 1                                   A JOINT MEMORIAL
 2    TO THE PRESIDENT OF THE UNITED STATES, THE SENATE AND THE HOUSE OF REPRESENTA-
 3        TIVES OF THE UNITED STATES IN CONGRESS ASSEMBLED, AND TO THE CONGRESSIONAL
 4        DELEGATION REPRESENTING THE STATE OF IDAHO IN THE CONGRESS OF  THE  UNITED
 5        STATES.

 6        We,  your Memorialists, the House of Representatives and the Senate of the
 7    State of Idaho assembled in the First Regular Session of the Fifty-fifth Idaho
 8    Legislature, do hereby respectfully represent that:

 9        WHEREAS, under the provisions of the Forest Service law of May  23,  1908,
10    35 Stat. 259, 260, 267 and as subsequently amended by the National Forest Man-
11    agement Act and the Federal Land Policy Management Act, the United States For-
12    est  Service  pays to counties through the State Treasurer twenty-five percent
13    of gross revenues from timber sales, grazing permits  and  leases,  recreation
14    fees, power line rights-of-way, special use permits and other programs; and
15        WHEREAS,  the  payments are made to states from each national forest, then
16    are apportioned to counties according to the proportion  of  acreage  of  each
17    national forest in each county; and
18        WHEREAS,  the  law  mandates that these funds be used for public roads and
19    public schools; and
20        WHEREAS, counties with large amounts of federal lands have few sources  of
21    revenue  and  rely  on these payments to maintain their public roads and their
22    public schools; and
23        WHEREAS, the Forest Service payments have become unpredictable due to for-
24    est planning processes over the past ten years that have reduced  timber  har-
25    vests on national forests; and
26        WHEREAS,  demands  on  counties to provide necessary services such as good
27    public roads, public schools, sanitation services, and search and rescue  have
28    increased; and
29        WHEREAS,  stabilizing  payments required by the 1908 Forest Service law is
30    essential for responsible fiscal planning by the counties.
31        NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session
32    of the Fifty-fifth Idaho Legislature, the House  of  Representatives  and  the
33    Senate  concurring therein, that we strongly support stabilization of payments
34    of the United States Forest Service to county governments  through  the  State
35    Treasurer  and  urge  our  congressional  delegation representing the state of
36    Idaho in the Congress of the United States to support  legislation  that  will
37    stabilize payments made by the United States Forest Service to the counties of
38    the  state of Idaho by increasing the annual timber harvest from federal lands
39    within the state of Idaho to the allowable sales quantity levels  outlined  in
40    the current forest plans and by increasing to fifty percent the amount of fed-
41    eral  funds returned to the counties from the sale of federal timber under the
42    provisions of the Forest Service law of May 23, 1908, 35 Stat. 259,  260,  267
43    and as subsequently amended by the National Forest Management Act and the Fed-
44    eral Land Policy Management Act.

 1        BE  IT  FURTHER  RESOLVED that the Chief Clerk of the House of Representa-
 2    tives be, and she is hereby authorized and directed to forward a copy of  this
 3    Memorial  to  the  President of the United States, the President of the Senate
 4    and the Speaker of the House of Representatives of Congress, and the  congres-
 5    sional  delegation  representing  the  state  of  Idaho in the Congress of the
 6    United States.

                       STATEMENT OF PURPOSE

This Memorial is to ask the United States Congress to restore
economic stability to those counties throughout Idaho and the
west by restoring federal timber harvest to annual sales quantity
levels.
