SNAKE RIVER - DAMS - Stating findings of the Legislature that the federal
and state enhancement efforts for anadromous fish must be undertaken in a
manner which protects Idaho's sovereignty over its water resources,
protects dams on the entire Snake River and prohibits contributions of
water from Idaho's reservoirs for flow augmentation, except those
authorized by the state of Idaho.

                            HOUSE CONCURRENT RESOLUTION NO. 17

                         BY RESOURCES AND CONSERVATION COMMITTEE

 1                               A CONCURRENT RESOLUTION
 2    STATING LEGISLATIVE FINDINGS AND SUPPORTING HEALTHY STOCKS OF ANADROMOUS  FISH
 3        AND  OPPOSING FLOW AUGMENTATION AND THE REMOVAL OF DAMS ON THE SNAKE RIVER
 4        AND ITS TRIBUTARIES.

 5    Be It Resolved by the Legislature of the State of Idaho:

 6        WHEREAS, the Legislature of the State of Idaho recognizes the  vital  con-
 7    tributions  the  Snake River and its tributaries bring to the state's economic
 8    well-being and to the state's quality of life; and
 9        WHEREAS, the Legislature of the State of Idaho supports the continued mul-
10    tiple uses of the Snake River and  its  tributaries  for  fish  and  wildlife,
11    hydropower  generation,  irrigation,  transportation, flood control and recre-
12    ation; and
13        WHEREAS, the Legislature of the State of Idaho recognizes the legal prior-
14    ity that agricultural irrigation and industrial  applications  of  water  have
15    within the state; and
16        WHEREAS,  the  Legislature of the State of Idaho believes that the removal
17    or breaching of dams on the Snake River and its tributaries, and  water  taken
18    from  the  state  for anadromous fish enhancement efforts would inflict on the
19    citizenry of the state a loss of recreational opportunities,  an  increase  in
20    electrical rates, a loss of recharge water for the state's aquifers, a loss of
21    navigation,  an increased risk of floods, a reduction in economic activity and
22    a threatened quality of life; and
23        WHEREAS, the  above-mentioned  activities  would  create  water  shortages
24    within  the  state  resulting  in  the idling of a large acreage of productive
25    Idaho farmland; and
26        WHEREAS, the Legislature of the State of Idaho believes that  the  anadro-
27    mous  fish  decline is due to many factors, some of which are diminished habi-
28    tat, increased predation, unfavorable ocean  conditions,  hatchery  practices,
29    harvest impacts, changing climatic conditions as well as hydropower generating
30    dams; and
31        WHEREAS, the Legislature of the State of Idaho recognizes the need to pro-
32    tect  and enhance anadromous fish populations and will work to accomplish this
33    while also protecting the needs of the citizens of the state.
34        NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session
35    of the Fifty-fifth Idaho Legislature, the House  of  Representatives  and  the
36    Senate  concurring  therein,  that  federal  and state enhancement efforts for
37    anadromous fish must be undertaken in a manner which protects  Idaho's  sover-
38    eignty  over  its water resources, protects dams on the entire Snake River and
39    prohibits contributions of water from Idaho's reservoirs for flow augmentation
40    except those authorized by the state of Idaho.
