HCR028|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE HOUSE OF REPRESENTATIVES HOUSE CONCURRENT RESOLUTION NO. 28 BY STATE AFFAIRS COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING FINDINGS OF THE LEGISLATURE CONCERNING THE THREAT OF TERRORISM IN THE 3 UNITED STATES AND ACTIONS WHICH SHOULD BE CONSIDERED TO ACHIEVE A RESPONSE 4 TO THE THREAT AND DIRECTING THAT COPIES OF THIS RESOLUTION BE FORWARDED TO 5 THE U.S. DEPARTMENT OF JUSTICE AND THE CONGRESS OF THE UNITED STATES. 6 Be It Resolved by the Legislature of the State of Idaho: 7 WHEREAS, the threat of terrorism in the United States is a real and com- 8 plex phenomenon that can strike any community, state or geographic region of 9 our nation; and 10 WHEREAS, threats incorporating the use of nuclear, radiological, biologi- 11 cal, chemical and cyber weapons, or combinations thereof, may be used against 12 critical infrastructures and the nation's food supply, of which the state of 13 Idaho is a major producer; and 14 WHEREAS, because terrorist incidents would occur in local communities 15 within the states, it is imperative that planning, training, exercises, equip- 16 ping and funding strategies for state and local response forces be included in 17 any national strategy; and 18 WHEREAS, the Legislature joins with the National Governors' Association 19 and the National Emergency Management Association to affirm its commitment to 20 ensuring a coordinated response and recovery to major emergencies and disas- 21 ters including incidents of terrorism and the use of weapons of mass destruc- 22 tion. 23 NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session 24 of the Fifty-fifth Idaho Legislature, the House of Representatives and the 25 Senate concurring therein, that we recommend the following actions be taken to 26 improve the nation's preparedness, and to more effectively prepare for, 27 respond to, and recover from consequences of terrorism at the state and local 28 level that: 29 (1) The White House and the Congress should consult and coordinate with 30 the nation's governors and their states to develop and implement a national 31 strategy that initiates and sustains activities for domestic preparedness at 32 the state and local level. One hundred percent federally funded state and 33 local assistance, previously granted to the states for civil defense, should 34 be provided to the states for preparedness activities for crisis and conse- 35 quence management as the result of the increasing potential for acts of ter- 36 rorism and use of weapons of mass destruction. 37 (2) The federal government recognizes that the short and long-term conse- 38 quences of domestic terrorism is among the responsibilities of state and local 39 government supplemented by the resources of the federal government. Federal 40 agencies that are tasked with providing assistance to state and local govern- 41 ment must be required to recognize and use the state's emergency management 42 systems that have effectively responded to state and local emergencies and 43 disasters for over fifty years. 44 (3) The National Guard of each state and territory is a critical state 2 1 resource during emergencies and disasters. As such, the role of the National 2 Guard and the Department of Defense must be better defined in preparing for 3 acts of terrorism. Furthermore, the National Guard must be funded, trained, 4 equipped and well exercised if it is to have a viable role in the response and 5 recovery to the use of weapons of mass destruction and terrorism. 6 (4) The nation's public health and medical system capabilities must be 7 significantly improved and fully integrated into the evolving domestic 8 preparedness program. As a health matter, specific attention must be placed on 9 the nation's food supply, both that which has been harvested, and that which 10 is yet to be developed. 11 (5) The government at all levels must ensure that the protection of civil 12 liberties and states' rights will remain the highest priority within the con- 13 text of national security as the United States prepares for and addresses the 14 consequences of terrorism. The White House and the Congress should specifi- 15 cally develop methods to eliminate unauthorized activity in the name of expe- 16 dience and national security. 17 BE IT FURTHER RESOLVED that the state of Idaho recognizes and supports the 18 efforts of the U.S. Department of Justice to accomplish the much needed pro- 19 gram coordination through the creation of the National Domestic Preparedness 20 Office. 21 BE IT FURTHER RESOLVED that the Clerk of the House of Representative be, 22 and she is hereby authorized and directed to forward a copy of this Resolution 23 to the U.S. Department of Justice, the President of the Senate and the Speaker 24 of the House of Representatives and the members of the Senate and the House of 25 Representatives representing the State of Idaho in the Congress of the United 26 States.
STATEMENT OF PURPOSE

This proposed House Concurrent Resolution requests that Congress
recognize the potential impact of terrorism and weapons of mass
destruction on the individual states, their subordinate units of
government, and the people. The resolution further requests that
one hundred percent federal funding previously granted to the
states for civil defense and disaster preparedness be re-instituted.
FISCAL NOTE
Would return federal money for civil defense and disaster
preparedness which has been removed by Congress.
