S1204|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE SENATE SENATE BILL NO. 1204 BY RESOURCES AND ENVIRONMENT COMMITTEE 1 AN ACT 2 RELATING TO FISH AND GAME; AMENDING SECTION 36-409, IDAHO CODE, TO PROVIDE FOR 3 THE ISSUANCE OF NONRESIDENT OPTION TAGS TO ALLOW NONRESIDENTS TO HUNT AND 4 KILL EITHER A DEER, BLACK BEAR OR MOUNTAIN LION DURING OPEN DEER SEASON IN 5 THE APPROPRIATE ZONE OR UNIT, TO PROVIDE THAT SEASONS OF HUNT APPLY, TO 6 PROVIDE THAT ONLY ONE ANIMAL MAY BE TAKEN, TO PROVIDE THAT NONRESIDENT 7 OPTION TAGS ARE LIMITED TO ZONES OR UNITS WHERE THE COMMISSION SEEKS TO 8 INCREASE THE HARVEST OF BLACK BEAR AND/OR MOUNTAIN LION, TO PROVIDE LIMITS 9 ON HARVEST AND USE OF NONRESIDENT OPTION TAGS, TO PROVIDE A PRICE FOR NON- 10 RESIDENT OPTION TAGS, TO LIMIT THE NUMBER OF NONRESIDENT OPTION TAGS THAT 11 MAY BE SOLD AND TO OTHERWISE PROVIDE FOR ALLOCATION AND DISTRIBUTION USING 12 PROCEDURES FOR NONRESIDENT TAGS GENERALLY. 13 Be It Enacted by the Legislature of the State of Idaho: 14 SECTION 1. That Section 36-409, Idaho Code, be, and the same is hereby 15 amended to read as follows: 16 36-409. GAME TAGS -- ARCHERY PERMITS -- FEES -- PENALTY. (a) Resident 17 Game Tags. A resident who has obtained a permit to hunt, as provided in sec- 18 tion 36-401, Idaho Code, or has purchased or obtained a license to hunt, as 19 provided in section 36-406, Idaho Code, upon payment of the fees provided 20 herein shall be eligible to receive a resident game tag to hunt and kill a 21 moose, bighorn sheep, mountain goat, elk, deer, antelope, mountain lion, bear, 22 or turkey in accordance with the laws of this state and rules promulgated by 23 the commission; provided further, that any person seventy (70) years of age or 24 older who holds a senior resident combination license, may be issued a bear, 25 deer or elk tag without charge; provided further, that resident game tags may 26 be issued only to those persons who meet residency requirements of subsection 27 (s) of section 36-202, Idaho Code. 28 (b) (1) Nonresident Game Tags. A nonresident who has pur- 29 chased a hunting license, as provided in section 36-407(a), Idaho Code, or 30 has obtained a license to hunt, as provided in section 36-406(e), Idaho 31 Code, upon payment of the fees provided herein, shall be eligible to 32 receive a nonresident tag to hunt and kill a moose, bighorn sheep, moun- 33 tain goat, elk, deer, antelope, mountain lion, bear or turkey in accor- 34 dance with the laws of this state and rules promulgated by the commission. 35 (2) Nonresident Option Tags for Deer, Black Bear and Mountain Lion. 36 A nonresident who has satisfied the requirements of subsection (b)(1) of 37 this section, is eligible to receive a nonresident option tag to hunt and 38 kill a whitetail deer, mule deer, black bear or mountain lion during open 39 deer season in the appropriate zone or unit. A nonresident option tag 40 allows the hunting and killing of only one (1) animal. A nonresident 41 option tag may be used only when the hunting season for black bear or 42 mountain lion falls within the hunting season for whitetail deer or mule 43 deer in a particular zone or unit. Animals may not be hunted or killed out 2 1 of season. Nonresident option tags are limited to zones or units where the 2 commission seeks to increase the harvest of black bear and/or mountain 3 lion. Should harvests of whitetail deer, mule deer, black bear or mountain 4 lion reach levels desired by the commission in a zone or unit where the 5 nonresident option tag is being used, sale and use of the nonresident 6 option tag shall cease. The total number of animals taken by use of non- 7 resident option tags shall not be allowed to cause the total harvest of a 8 species of animal to exceed the harvest limit set by the commission. The 9 price of a nonresident option tag shall be the price of a nonresident deer 10 tag plus fifty dollars ($50.00). Annually, the number of nonresident 11 option tags authorized for sale shall not exceed the number of nonresident 12 deer tags authorized for sale. The appropriate tag 29 must be had for the hunting or taking of each and every one (1) of the afore- 30 mentioned wildlife. Provided, however, that the requirements for a mountain 31 lion tag or a bear tag, as to different periods of time and areas of the 32 state, shall be determined and specified by the commission. All of said tags 33 are to bear and have serial numbers to be endorsed on the purchaser's license 34 by the vendor at the time of sale. 35 (e) Game Tag to Be Validated and Attached to Carcass. As soon as any per- 36 son kills any wildlife for which a tag is required, said tag, belonging to 37 him, must be validated and attached to said wildlife in a manner provided by 38 commission regulation. 39 (f) Archery Permits. In addition to meeting the license and tag require- 40 ments provided in this chapter, any persons participating in any controlled or 41 general game season which has been specifically designated as an archery hunt 42 must have in his possession an archery hunt permit which may be purchased at a 43 fee of seven dollars and fifty cents ($7.50). 44 (g) Muzzleloader Permit. In addition to meeting the license and tag 45 requirements provided in this chapter, any person participating in any con- 46 trolled or general game season which has been specifically designated as a 47 muzzleloader hunt must have in his possession a muzzleloader permit which may 48 be purchased at a fee of seven dollars and fifty cents ($7.50). 49 (h) Upland Game Bird Stamp. The commission may, under rules as it may 50 prescribe, issue an upland game bird stamp that must be purchased by all per- 51 sons over sixteen (16) years of age prior to hunting upland game birds, pro- 52 vided that a stamp shall not be required to hunt forest grouse (blue, ruffed 53 or spruce), sharp-tailed grouse, sage grouse, or turkey. The fee for such a 54 stamp shall be five dollars ($5.00) and the proceeds from the sale of such 55 stamps shall be utilized for the acquisition of state and federal lands or 3 1 interests of less than fee simple in private lands and the development, man- 2 agement, improvement, sale or exchange of upland game bird habitat in accor- 3 dance with Idaho fish and game commission order number 95-07. This subsection 4 shall be null and void and of no force and effect on and after July 1, 2000. 5 (i) Hound Hunter Permit. Any person using a dog for the purpose of hunt- 6 ing or for taking, as defined in section 36-202, Idaho Code, big game or 7 furbearing animals must have in his possession a valid hound hunter permit 8 which may be purchased for a fee of ten dollars ($10.00). 9 (j) Nonresident Bird of Prey Capture Permit. The commission may, under 10 rules as it may prescribe, issue a nonresident bird of prey capture permit. 11 This capture permit may be purchased by any licensed, nonresident falconer for 12 capturing birds of prey in Idaho. The fee for the permit shall be one hundred 13 dollars ($100) and the permit shall be issued under the condition that the 14 nonresident's home state allows reciprocal raptor capturing privileges for 15 Idaho falconers. Any funds in excess of those required to issue and administer 16 nonresident capture permits shall be used to issue and administer any resident 17 falconry program established by the commission. 18 (k) Wildlife Management Area (WMA) Pheasant Permit. The commission may, 19 under rules as it may prescribe, issue a wildlife management area pheasant 20 permit that must be purchased by all persons over sixteen (16) years of age 21 prior to hunting pheasants on state wildlife management areas designated by 22 the commission. The fee for the permit shall be ten dollars ($10.00).

The purpose of this legislation is to provide for the issuance of nonresident
option tags to allow nonresidents to hunt and kill either a deer, black bear or
mountain lion during the open deer season in designated units. Provides that
the option tag shall be available in those units where the commission seeks
to increase the harvest of black bear and/or mountain lion. Establishes a price
for the option tag.
FISCAL IMPACT
It is estimated that this bill will raise betwen S140.000 and S240,000 annually
in additional revenues for the Idaho Department of Fish & Game.
