S1088|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE SENATE SENATE BILL NO. 1088, As Amended in the House BY JUDICIARY AND RULES COMMITTEE 1 AN ACT 2 RELATING TO PROPERTY EXEMPT FROM ATTACHMENT OR LEVY; AMENDING SECTION 11-605, 3 IDAHO CODE, TO INCREASE THE VALUE LIMITATIONS FOR CERTAIN EXEMPT HOUSEHOLD 4 ITEMS, TO REDEFINE THE HOUSEHOLD ITEMS TO WHICH THE EXEMPTION APPLIES, TO 5 INCREASE THE EXEMPTIONS FOR JEWELRY, TOOLS OF THE TRADE AND A MOTOR VEHI- 6 CLE AND TO ADD EXEMPTIONS FOR CERTAIN LIFE INSURANCE CONTRACTS AND OTHER 7 PROPERTY. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Section 11-605, Idaho Code, be, and the same is hereby 10 amended to read as follows: 11 11-605. EXEMPTIONS OF PERSONAL PROPERTY SUBJECT TO VALUE LIMITATIONS. (1) 12 An individual is entitled to exemption of the following property to the extent 13 of a value not exceeding five hundred dollars ($500) on any one (1) item of 14 property and not to exceed a total value offourfive 15 thousand dollars ($45 ,000)per house-16holdfor all items exempted under this subsection: 17 (a) household furnishings , household goods, and 18 appliancesreasonably necessary for one (1) household, including one19(1) firearmheld primarily for the personal, family, or 20 household use of the individual or a dependent of the individual ; 21 (b) if reasonably held for the personal use of the individual or a 22 dependent, wearing apparel,household petsanimals 23 , books, and musical instruments; and 24 (c) family portraits and heirlooms of particular sentimental value to 25 the individual. 26 (2) An individual is entitled to exemption of jewelry, not exceeding 27two hundred fiftyone thousand dollars ($25281,00 0) in aggregate value, if held for the personal use of 29 the individual. 30 (3) An individual is entitled to exemption, not exceeding one thousand 31 five hundred dollars ($1,05 00) in 32 aggregate value, of implements, professional books, and tools of the trade; 33 and to an exemption of one (1) motor vehicle to the extent of a value not 34 exceedingonethree thousandfive hundred35dollars ($13 ,50 36 00). 37 (4) All courthouses, jails, public offices and buildings, school houses, 38 lots, grounds and personal property appertaining thereto, the fixtures, furni- 39 ture, books, papers and appurtenances belonging and pertaining to the court- 40 house, jail and public offices belonging to any county of this state, or for 41 the use of schools, and all cemeteries, public squares, parks and places, pub- 42 lic buildings, town halls, markets, buildings for the use of fire departments 43 and military organizations, and the lots and grounds thereto belonging and 2 1 appertaining, owned or held by any town or incorporated city, or dedicated by 2 such town or city to health, ornament or public use, or for the use of any 3 fire or military company organized under the laws of this state. No article or 4 species of property mentioned in this section is exempt from execution issued 5 upon a judgment recovered for its price or upon a mortgage thereon. 6 (5) All arms, uniforms and accouterments required for the use of an indi- 7 vidual as a peace officer, a member of the national guard or military service. 8 (6) A water right not to exceed one hundred sixty (160) inches of water 9 used for the irrigation of lands actually cultivated by the individual, and 10 the crop or crops growing or grown on fifty (50) acres of land, leased, owned 11 or possessed by an individual cultivating the same, provided, that the amount 12 of the crops so exempted shall not exceed the value of one thousand dollars 13 ($1,000). 14 (7) An individual is entitled to exemption of one (1) firearm 15 valued at less than five hundred dollars ($500). 16 (8) Any unmatured life insurance contract owned by an individual, other 17 than a credit life insurance contract. 18 (9) An individual's aggregate interest, not to exceed five thousand dol- 19 lars ($5,000) in any accrued dividend or interest under, or loan value of, any 20 unmatured life insurance contract owned by the individual under which the 21 insured is the individual or a person of whom the individual is a dependent. 22 (10) An individual's aggregate interest in any property, not to exceed the 23 value of eight hundred dollars ($800).
