SCR133|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE SENATE SENATE CONCURRENT RESOLUTION NO. 133 BY STATE AFFAIRS COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING LEGISLATIVE FINDINGS AND AUTHORIZING AND DIRECTING THE DEPARTMENT OF 3 ADMINISTRATION TO ACQUIRE STATE BUILDINGS AND FACILITIES THROUGH THE STATE 4 BUILDING AUTHORITY UNDER CERTAIN PARAMETERS. 5 Be It Resolved by the Legislature of the State of Idaho: 6 WHEREAS, the Legislature finds that while interest rates are volatile and 7 are escalating they are very favorable presently for the issuance of bonds by 8 the State Building Authority for the financing of certain state buildings and 9 facilities; and 10 WHEREAS, the Department of Administration is authorized by Section 11 67-5708, Idaho Code, to enter into leases with the State Building Authority 12 for facilities for state use when the facility is authorized by a concurrent 13 resolution; and 14 WHEREAS, several leases of state buildings and facilities are at a point 15 where it appears to make economic sense to have the Department of Administra- 16 tion enter into an arrangement with the State Building Authority to purchase 17 the building or facility, including appropriate facility refurbishment 18 reserves, and lease it back to the state or to have the State Building Author- 19 ity build or purchase a facility and lease it back to the state. 20 NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session 21 of the Fifty-fifth Idaho Legislature, the Senate and the House of Representa- 22 tives concurring therein, that we hereby authorize the Department of Adminis- 23 tration to identify which leases of state buildings or facilities would pro- 24 duce significant long-term savings of taxpayer dollars if canceled and the 25 State Building Authority either purchased the building or facility or provided 26 another building or facility for the state agency. 27 BE IT FURTHER RESOLVED that during the interim between regular legislative 28 sessions, with the approval of the State Board of Examiners with the President 29 Pro Tempore of the Senate and the Speaker of the House of Representatives con- 30 curring therein, the Department of Administration shall proceed to enter into 31 agreements with the State Building Authority for those facilities wherein sig- 32 nificant taxpayer savings are available. 33 BE IT FURTHER RESOLVED that the Department of Administration shall make a 34 report to the Second Regular Session of the Fifty-fifth Idaho Legislature 35 regarding the action it has taken regarding building and facilities addressed 36 by this resolution.
STATEMENT OF PURPOSE RS 09174 This concurrent resolution gives direction to the Department of Administration (DOA) to proceed in identifying opportunities to save significant long-term lease costs on state occupied facilities by leasing from the Idaho State Building Authority. Interest rates are at a low that hasn't existed for decades. In an inflationary economy, such rates are likely to rise. This legislation gives flexibility to the DOA, so they may move promptly on opportunities in order to save significant taxpayer dollars if approved by the Board of Examiners, with the Senate President, Pro Tempore and the Speaker of the House concurring therein, during the interim between regular legislative sessions. FISCAL NOTE Significant long-term savings will result on all leases approved. Obtaining significant savings is the basis for approving the ISBA lease option. Short-term savings could be up to 10% of current lease costs. Long-term, the savings could run into hundreds of millions of dollars.
