S1360|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature Second Regular Session - 2000IN THE SENATE SENATE BILL NO. 1360 BY JUDICIARY AND RULES COMMITTEE 1 AN ACT 2 RELATING TO THREATS AGAINST ELECTED OFFICIALS; AMENDING SECTION 18-1353A, 3 IDAHO CODE, TO PROHIBIT THREATS AGAINST ELECTED OFFICIALS OF A COUNTY OR 4 CITY; AND PROVIDING AN EFFECTIVE DATE. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 18-1353A, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 18-1353A. THREATS AGAINST STATE OFFICIALS OF THE EXECUTIVE, LEGISLATIVE 9 OR JUDICIAL BRANCH OR ELECTED OFFICIALS OF A COUNTY OR CITY. Whoever knowingly 10 and willfully deposits for conveyance in the mail or for a delivery from any 11 post office or by any letter carrier, any letter, paper, writing, print, 12 missive, or document containing any threat to take the life of or to inflict 13 bodily harm upon any state elected official of the executive or legislative 14 branch, or any justice, judge or magistrate of the judicial branch, or person 15 appointed to fill the vacancy of a state elected official of the executive or 16 legislative branch of the state of Idaho, or knowingly and willfully otherwise 17 makes any such threat against a state elected official of the executive or 18 legislative branch, or any justice, judge or magistrate of the judicial 19 branch, or person appointed to fill the vacancy of a state elected official of 20 the executive or legislative branch of the state of Idaho, or upon any elected 21 official of any county or city, is guilty of a misdemeanor and upon conviction 22 thereof shall be fined not to exceed one thousand dollars ($1,000) and shall 23 be sentenced to not to exceed one (1) year in the county jail. If such threat 24 is made while the defendant exhibits a firearm or other dangerous or deadly 25 weapon, the defendant shall be guilty of a felony. Upon a second or subsequent 26 conviction of an offense under this section, the defendant shall be guilty of 27 a felony and shall be sentenced to a term of not to exceed five (5) years in 28 the state penitentiary. 29 SECTION 2. This act shall be in full force and effect on and after July 30 1, 2000.
STATEMENT OF PURPOSE 09690C1 Idaho law makes it a misdemeanor to make threats against state officials. This proposed legislation would also make it a misdemeanor to make such threats against elected city and county officials. FISCAL IMPACT There would be no fiscal impact to the state or local governments.
