  1                               A CONCURRENT RESOLUTION
  2    STATING FINDINGS OF THE LEGISLATURE AND AUTHORIZING THE LEGISLATIVE COUNCIL TO
  3        APPOINT A COMMITTEE TO UNDERTAKE AND COMPLETE A STUDY  OF  THE  COMMERCIAL
  4        PRACTICE OF MAKING UNAUTHORIZED TRANSFERS OF PERSONAL INFORMATION ABOUT AN
  5        INDIVIDUAL TO THIRD PARTIES FOR PURPOSES OF COMMERCIAL SOLICITATION.
                                                                        
  6    Be It Resolved by the Legislature of the State of Idaho:
                                                                        
  7        WHEREAS,  the  Idaho Legislature has expressed a strong policy in favor of
  8    protecting the private affairs of Idahoans;
  9        WHEREAS, because of improvements in electronic  technology  and  expanding
 10    markets,  it  is  increasingly common for some businesses to make unauthorized
 11    transfers of personal information about an individual to third parties  to  be
 12    used for commercial solicitation by the third parties;
 13        WHEREAS,  information transferred without authority is often very personal
 14    and sensitive, and often includes information about one's personal life, phys-
 15    ical health, mental health and financial and pharmaceutical records;
 16        WHEREAS, Idaho citizens are being harmed because they can no longer  main-
 17    tain the privacy of their personal information;
 18        WHEREAS,  the  Idaho  Department  of  Finance  and the Idaho Department of
 19    Insurance regulate many of the businesses that acquire personal information in
 20    the course of their business;
 21        WHEREAS, in 1999, in response to concerns about unauthorized transfers  of
 22    personal  information,  the  United  States  Congress  enacted a comprehensive
 23    financial privacy law as a part of the   recent  Gramm-Leach-Bliley  Financial
 24    Modernization Act;
 25        WHEREAS,  Idaho citizens would benefit from improvements in state law that
 26    would allow Idaho to enforce the same privacy protections under state law,  in
 27    addition  to those provided under the federal law, and which would enable cus-
 28    tomers to instruct their financial institutions and insurance companies to not
 29    transfer personal information without the consent of the customer.
 30        NOW, THEREFORE, BE IT RESOLVED by the members of the Second  Regular  Ses-
 31    sion  of  the  Fifty-fifth Idaho Legislature, the House of Representatives and
 32    the Senate concurring therein, that the Legislative Council is  authorized  to
 33    appoint a committee to undertake and complete a study of the business acquisi-
 34    tion,  use  and practice of making unauthorized transfers of personal informa-
 35    tion about an individual to third parties for purposes of commercial solicita-
 36    tion. The Legislative Council shall determine the number  of  legislators  and
 37    membership  from each house appointed to the committee and shall authorize the
 38    committee to receive input, advice and assistance from interested and affected
 39    parties who are not members of the legislature.
 40        BE IT FURTHER RESOLVED that nonlegislative members of the committee may be
 41    appointed by the cochairs of the committee who are appointed by  the  Legisla-
 42    tive  Council.  Nonlegislative  members of the advisory committee shall not be
 43    reimbursed from legislative funds for per diem, mileage or other expenses  and
 44    shall  not have voting privileges regarding the committee's recommendations or

  1    proposed legislation.
  2        BE IT FURTHER RESOLVED that the committee shall report its findings,  rec-
  3    ommendations and proposed legislation, if any, to the First Regular Session of
  4    the Fifty-sixth Idaho Legislature.

                  STATEMENT OF PURPOSE
                       RS 10248

This bill authorizes the Legislative Council to appoint a 
committee to undertake a study of the business practice of 
making unauthorized transfers of personal information to 
third parties for commercial solicitation and laws regulating 
transfers of information.

                        FISCAL IMPACT

Usual costs of a study committee are estimated at $6,000, which 
comes out of the Legislative Account.
