  1                                        AN ACT
  2    RELATING TO VETERANS; AMENDING SECTION 49-418, IDAHO CODE, TO PROVIDE  THAT  A
  3        PORTION  OF  THE  SPECIAL  PROGRAM FEES FOR VETERANS MOTOR VEHICLE LICENSE
  4        PLATES SHALL BE DEPOSITED TO THE VETERANS CEMETERY MAINTENANCE  FUND;  AND
  5        AMENDING CHAPTER 1, TITLE 65, IDAHO CODE, BY THE ADDITION OF A NEW SECTION
  6        65-107,  IDAHO CODE, TO CREATE A VETERANS CEMETERY MAINTENANCE FUND AND TO
  7        PROVIDE FOR PURPOSES AND ADMINISTRATION OF MONEYS IN THE FUND.
                                                                        
  8    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  9        SECTION 1.  That Section 49-418, Idaho Code, be, and the  same  is  hereby
 10    amended to read as follows:
                                                                        
 11        49-418.  VETERANS  PLATES.  (1)  Any  person who is the owner of a vehicle
 12    registered under the provisions of section 49-402 or  49-434(1),  Idaho  Code,
 13    may  apply  for  and upon department approval receive special veterans license
 14    plates in lieu of regular license plates. The provisions of this section shall
 15    not apply to any vehicle with a registered maximum gross weight  over  sixteen
 16    thousand  (16,000)  pounds. Availability of veterans plates for other vehicles
 17    shall be subject to the rules, policies and procedures of the department.
 18        (2)  Proof of being a current or former member of the United States  armed
 19    forces must be furnished to the department before special veterans plates will
 20    be  issued.  Acceptable  proof  shall be a copy of form DD214 or an equivalent
 21    document or statement from the department of veterans affairs.
 22        (3)  In addition to the regular  registration  fees  required  in  section
 23    49-402(1)  or  49-434(1), Idaho Code, the applicant shall pay the initial pro-
 24    gram fee of twenty-five dollars ($25.00) and the annual program fee of fifteen
 25    dollars ($15.00) as specified in section 49-402, Idaho Code, and the plate fee
 26    specified in section 49-450, Idaho Code. Ten dollars ($10.00) of  the  initial
 27    program fee and ten dollars ($10.00) of the annual program fee shall be depos-
 28    ited in the state highway account and shall be used to fund the cost of admin-
 29    istration  of  this special license plate program. Fifteen dollars ($15.00) of
 30    the initial program fee and five dollars ($5.00) of  the  annual  program  fee
 31    shall  be  deposited to the veterans cemetery maintenance fund created in sec-
 32    tion 65-107, Idaho Code, and shall be used to operate  and  maintain  a  state
 33    veterans cemetery.
 34        (4)  Whenever  title  or interest in a vehicle registered under the provi-
 35    sions of this section is transferred or assigned, the owner may  transfer  the
 36    special  plates to another vehicle upon payment of the required transfer fees.
 37    The owner may only display the plates on another vehicle upon receipt  of  the
 38    new registration from the department.
 39        (5)  The veterans license plate design shall include the colors red, white
 40    and  blue,  shall  designate one (1) of the five (5) branches of military ser-
 41    vice, and display either:
 42        (a)  The word "VETERAN" or
 43        (b)  The name of a conflict or war period recognized by the United  States

  1        department  of  veterans  affairs for the purpose of awarding federal vet-
  2        erans benefits as defined in 38 U.S.C. 101(11).
  3    The license plate design shall comply with all applicable rules of the depart-
  4    ment, and shall include a separate and distinct numbering system. The  design,
  5    color, and numbering system shall be subject to approval of the department.
                                                                        
  6        SECTION  2.  That  Chapter  1,  Title  65, Idaho Code, be, and the same is
  7    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
  8    ignated as Section 65-107, Idaho Code, and to read as follows:
                                                                        
  9        65-107.  VETERANS  CEMETERY MAINTENANCE FUND. (1)  There is hereby created
 10    in the state treasury a fund to be known as the "veterans cemetery maintenance
 11    fund" to which shall be deposited the revenues derived from the  program  fees
 12    for  special  veterans  motor  vehicle  license  plates as provided in section
 13    49-418, Idaho Code, and any other moneys as may be provided by  law.  Interest
 14    earned  on idle moneys in the veterans cemetery maintenance fund shall be paid
 15    to such fund.
 16        (2)  Moneys in the fund shall be used  exclusively  for  the  purposes  of
 17    operating  and maintaining a state veterans cemetery, and moneys shall be con-
 18    tinuously appropriated for such purposes.
 19        (3)  The administrator of the division of veterans services shall have the
 20    authority and the responsibility, with the advice and approval  of  the  Idaho
 21    veterans affairs commission created in section 65-201, Idaho Code, to adminis-
 22    ter moneys for the purposes indicated.

                 STATEMENT OF PURPOSE

     The purpose of this proposal is to provide that a portion of the special program
     fees for veterans motor vehicle license plates shall be deposited to the Veterans
     Cemetery Maintenance Fund, to create the fund and provide for purposes and
     administration of monies in the fund within the authority of the veterans affairs
     commission, as defined in Section 65-201. 
     
     
     
                    FISCAL IMPACT 
     
     There should be no fiscal impact on the general fund, as proceeds from the special
     plates should cover costs of maintenance of the cemetery.
