1 AN ACT
2 RELATING TO SPEEDING TRAFFIC INFRACTIONS; AMENDING CHAPTER 6, TITLE 49, IDAHO
3 CODE, BY THE ADDITION OF A NEW SECTION 49-658, IDAHO CODE, TO SPECIFY A
4 FIXED PENALTY FOR EXCEEDING THE SPEED LIMIT IN A SCHOOL ZONE.
5 Be It Enacted by the Legislature of the State of Idaho:
6 SECTION 1. That Chapter 6, Title 49, Idaho Code, be, and the same is
7 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
8 ignated as Section 49-658, Idaho Code, and to read as follows:
9 49-658. SCHOOL SPEED ZONE PENALTY. (1) No person shall operate a vehicle
10 in excess of the posted maximum speed limit established for a school zone when
11 the school zone is designated by appropriately placed signs indicating: the
12 school zone; the reduced speed limit for the zone; and notice of an enhanced
13 penalty for exceeding the reduced speed limit.
14 (2) Violation of the provisions of this section shall be an infraction
15 punishable by a fixed penalty of forty-one dollars ($41.00) if the violation
16 is more than one (1) but less than twenty (20) miles per hour above the speed
17 limit, and punishable by a fixed penalty of one hundred fifty-one dollars
18 ($151) if the violation is more than twenty (20) miles per hour above the
19 speed limit.

STATEMENT OF PURPOSE

The purpose of this bill is to reduce incidents of speeding in school zones by
doubling the basic fine for speeding in the zone. Local authorities already
determine which schools have reduced speed zones and what the speed limit is.
This bill does not change that, only the amount of the fine, which is set by state
code. To be in effect, the school zone would require the usual signs indicating that
the area is a school zone with a lower speed limit and a new sign stating that fines
are doubled for speeding in that zone.
FISCAL NOTE
This bill brings both expense and income. For the fine to be doubled, the
school zone would have to have a sign so stating. School zones could require from
one to four signs, depending on the location of the school. There are 637 school
buildings in Idaho. Signs and installation range in price from $25, estimated by
the Ada County Highway District, to $40 by the Department of Transportation.
Assuming all local authorities decide to add an average of two signs to each
school, the total cost statewide would be from $16,000 to $25,480.
The cost of the new signs are borne by the local authority in charge of the
roads around the school. In Ada County, 250 signs, in addition to current signage,
would be needed at a cost of $25 per sign for material and labor. The total cost to
Ada County Highway District is estimated to be $ 6,250.
According to the State Transportation Department, "The department's
initial financing impact to implement this legislation on the State Highway
System would consist of placing approximately 76 signs at a cost of $3,000. The
average annual cost to maintain these signs would be approximately $500. These
materials include all material and labor costs." (This reflects a cost of $39.50 per
sign.)

The bill raises revenue through the additional penalty added to the
speeding tickets. There is no way of knowing what this income will be; however,
for comparison, the enhanced penalty for speeding in construction zones brought
in an additional $25,933 in 1999.
