  1                                        AN ACT
  2    RELATING TO OPTIONS WITHIN THE PUBLIC SCHOOLS; PROVIDING  LEGISLATIVE  INTENT;
  3        AMENDING CHAPTER 9, TITLE 33, IDAHO CODE, BY THE ADDITION OF A NEW SECTION
  4        33-907,  IDAHO  CODE, TO CREATE THE PUBLIC SCHOOL OPTIONS FUND, TO PROVIDE
  5        FOR WHAT MONEYS IN THE FUND MAY BE EXPENDED, TO PROVIDE FOR GRANTS AND  TO
  6        PROVIDE FOR MAXIMUM AMOUNTS OF GRANTS; AND PROVIDING A SUNSET CLAUSE.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION 1.  LEGISLATIVE INTENT. The Legislature finds that individual stu-
  9    dents  can  respond  differently in different educational settings.  Where one
 10    individual child can flourish under one set of  educational  circumstances,  a
 11    second  can  experience  great  difficulties in those identical circumstances.
 12    School districts that offer students a broad array of educational options  are
 13    responding to the tenet that students are best served when they and their par-
 14    ents  are  able  to  better match individual circumstances and needs to educa-
 15    tional opportunities. This legislation is intended to encourage public schools
 16    to experiment with differing curriculums, settings, processes  and  structures
 17    that offer students clear choice options within the public schools.
                                                                        
 18        SECTION  2.  That  Chapter  9,  Title  33, Idaho Code, be, and the same is
 19    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 20    ignated as Section 33-907, Idaho Code, and to read as follows:
                                                                        
 21        33-907.  PUBLIC  SCHOOL OPTIONS FUND. There is hereby created in the state
 22    treasury the public school options fund which shall  be  administered  by  the
 23    state  board  of  education through the department of education. Moneys in the
 24    fund may be expended pursuant to appropriation. The fund may accept donations,
 25    grants or funds from any source. The fund is created to award one-time  grants
 26    on  a competitive basis to Idaho public schools that develop an implementation
 27    plan to be financed by grant dollars from the fund,  which  plan  offers  some
 28    clear  choice  available  to  some  segment of a public school population. The
 29    choice may be offered within an individual school district,  school  or  grade
 30    within  a  school.  It is expected that school districts will use grant moneys
 31    from the fund for start-up purposes and will devise  ways  to  maintain  these
 32    choice opportunities in subsequent years. As a condition of securing a grant a
 33    school  district must, at a minimum, outline in its application the following:
 34    a brief description and rationale for the proposed plan; a list  of  the  stu-
 35    dents  and  staff who have committed to participate in the "choice program"; a
 36    brief background on why the proposal is a new  choice  opportunity  for   stu-
 37    dents;  an  outline  of  how the school district will evaluate the effects and
 38    effectiveness of the program; the recipient district shall agree to report  to
 39    the state department of education the results of their evaluation; an itemized
 40    spending  plan  and  a brief description of how the district can maintain this
 41    program in subsequent years without additional funding from the public  school
 42    options  fund. Public school options grants shall have a maximum amount of one

  1    hundred thousand dollars ($100,000) if funds are available.
                                                                        
  2        SECTION 3.  This act shall be null, void and of no force and effect on and
  3    after July 1, 2003.

  1                                AMENDMENT TO SECTION 2
  2        On page 1 of the printed bill, in line 40,  following  "program;"  insert:
  3    "the  recipient district shall agree to report to the state department of edu-
  4    cation the results of their evaluation;".
  5        On page 2, delete lines 1 through 3 and insert: "grants shall have a maxi-
  6    mum amount of one hundred thousand dollars  ($100,000)  if  funds  are  avail-
  7    able.".
                                                                        
  8                                AMENDMENT TO THE BILL
  9        On page 2, delete lines 4 through 6 and insert:
 10        "SECTION 3. This act shall be null, void and of no force and effect on and
 11    after July 1, 2003.".
                                                                        
 12                                 CORRECTION TO TITLE
 13        On  page  1,  delete  lines  6  through 8 and insert: "PROVIDE FOR MAXIMUM
 14    AMOUNTS OF GRANTS; AND PROVIDING A SUNSET CLAUSE.".

                 STATEMENT OF PURPOSE

     The purpose of this legislation is to establish a special fund with the Idaho State
     Board of Education that will be used to award competitive grants to school
     districts wishing to establish new choice options within their public schools. The
     grant awards are on a one-time basis and are intended as startup funds to establish
     new learning options to parents and students. Often times a district or school is
     restricted in their thinking "outside of the box" because of the costs associated
     with change. The public school option fund is developed to assist in this area. 
     
     
     
                    FISCAL IMPACT 
     
     A $500,000.00 appropriation request for FY2001 was included in the Governor's
     Executive Budget request. Actual funding is subject to Joint
     Finance-Appropriation Committee action.
