PARKS AND RECREATION CAPITAL IMPROVEMENT ACCOUNT - Amends existing law to
broaden the uses of gasoline tax revenues distributed to the Park and

  1                                        AN ACT
  2    RELATING TO GASOLINE TAXES; AMENDING SECTION 63-2412, IDAHO CODE,  TO  BROADEN
  3        THE  USES  OF GASOLINE TAX REVENUES DISTRIBUTED TO THE PARK AND RECREATION
  4        CAPITAL IMPROVEMENT ACCOUNT TO INCLUDE DEVELOPING, CONSTRUCTING AND  MAIN-
  5        TAINING  ROADS,  BRIDGES  AND PARKING AREAS WITHIN AND LEADING TO PARK AND
  6        RECREATION AREAS AND TO  MAKE  TECHNICAL  CORRECTIONS;  AND  PROVIDING  AN
  7        EFFECTIVE DATE.
                                                                        
  8    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  9        SECTION  1.  That  Section 63-2412, Idaho Code, be, and the same is hereby
 10    amended to read as follows:
                                                                        
 11        63-2412.  DISTRIBUTION OF TAX REVENUES. (1) The revenues received from the
 12    taxes imposed by sections 63-2402 and 63-2405, Idaho Code, and any  penalties,
 13    interest,  or deficiency additions, or from the fees imposed by the commission
 14    under the provisions of section 63-2409,  Idaho  Code,  shall  be  distributed
 15    periodically as follows:
 16        (a)  An  amount  of money equal to the actual cost of collecting, adminis-
 17        tering and enforcing the gasoline tax requirements by the  commission,  as
 18        determined  by it shall be retained by the commission. The amount retained
 19        by the commission shall not exceed the amount authorized to be expended by
 20        appropriation by the legislature. Any unencumbered balance  in  excess  of
 21        the  actual  cost  of collecting, administering and enforcing the gasoline
 22        tax requirements by the commission at the end of each fiscal year shall be
 23        distributed as listed in paragraph (e) of this subsection.
 24        (b)  An amount of money shall be distributed to the state  refund  account
 25        sufficient  to  pay  current  refund claims. All refunds authorized by the
 26        commission to be paid shall be paid from  the  state  refund  account  and
 27        those moneys are hereby continuously appropriated for that purpose.
 28        (c)  As  soon as possible after the beginning of each fiscal year, the sum
 29        of two hundred fifty thousand dollars ($250,000) shall be  distributed  to
 30        the  railroad  grade crossing protection account in the dedicated fund, to
 31        pay the amounts from the account pursuant to  the  provisions  of  section
 32        62-304C, Idaho Code.
 33        (d)  As  soon as possible after the beginning of each fiscal year, the sum
 34        of one hundred thousand dollars ($100,000) shall  be  distributed  to  the
 35        local  bridge inspection account in the dedicated fund, to pay the amounts
 36        from the account pursuant to the provisions of section 40-703, Idaho Code.
 37        (e)  From the balance remaining with the commission after distributing the
 38        amounts in paragraphs (a) through (d) of subsection (1) of this section:
 39             1.  One and twenty-eight hundredths per cent percent (1.28%) shall be
 40             distributed as follows: sixty-six per cent percent (66%) of  the  one
 41             and  twenty-eight  hundredths  per cent percent (1.28%) shall be dis-
 42             tributed to the waterways improvement account, as created in  chapter
 43             15,  title 57, Idaho Code. Up to twenty per cent percent (20%) of the

  1             moneys distributed to the waterways  improvement  account  under  the
  2             provisions  of  this paragraph may be used by the department of parks
  3             and recreation to defray administrative costs. Any moneys  unused  at
  4             the  end of the fiscal year by the department of parks and recreation
  5             shall be returned to the state treasurer for deposit in the waterways
  6             improvement account. Thirty-three per cent percent (33%) of  the  one
  7             and  twenty-eight  hundredths  per cent percent (1.28%) shall be dis-
  8             tributed into the park and recreation capital improvement account  as
  9             created  in section 57-1801, Idaho Code. One per cent percent (1%) of
 10             the one and twenty-eight hundredths per cent percent (1.28%) shall be
 11             distributed to the search  and  rescue  account  created  in  section
 12             67-2903, Idaho Code;
 13             2.  One and twenty-eight hundredths per cent percent (1.28%) shall be
 14             distributed  as  follows: sixty-six per cent percent (66%) of the one
 15             and twenty-eight hundredths per cent percent (1.28%)  shall  be  dis-
 16             tributed to the off-road motor vehicle account, as created in section
 17             57-1901,  Idaho  Code.  Up  to  twenty  per cent percent (20%) of the
 18             moneys distributed to the off-road  motor  vehicle  account  by  this
 19             subpart  subparagraph may be used by the department of parks and rec-
 20             reation to defray administrative costs. Any moneys unused at the  end
 21             of the fiscal year by the department of parks and recreation shall be
 22             returned  to  the  state  treasurer for deposit in the off-road motor
 23             vehicle account. Thirty-three per cent percent (33%) of the  one  and
 24             twenty-eight hundredths per cent percent (1.28%) shall be distributed
 25             into  the  park and recreation capital improvement account as created
 26             in section 57-1801, Idaho Code. One per cent percent (1%) of the  one
 27             and  twenty-eight  hundredths  per cent percent (1.28%) shall be dis-
 28             tributed to the search and rescue account created in section 67-2903,
 29             Idaho Code; and
 30             3.  Forty-four hundredths per cent percent (.44%) shall  be  distrib-
 31             uted  to  the park and recreation capital improvement account as cre-
 32             ated in section 57-1801, Idaho Code, to be  used  solely  to  improve
 33             develop,  construct, maintain and repair roads, and bridges and park-
 34             ing areas within and leading to parks and  recreation  areas  of  the
 35             state.
 36             4.  The balance remaining shall be distributed to the highway distri-
 37             bution account created in section 40-701, Idaho Code.
 38        (2)  The  revenues  received  from  the  taxes imposed by section 63-2408,
 39    Idaho Code, and any penalties, interest, and deficiency amounts, shall be dis-
 40    tributed as follows:
 41        (a)  An amount of money shall be distributed to the state  refund  account
 42        sufficient  to  pay  current  refund claims. All refunds authorized by the
 43        commission to be paid shall be paid from the  state  refund  account,  and
 44        those moneys are hereby continuously appropriated.
 45        (b)  The balance remaining of all the taxes collected shall be distributed
 46        to  the  state  aeronautics  account, as provided in section 21-211, Idaho
 47        Code.
                                                                        
 48        SECTION 2.  This act shall be in full force and effect on and  after  July
 49    1, 2000.

                           STATEMENT  OF  PURPOSE
                             RS09354
This proposed legislation will broaden the use of recreational road and
bridge funds, derived from a portion of state gasoline taxes, to include
parking areas within and leading to state park and recreation areas.






                         FISCAL  IMPACT
The department estimates $300,000 is needed for road and bridge
improvements in FY 2001.  Approximately $50,000 of this amount would be
utilized for parking area improvements and maintenance if this proposal
is passed.  This represents a reallocation of existing dedicated funds.
