  4        1999,  SECTION  1, CHAPTER 317, LAWS OF 1999, SECTION 1, CHAPTER 318, LAWS
  5        OF 1999,  SECTION 1, CHAPTER 319, LAWS OF 1999,  AND  SECTION  2,  CHAPTER
  6        360,  LAWS  OF 1999, TO PROVIDE A ONE-YEAR COMMERCIAL DRIVER'S LICENSE FOR
  7        PERSONS AGED TWENTY YEARS, TO PROVIDE A ONE-YEAR CLASS D DRIVER'S  LICENSE
  8        FOR  PERSONS  AGED  SEVENTEEN  YEARS  OR  TWENTY YEARS, TO CLARIFY THAT AN
  9        EIGHT-YEAR LICENSE IS AVAILABLE ONLY TO PERSONS AGED TWENTY-ONE TO  SIXTY-
 10        THREE  YEARS,  TO  PROVIDE  FOR DISTRIBUTION OF FEES AND TO MAKE TECHNICAL
 11        CORRECTIONS; AMENDING SECTION 49-319, IDAHO CODE, AS  AMENDED  BY  SECTION
 12        12,  CHAPTER  81,  LAWS OF 1999, SECTION 2, CHAPTER 317, LAWS OF 1999, AND
 13        SECTION 3, CHAPTER 318, LAWS OF 1999, TO CLARIFY DATES OF  EXPIRATION  AND
 14        RENEWAL  FOR  COMMERCIAL AND NONCOMMERCIAL DRIVER'S LICENSES, TO PROVIDE A
 15        FIVE-DAY EXTENSION FOR RENEWAL OF  DRIVER'S  LICENSES  FOR  PERSONS  WHOSE
 16        LICENSES  EXPIRE  ON  THEIR  EIGHTEENTH  BIRTHDAY OR ON THEIR TWENTY-FIRST
 17        BIRTHDAY, AND TO MAKE TECHNICAL  CORRECTIONS;  AMENDING  SECTION  49-2444,
 18        IDAHO CODE, AS AMENDED BY SECTION 2, CHAPTER 79, LAWS OF 1999, SECTION 21,
 19        CHAPTER  81,  LAWS OF 1999, SECTION 3, CHAPTER 317, LAWS OF 1999, AND SEC-
 20        TION 4, CHAPTER 318, LAWS OF 1999, TO PROVIDE  A  FIVE-DAY  EXTENSION  FOR
 21        RENEWAL  OF AN IDENTIFICATION CARD FOR PERSONS WHOSE CARDS EXPIRE ON THEIR
 22        EIGHTEENTH BIRTHDAY OR ON THEIR TWENTY-FIRST BIRTHDAY;  AND  PROVIDING  AN
 23        EFFECTIVE DATE.
                                                                        
 24    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 25        SECTION  1.  That  Section  49-306,  Idaho  Code, as amended by Section 9,
 26    Chapter 81, Laws of 1999, Section 1, Chapter 317, Laws  of  1999,  Section  1,
 27    Chapter  318,  Laws of 1999, Section 1, Chapter 319, Laws of 1999, and Section
 28    2, Chapter 360, Laws of 1999, be, and the same is hereby amended  to  read  as
 29    follows:
                                                                        
 30        49-306.  APPLICATION FOR DRIVER'S LICENSE OR INSTRUCTION PERMIT. (1) Every
 31    application  for an instruction permit or for a driver's license shall be made
 32    upon a form furnished by the department and shall be verified by the applicant
 33    before a person authorized to administer oaths. Officers and employees of  the
 34    department  and  sheriffs  and their deputies are authorized to administer the
 35    oaths without charge. Every application for a permit,  extension  or  driver's
 36    license  shall  be  accompanied by the following fee, none of which is refund-
 37    able:
 38        (a)  Class A, B, C (4-year) license with endorsements - age 21  years  and
 39        older ............................................................. $28.50
 40        (b)  Class A, B, C (3-year) license with endorsements - under age 18 to 21

 24        (2)  Every application shall state the true and full name, date of  birth,
 25    sex,  declaration  of  Idaho  residency,  Idaho  residence address and mailing
 26    address, if different, of the applicant, height, weight, hair color,  and  eye
 27    color,  and  the  applicant's  social  security  number  as  verified  by  the
 28    applicant's social security card or by the social security administration.
 29        (a)  The requirement that an applicant provide a social security number as
 30        verified by his social security card or by the social security administra-
 31        tion  shall apply only to applicants who have been assigned a social secu-
 32        rity number.
 33        (b)  An applicant who has not  been  assigned  a  social  security  number
 34        shall:
 35             (i)   Present  written verification from the social security adminis-
 36             tration that the applicant has not been assigned  a  social  security
 37             number; and
 38             (ii)  Submit  a birth certificate, passport or other documentary evi-
 39             dence issued by an entity other than a state or  the  United  States;
 40             and
 41             (iii) Submit such proof as the department may require that the appli-
 42             cant is lawfully present in the United States.
 43        A  driver's  license  or instruction permit issued on and after January 1,
 44    1993, shall not contain an applicant's social security number. Applications on
 45    file shall be exempt from disclosure except as provided  in  sections  49-202,
 46    49-203, 49-203A and 49-204, Idaho Code.
 47        Every  application  shall  also state whether the applicant has previously
 48    been licensed as a driver, and if so, when and by what state or  country,  and
 49    whether  a  driver's  license or privileges have ever been suspended, revoked,
 50    denied, disqualified, cancelled  or  whether  an  application  has  ever  been
 51    refused,  and  if  so,  the date of and reason for the suspension, revocation,
 52    denial, disqualification, cancellation or refusal  and  the  applicant's  oath
 53    that all information is correct as signified by the applicant's signature.
 54        The  applicant  may  be required to submit proof of identity acceptable to
 55    the examiner or the department and date of birth as set forth in  a  certified

  1    copy  of his birth certificate when obtainable, or another document which pro-
  2    vides satisfactory evidence of a person's date  of  birth  acceptable  to  the
  3    examiner or the department.
  4        (3)  Whenever an application is received from a person previously licensed
  5    in  another  jurisdiction, the department shall request a copy of the driver's
  6    record from the other jurisdiction and shall contact the national driver  reg-
  7    ister. When received, the driver's record from the previous jurisdiction shall
  8    become  a  part  of  the driver's record in this state with the same force and
  9    effect as though entered on the driver's record in this state in the  original
 10    instance.
 11        (4)  Whenever the department receives a request for a driver's record from
 12    another licensing jurisdiction, the record shall be forwarded without charge.
 13        (5)  The department shall contact and notify the commercial driver license
 14    information  system of the proposed application for a class A, B or C driver's
 15    license to insure identification of the person  and  to  obtain  clearance  to
 16    issue the license.
 17        (6)  When  the  fees required under this section are collected by a county
 18    officer, they shall be paid over to the county treasurer not less  often  than
 19    monthly, who shall immediately:
 20        (a)  Deposit  an  amount equal to five dollars ($5.00) from each four-year
 21        driver's license except an eight-year class D license, or instruction per-
 22        mit application fees, application for a duplicate driver's license or per-
 23        mit, classification  change,  seasonal  driver's  license  and  additional
 24        endorsement,  and  ten  dollars  ($10.00)  from  each  eight-year  class D
 25        driver's license, in the current expense fund; and
 26        (b)  Deposit two dollars and fifty  cents  ($2.50)  from  each  motorcycle
 27        endorsement  and motorcycle endorsement instruction permit fee in the cur-
 28        rent expense fund; and
 29        (c)  Deposit an amount equal to three dollars ($3.00) from each fee for  a
 30        knowledge test in the current expense fund; and
 31        (d)  Deposit  an  amount equal to five dollars ($5.00) from each fee for a
 32        motorcycle endorsement skills test in the current expense  fund;  provided
 33        however,  if a contractor administers the skills test he shall be entitled
 34        to the five dollar ($5.00) fee; and
 35        (e)  Remit the remainder to the state treasurer; and
 36        (f)  Deposit eleven dollars and fifty cents ($11.50) from each fee  for  a
 37        class  D skills test into the county current expense fund, unless the test
 38        is administered by a department-approved contractor,  in  which  case  the
 39        contractor shall be entitled to eleven dollars and fifty cents ($11.50) of
 40        each fee.
 41        (7)  When  the  fees  required under this section are collected by a state
 42    officer or agency, they shall be paid over to the state treasurer.
 43        (8)  The state treasurer shall distribute the moneys  received  from  fees
 44    imposed by the provisions of this section, whether collected by a county offi-
 45    cer or by a state officer or agency as follows:
 46        (a)  Two  dollars  ($2.00) of each fee for a four-year driver's license or
 47        seasonal driver's license, and four dollars ($4.00) of  each  fee  for  an
 48        eight-year  class  D  driver's  license,  and  one  dollar and fifty cents
 49        ($1.50) of each fee charged for driver's licenses pursuant to  subsections
 50        (1)(b), (c) and (d) and (e) of this section, and fifty cents (50) of each
 51        fee  charged  for driver's licenses pursuant to subsections (1)(c) and (f)
 52        of this section, shall be deposited  in  the  emergency  medical  services
 53        account  II  created  in  section  39-146A,  Idaho  Code, and four dollars
 54        ($4.00) of each such fee charged pursuant to subsections (1)(a),  (g)  and
 55        (s)  of  this section shall be deposited in the emergency medical services

  1        account III created in section 39-146B, Idaho Code; and
  2        (b)  Sixteen dollars and fifty cents ($16.50) of each fee for  a  seasonal
  3        or class A, B, or C driver's license, and ten dollars ($10.00) of each fee
  4        charged  for  a license pursuant to subsection (1)(b) of this section, and
  5        five dollars and forty-one cents ($5.41) of each fee charged for a license
  6        pursuant to subsection (1)(c) of this section shall be  deposited  in  the
  7        state highway account; and
  8        (c)  Ten dollars and fifty cents ($10.50) of each fee for a class A, B, or
  9        C  instruction  permit  or driver's license classification change shall be
 10        deposited in the state highway account; and
 11        (d)  Four dollars ($4.00) of each fee for a class A, B, or  C  instruction
 12        permit  shall  be  deposited in the emergency medical services account III
 13        created in section 39-146B, Idaho Code; and
 14        (e)  Six dollars and fifty cents ($6.50) of each fee for a duplicate  sea-
 15        sonal  or  class  A,  B,  or C driver's license, class A, B, or C driver's
 16        license extension, or additional endorsement shall  be  deposited  in  the
 17        state highway account; and
 18        (f)  Four  dollars  ($4.00)  of  each fee for a motorcycle endorsement and
 19        motorcycle endorsement instruction permit shall be deposited in the  state
 20        highway account; and
 21        (g)  Five  dollars  and  thirty  cents ($5.30) of each fee for a four-year
 22        class D driver's license, and ten dollars and sixty cents ($10.60) of each
 23        fee for an eight-year class D driver's license, and four  dollars  ($4.00)
 24        of  each  fee charged for a license pursuant to subsections (1)(c) and (d)
 25        and (e) of this section, and one dollar and thirty-three cents ($1.33)  of
 26        each  fee charged for a license pursuant to subsection (1)(f) of this sec-
 27        tion shall be deposited in the driver training account; and
 28        (h)  Seven dollars and twenty cents ($7.20) of each fee  for  a  four-year
 29        class D driver's license, and fourteen dollars and forty cents ($14.40) of
 30        each  fee  for  an  eight-year  class  D driver's license, and six dollars
 31        ($6.00) of each fee charged for a license pursuant to  subsections  (1)(c)
 32        and  (d) and (e) of this section, and four dollars and eight cents ($4.08)
 33        of each fee charged for a license pursuant to subsection  (1)(f)  of  this
 34        section shall be deposited in the highway distribution account; and
 35        (i)  Two  dollars  and  sixty  cents  ($2.60)  of  each  fee for a class D
 36        instruction permit, duplicate class D  license  or  permit,  and  class  D
 37        license extension shall be deposited in the driver training account; and
 38        (j)  Three  dollars  and  ninety  cents  ($3.90) of each fee for a class D
 39        instruction permit, duplicate class D  license  or  permit,  and  class  D
 40        license  extension shall be deposited in the highway distribution account;
 41        and
 42        (k)  Five dollars ($5.00) of each fee for a class A, B, or C  skills  test
 43        shall be deposited in the state highway account; and
 44        (l)  One  dollar ($1.00) of each fee for a class A, B, C or or four-year D
 45        driver's license, and two dollars ($2.00) of each fee  for  an  eight-year
 46        class D driver's license, and one dollar ($1.00) of each fee charged for a
 47        license  pursuant  to subsections (1)(b), (c) and (d) and (e) of this sec-
 48        tion, and thirty-four cents (34) of each fee charged for a license pursu-
 49        ant to subsections (1)(c) and (f) of this section shall  be  deposited  in
 50        the  motorcycle  safety program fund established in section 33-4904, Idaho
 51        Code; and
 52        (m)  Three dollars and fifty cents ($3.50) of  each  fee  for  a  class  D
 53        skills test shall be deposited into the state highway account.
 54        (9)  The  contractor administering a class A, B, or C skills test shall be
 55    entitled to not more than fifty dollars ($50.00) of the  skills  test  fee.  A

  1    contractor  administering  a class A, B, or C skills test may collect an addi-
  2    tional fee for the use of the contractor's vehicle for the skills test.
  3        (10) Thirty-five dollars ($35.00) of each restricted driving permit  shall
  4    be deposited in the state highway account.
  5        (11) The  department  may  issue  seasonal  class B or C driver's licenses
  6    that:
  7        (a)  Will only be valid for  driving  commercial  vehicles  that  normally
  8        require class B or C commercial driver's licenses;
  9        (b)  Will be valid for seasonal periods that begin on the date of issuance
 10        and  that are not to exceed one hundred eighty (180) days in a twelve (12)
 11        month period;
 12        (c)  May only be obtained twice in a driver's lifetime;
 13        (d)  Are valid only within a one hundred fifty (150) mile  radius  of  the
 14        place of business or farm being serviced; and
 15        (e)  Will  be  valid only in conjunction with valid Idaho class D driver's
 16        licenses.
 17        (12) The department may issue seasonal class B or C driver's  licenses  to
 18    drivers who:
 19        (a)  Have not violated the single license provisions of 49 CFR part 383;
 20        (b)  Have not had any license suspensions, revocations or cancellations;
 21        (c)  Have not had any convictions in any vehicle for any offense listed in
 22        section  49-335(1)  or  (2),  Idaho  Code,  or any one (1) serious traffic
 23        offense;
 24        (d)  Have at least one (1) year of driving experience with a  class  D  or
 25        equivalent license in any type motor vehicle; and
 26        (e)  Are at least sixteen (16) years old.
                                                                        
 27        SECTION  2.  That  Section  49-319,  Idaho Code, as amended by Section 12,
 28    Chapter 81, Laws of 1999, Section 2, Chapter 317, Laws of 1999, and Section 3,
 29    Chapter 318, Laws of 1999, be, and the same is hereby amended to read as  fol-
 30    lows:
                                                                        
 31        49-319.  EXPIRATION  AND RENEWAL OF DRIVER'S LICENSE. (1) Every noncommer-
 32    cial Idaho driver's license issued to a  driver  under  shall  expire  and  be
 33    renewable as follows:
 34        (a)  Ttwenty-one  (21)  years  of age and sixty-three (63) years of age or
 35        older shall expire on the licensee's birthday in the fourth year following
 36        the issuance of the driver's license.
 37        (b)  At the option of the applicant, for drivers twenty-one (21) years  of
 38        age through sixty-two (62) years of age, the driver's license shall expire
 39        either  on  the  licensee's birthday in the fourth year or the eighth year
 40        following the issuance of the driver's license.
 41        (c)  Every driver's license issued to a driver under eighteen  (18)  years
 42        of  age  shall  expire  on  five  (5) days after the licensee's eighteenth
 43        birthday.
 44        (d)  Every driver's license issued to a driver eighteen (18) years of  age
 45        but under twenty-one (21) years of age shall expire on five (5) days after
 46        the licensee's twenty-first birthday.
 47        (e)  Except licenses issued to drivers under twenty-one (21) years of age,
 48        eEvery  driver's  license  that  is  not,  as  provided by law, suspended,
 49        revoked or disqualified in this state or any other jurisdiction  shall  be
 50        renewable  on  or  before  its  expiration, except those issued to drivers
 51        under twenty-one (21) years of age, but not more than twelve  (12)  months
 52        before,  upon  application,  payment of the required fee, and satisfactory
 53        completion of the required eyesight examination.

  1        (2)  Every commercial driver's license issued to a person twenty-one  (21)
  2    years  of  age  or older shall expire on the licensee's birthday in the fourth
  3    year following issuance of the license, and any Class A, B or C license issued
  4    to a person eighteen (18), nineteen (19) or twenty (20)  years  of  age  shall
  5    expire  five  (5) days after the licensee's twenty-first birthday. There shall
  6    be no option for an eight-year Class A, B or C license.
  7        (3)  An applicant who is issued a driver's license in another jurisdiction
  8    after an Idaho driver's license has been issued is not eligible for renewal or
  9    a duplicate of the Idaho driver's license. The applicant may apply for  a  new
 10    Idaho driver's license as provided in section 49-306, Idaho Code.
 11        (34)  No  knowledge  test  shall  be  required  for  renewal of a driver's
 12    license, except for renewal of a hazardous material  endorsement.  Appropriate
 13    knowledge  and  skill  tests  shall  be  required for an upgrade in a driver's
 14    license class or an endorsement addition. In the case of a  name  change,  the
 15    applicant shall provide legal documentation to verify the change in accordance
 16    with department rules.
 17        (45)  Except  for  drivers  under  twenty-one  (21)  years of age, wWhen a
 18    driver's license has been expired for less fewer than twelve (12) months,  the
 19    renewal  of the driver's license shall start from the original date of expira-
 20    tion regardless of the year in which the application for renewal is  made.  If
 21    the  driver's license is expired for twelve (12) months or more, the applicant
 22    shall be required to take the knowledge, skills for the class  of  license  or
 23    endorsement  being  applied  for,  and  vision tests and the application shall
 24    expire on the licensee's birthday in the fourth year following issuance of the
 25    driver's license for drivers under twenty-one (21) years of  age  and  drivers
 26    sixty-three  (63)  years  of age or older. At the option of the applicant, for
 27    drivers twenty-one (21) years of age through sixty-two (62) years of age,  the
 28    renewed  license  shall expire either on the licensee's birthday in the fourth
 29    year or the eighth year following issuance.
 30        (56) (a)  If a driver's license has expired or will expire and the  licen-
 31        see  is  temporarily  out-of-state except on active military duty, and the
 32        driver's license has not, as provided by  law,  been  suspended,  revoked,
 33        cancelled,  denied,  refused  or disqualified, the licensee may request in
 34        writing on a form  prescribed  by  the  department  an  extension  of  the
 35        driver's  license.  The  request  shall be accompanied by the fee fixed in
 36        section 49-306, Idaho Code, and the extension shall be less than a  twelve
 37        (12)  month  period. If the department determines that an extension of the
 38        driver's license is necessary, it may issue  a  certificate  of  extension
 39        showing  the  date  to which the expired driver's license is extended, and
 40        this certificate shall be attached to the expired driver's  license.  Cer-
 41        tificates of extension are limited to two (2) per licensee.
 42        (b)  Upon  returning  to the state of Idaho, the licensee shall within ten
 43        (10) days, apply for a renewal of the expired driver's license and surren-
 44        der the certificate of extension and the expired driver's license.
 45        (c)  A hazardous material endorsement cannot be extended.
 46        (67)  An Idaho driver's license issued to any person prior to  serving  on
 47    active duty in the armed forces of the United States, or a member of the imme-
 48    diate family accompanying such a person, if valid and in full force and effect
 49    upon  entering  active  duty, shall remain in full force and effect and shall,
 50    upon application, be extended for a period of four (4) years so long as active
 51    duty continues, if the driver's license is not  suspended,  denied,  disquali-
 52    fied,  cancelled  or  revoked, as provided by law, during the active duty, and
 53    the driver's license shall remain in full force and  effect  sixty  (60)  days
 54    following the date the holder is released from active duty.
 55        (78)  The  department may use a mail renewal process for four-year class D

  1    licenses based on criteria established by rule.
  2        (89)  A seasonal driver's license is only valid for a one  hundred  eighty
  3    (180)  day  period  from  the date of issuance. Only one (1) seasonal driver's
  4    license may be obtained in any twelve (12)  month  period,  and  may  only  be
  5    obtained twice in a driver's lifetime.
                                                                        
  6        SECTION  3.  That  Section  49-2444,  Idaho Code, as amended by Section 2,
  7    Chapter 79, Laws of 1999, Section 21, Chapter 81, Laws of 1999,    Section  3,
  8    Chapter  317, Laws of 1999, and Section 4, Chapter 318, Laws of 1999,  be, and
  9    the same is hereby amended to read as follows:
                                                                        
 10        49-2444.  IDENTIFICATION CARD ISSUED -- FOUR-YEAR OR EIGHT-YEAR.  (1)  The
 11    department  shall  issue  a distinguishing identification card which shall set
 12    forth the information contained in the application, in a form as prescribed by
 13    the department. All identification cards issued on or after January  1,  1993,
 14    shall  not  contain  the  applicant's  social  security number. An applicant's
 15    social security number shall be exempt from disclosure  except  for  inquiries
 16    from agencies or institutions authorized to obtain such information by federal
 17    law  or  regulation, from peace officers or from jury commissioners. Each card
 18    shall be issued a distinguishing number and shall bear upon it a color  photo-
 19    graph  of  the  applicant  which shall be taken by the examiner at the time of
 20    application. The photograph shall be taken without headgear or other  clothing
 21    or  device that disguises or otherwise conceals the face or head of the appli-
 22    cant. A waiver may be granted by the department allowing the applicant to wear
 23    headgear or other head covering for medical, religious or safety  purposes  so
 24    long as the face is not disguised or otherwise concealed.
 25        No person shall receive an identification card unless and until he surren-
 26    ders  to  the  department all identification cards in his possession issued to
 27    him by Idaho or any other jurisdiction, or any driver's license issued by  any
 28    other jurisdiction within the United States, or until he executes an affidavit
 29    that he does not possess an identification card or any driver's license.
 30        Identification  cards  issued  to persons under eighteen (18) years of age
 31    shall include a notation "under 18 until (month, day, year)," and  identifica-
 32    tion  cards  issued  to  persons eighteen (18) years of age to twenty-one (21)
 33    years of age shall include a notation "under 21 until (month, day, year)." The
 34    nonrefundable fee for  a  four-year  identification  card  issued  to  persons
 35    twenty-one  (21)  years of age or older shall be seven dollars and fifty cents
 36    ($7.50) of which five dollars ($5.00) shall be  retained  by  the  county  and
 37    credited  to the current expense fund, and two dollars and fifty cents ($2.50)
 38    shall be deposited in the state treasury to the credit of the highway  distri-
 39    bution  account. The nonrefundable fee for identification cards issued to per-
 40    sons under twenty-one (21) years of age shall be six dollars and  fifty  cents
 41    ($6.50),  of  which  five  dollars ($5.00) shall be retained by the county and
 42    credited to the current expense fund, and one dollar and fifty  cents  ($1.50)
 43    shall  be deposited in the state treasury to the credit of the highway distri-
 44    bution account. The nonrefundable fee for an  eight-year  identification  card
 45    shall  be  fifteen  dollars  ($15.00)  of  which ten dollars ($10.00) shall be
 46    retained by the county and credited to the current expense fund, and five dol-
 47    lars ($5.00) shall be deposited in the state treasury to  the  credit  of  the
 48    highway  distribution account. At the option of the applicant, the identifica-
 49    tion card issued to a person twenty-one (21)  years  of  age  or  older  shall
 50    expire  either  on  the cardholder's birthday in the fourth year or the eighth
 51    year following issuance of the card. Every identification  card  issued  to  a
 52    person  under  eighteen  (18) years of age shall expire on five (5) days after
 53    the person's eighteenth birthday. Every identification card issued to a person

  1    eighteen (18) years of age but under twenty-one (21) years of age shall expire
  2    on five (5) days after the person's twenty-first birthday.
  3        (2)  Every identification card,  except  those  issued  to  persons  under
  4    twenty-one  (21) years of age, shall be renewable on or before its expiration,
  5    but  not more than twelve (12) months before, and upon application and payment
  6    of the required fee.
  7        (3)  When an identification card has been expired  for  less  than  twelve
  8    (12) months, the renewal of the identification card shall start from the orig-
  9    inal  date  of  expiration regardless of the year in which the application for
 10    renewal is made. If the identification card is expired for  more  than  twelve
 11    (12)  months, the application shall expire, at the option of the applicant, on
 12    the applicant's birthday in the fourth year or the eighth year following reis-
 13    suance of the identification card.
 14        (4)  A person possessing an identification card desiring to donate any  or
 15    all  organs  or  tissue  in the event of death, pursuant to the provisions for
 16    donation of anatomical gifts as set forth in chapter 34, title 39, Idaho Code,
 17    at the option of the donor may indicate this desire on the identification card
 18    by the imprinting of the word "donor" on the identification card.
 19        (5)  In the case of a name change, the applicant shall provide legal docu-
 20    mentation to verify the change in accordance with department rules.
 21        (6)  Whenever any person, after applying for or receiving  an  identifica-
 22    tion  card,  shall  move  from  the address shown on the application or on the
 23    identification card issued, that person shall, within thirty (30) days, notify
 24    the transportation department in writing of the old and new addresses.
 25        (7)  The department shall cancel any identification card upon  determining
 26    that  the  person was not entitled to the issuance of the identification card,
 27    or that the person failed to give the required and correct information in  his
 28    application  or  committed fraud in making the application. Upon cancellation,
 29    the person shall surrender the cancelled identification card  to  the  depart-
 30    ment.
 31        (8)  If  any person shall fail to return to the department the identifica-
 32    tion card as required, the department may direct any peace officer  to  secure
 33    its possession and return the identification card to the department.
 34        (9)  The  department may issue a no-fee identification card to an individ-
 35    ual whose driver's license has been cancelled and voluntarily  surrendered  as
 36    provided  in  section  49-322(4),  Idaho  Code. The identification card may be
 37    renewed at no cost to the applicant as long as the  driver's  license  remains
 38    cancelled.
                                                                        
 39        SECTION  4.  This act shall be in full force and effect on and after Janu-
 40    ary 1, 2001.

Statement of Purpose / Fiscal Impact


                      STATEMENT OF PURPOSE
                            RS09528 

This legislation will amend Sections 49-306, 49-319, 49-2444, 
Idaho Code, as previously amended by Senate Bill 1169, 1999, 
which will be effective January 1, 2001. SBI169, 1999, created 
a distinct driver's license and identification card for youths 
15-18 and young adults 18-21. The purpose of the distinct 
driver's license and identification card is to assist retailers 
inidentifying age for those purchasing tobacco or alcoholic 
beverages. This legislation will further amend the previously 
referenced code in the following ways and will also become 
effective January 1, 2001:

Driver's license or identification cards issued to applicants 
under 21 years will expire five (5) days after their birthday.
It allows for a one- (1) year driver's license when an applicant 
is getting a license at age 17 or 20 which will expire on 
either the 18th or 21't birthday. It provides for a one-year 
commercial driver's license for an applicant aged 20 years.
It also provides for the distribution of fees collected.

                          FISCAL IMPACT

SB 1169, 1999, as approved, was determined to have a fiscal 
impact on the Idaho Transportation Department of $13,000 
for one-time contractor costs to modify an automated computer 
system. No additional cost to the department will be 
required with the proposed amendments.
