including moneys 14 received from the sale of predatory animal furs taken under the provisions of 15 this chapter, and the state treasurer shall deposit all such moneys in the 16 fish and game account, which is hereby established, reserved, set aside, 17 appropriated in the state treasury, and made available until expended as may 18 be directed by the commission in carrying out the purposes of the Idaho fish 19 and game code or any law or regulation promulgated for the protection of wild- 20 life, and shall be used for no other purpose. Pending expenditure or use, sur- 21 plus moneys in the fish and game account shall be invested by the state trea- 22 surer in the manner provided for idle state moneys in the state treasury by 23 section 67-1210, Idaho Code. Interest received on all such investments shall 24 be paid into the account.The state controller shall annually, by August251 of each year, transfer the sum of one hundred thousand dollars ($100,000)26from the fish and game account to the University of Idaho Caine Veterinary27Teaching and Research Center for disease research regarding the interaction of28disease between wildlife and domestic livestock. Said moneys shall be expended29on projects agreed upon by the University of Idaho Caine Veterinary Teaching30and Research Center and the state wildlife veterinarian.31 (b) The commission shall govern the financial policies of the department 32 and shall, as provided by law, fix the budget for the operation and mainte- 33 nance of its work for each fiscal year. Said budget shall not be exceeded by 34 the director. 35 (c) The sum of two dollars ($2.00) from each license authorized in sec- 36 tions 36-406(a) and 36-407(b), Idaho Code, which entitle a person to fish, 37 shall be used for the construction, repair, or rehabilitation of state fish 38 hatcheries, fishing lakes, or reservoirs. 39 (d) The department is authorized to expend up to one dollar and fifty 40 cents ($1.50) from each resident deer and elk tag sold and five dollars 41 ($5.00) from each nonresident deer and elk tag sold to fund the department's 42 big game landowner-sportsman's relations program.
STATEMENT OF PURPOSE RS08403 The legislation deletes the annual transfer of $100,000 of hunting and fishing license funds to the University of Idaho Caine Veterinary Teaching and Research Center. Sportsmen dollars will be more effectively used to address wildlife health and disease concerns at the Department's wildlife health laboratory. FISCAL IMPACT A savings of $100,000 annually for the Department of Fish and Game. No impact on the general fund.
