S1058|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE SENATE SENATE BILL NO. 1058 BY COMMERCE AND HUMAN RESOURCES COMMITTEE 1 AN ACT 2 RELATING TO DESIGNATED SMOKING AREAS; AMENDING SECTION 39-5504, IDAHO CODE, TO 3 FURTHER DEFINE DESIGNATED SMOKING AREAS. 4 Be It Enacted by the Legislature of the State of Idaho: 5 SECTION 1. That Section 39-5504, Idaho Code, be, and the same is hereby 6 amended to read as follows: 7 39-5504. DESIGNATED SMOKING AREAS. (1) Smoking areas may be designated by 8 proprietors or other persons in charge of public places, except in places in 9 which smoking is prohibited by the fire marshal or by other law, ordinance or 10 regulation. 11 (2) Where smoking areas are designated, a "good faith" effort shall be 12 made to minimize the effect of smoke in adjacent nonsmoking areas by 13 completely enclosing the designated smoking area . In the case of public 14 places consisting of a single room, the provisions of this chapter shall be 15consideredmet only ifone side ofthe 16 entire room is reserved and posted as a no smoking area.
STATEMENT OF PURPOSE RS08708 This simple amendment extends the courtesy of clean indoor air to all citizens at all times in all public places. Most employers and most public places now provide a smoke free environment, but there are few places that do not. This simple change would assure all citizens the right to enter any public place and not be assaulted by offensive, foul, unhealthy smoke filled rooms. FISCAL NOTE Neither the state nor local governments spend much time or money enforcing the no-smoking law. This will add little or no additional enforcement responsibilities. Over time, proprietors and owners will simply adopt their practices to conform. We see no fiscal impact to any local government. CONTACT: Sen.
