H0180|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 180 BY TRANSPORTATION AND DEFENSE COMMITTEE 1 AN ACT 2 RELATING TO COMMERCIAL DRIVER'S LICENSES; AMENDING SECTION 49-302, IDAHO CODE, 3 TO PROVIDE AN EXEMPTION FROM THE REQUIREMENT TO OBTAIN A COMMERCIAL 4 DRIVER'S LICENSE; AND DECLARING AN EMERGENCY. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 49-302, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 49-302. WHAT PERSONS ARE EXEMPT FROM LICENSE. The following persons are 9 exempt from licensing if driving privileges are not suspended, cancelled, 10 revoked, disqualified, denied or refused: 11 (1) Any person while driving or operating any farm tractor or implement 12 of husbandry when incidentally operated on a highway. 13 (2) Farmers are exempt from obtaining a class A, B or C driver's license 14 to operate a commercial motor vehicle which is: 15 (a) Controlled and operated by a farmer, including operation by employees 16 or family members; and 17 (b) Used to transport either agricultural products, farm machinery, farm 18 supplies, or both, to or from a farm; and 19 (c) Not used in the operations of a common or contract motor carrier; and 20 (d) Used within one hundred fifty (150) miles of the person's farm. 21 (3) Any person is exempt from obtaining a class A, B or C driver's 22 license for the operation of commercial motor vehicles which are necessary to 23 the preservation of life or property or the execution of emergency governmen- 24 tal functions, are equipped with audible and visual signals, and are not sub- 25 ject to normal traffic regulations. 26 (4) Any person is exempt from obtaining a class A, B or C driver's 27 license for the operation of any vehicle weighing up to sixty thousand 28 (60,000) pounds which is owned and operated by such person and which is not 29 used to transport any equipment, supplies, materials or products for hire. 30 (5) Any person is exempt from obtaining a class A, B or C license 31 to operate a commercial vehicle which is exclusively used to transport per- 32 sonal possessions or family members for nonbusiness or recreational purposes. 33 (56 ) A nonresident who is at least fifteen (15) 34 years of age and who has in his immediate possession a valid driver's license 35 issued to him in his home state or country may operate a motor vehicle in 36 Idaho only as a class D operator with driving privileges restricted to day- 37 light hours only, and with full privileges at sixteen (16) years of age, and 38 only if Idaho residency is not established. 39 (67 ) A nonresident who is at least fifteen (15) 40 years of age and who has in his possession a valid driver's license with a 41 motorcycle endorsement or who has a valid motorcycle driver's license issued 42 to him in his home state or country may operate a motorcycle in Idaho with 43 driving privileges restricted to daylight hours only, and with full privileges 2 1 at sixteen (16) years of age. 2 (78 ) A nonresident who has in his immediate 3 possession a valid commercial driver's license issued to him in his home state 4 or country may operate a motor vehicle in Idaho. 5 (89 ) A nonresident on active duty in the armed 6 forces of the United States who has a valid driver's license issued by his 7 home jurisdiction, and such nonresident's spouse or dependent son or daughter 8 who has a valid driver's license issued by such person's home jurisdiction. 9 (910 ) Any active duty military personnel, active 10 duty U.S. coast guard personnel, and members of the reserves and national 11 guard on active duty including personnel on full-time national guard duty, 12 personnel on part-time training and national guard military technicians who as 13 civilians are required to wear military uniforms and are subject to the code 14 of military justice, are exempt from obtaining a commercial driver's license 15 to operate military vehicles. This exemption does not apply to U.S. reserve 16 technicians. 17 SECTION 2. An emergency existing therefor, which emergency is hereby 18 declared to exist, this act shall be in full force and effect on and after its 19 passage and approval.
STATEMENT OF PURPOSE RS 08330 The purpose of this legislation is to clarify in code the exemption from the requirement to obtain a Class A, B or C driver's licence (CDL) for the operation of any vehicle weighing up to sixty thousand (60,000) pounds for certain small business haulers who own their vehicle and are merely transporting their own property -- and are definitely not transporting products or materials for hire.
