  1                                        AN ACT
  2    APPROPRIATING ADDITIONAL MONEYS TO THE MILITARY DIVISION FOR FISCAL YEAR 2000;
  3        DIRECTING THE STATE CONTROLLER TO TRANSFER MONEYS TO  THE  HAZARDOUS  SUB-
  4        STANCE  EMERGENCY  RESPONSE  FUND; EXPRESSING LEGISLATIVE INTENT REGARDING
  5        THE MILO CREEK CONTAINMENT PROJECT; EXPRESSING LEGISLATIVE INTENT THAT THE
  6        MILITARY DIVISION CONTINUE TO SEEK FUNDS FROM NONSTATE SOURCES;  DIRECTING
  7        THE  STATE  CONTROLLER TO TRANSFER MONEYS TO THE NATURAL RESTORATION FUND;
  8        DIRECTING THE STATE CONTROLLER TO TRANSFER MONEYS TO THE NATURAL  RESTORA-
  9        TION  FUND;  PROVIDING FOR REAPPROPRIATION OF CERTAIN UNEXPENDED AND UNEN-
 10        CUMBERED BALANCES; DIRECTING THE REVERSION OF CERTAIN UNEXPENDED AND UNEN-
 11        CUMBERED MONEYS; DIRECTING THE STATE CONTROLLER TO TRANSFER MONEYS TO  THE
 12        PERMANENT BUILDING FUND; AND DECLARING AN EMERGENCY.
                                                                        
 13    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 14        SECTION  1.  In  addition  to the appropriation made in Section 1, Chapter
 15    254, Laws of 1999, there is hereby appropriated to the Office of the  Governor
 16    for  the Military Division the following amounts to be expended for the desig-
 17    nated programs according to the designated expense  classes  from  the  listed
 18    funds for the period July 1, 1999, through June 30, 2000:

 32        SECTION  2.  The  State  Controller  shall make a cash transfer of $22,400
 33    from the General Fund to the Hazardous Substance Emergency Response  Fund,  as
 34    appropriated to the Bureau of Hazardous Materials in Section 1 of this act.
                                                                        
 35        SECTION  3.  It  is legislative intent that the moneys appropriated to the
 36    Bureau of Disaster Services in Section 1 of this act shall only be used to pay
 37    for the costs of the Milo Creek Containment Project.
                                                                        
 38        SECTION 4.  It is legislative intent that the Military  Division  continue
 39    to  seek  funds  for the Milo Creek Containment Project from nonstate sources,
 40    and that any additional funds so obtained be used instead of  funds  appropri-

  1    ated  to  the Bureau of Disaster Services from the Natural Restoration Fund in
  2    Section 1 of this act.
                                                                        
  3        SECTION 5.  Any other provision of law notwithstanding, the State Control-
  4    ler shall transfer $1,500,000 from the State Highway Restricted Disaster  Fund
  5    to  the  Natural Restoration Fund for the purposes of the appropriation to the
  6    Bureau of Disaster Services in Section 1 of this act.
                                                                        
  7        SECTION 6.  Any other provision of law notwithstanding, the State Control-
  8    ler shall transfer the $2,000,000 appropriated to the Bureau of Disaster  Ser-
  9    vices in Section 1 of this act from the Federal Grant Fund to the Natural Res-
 10    toration Fund.
                                                                        
 11        SECTION  7.  There  is  hereby reappropriated to the Military Division the
 12    unexpended and unencumbered balance of moneys appropriated to  the  Bureau  of
 13    Disaster  Services  in  Section  1  of  this  act for the period July 1, 1999,
 14    through June 30, 2000, to be used only for nonrecurring  expenditures  related
 15    to  the  Milo  Creek  Containment Project for the period July 1, 2000, through
 16    June 30, 2001.
                                                                        
 17        SECTION 8.  Any unexpended and unencumbered moneys  appropriated  for  the
 18    Milo  Creek  Containment  Project remaining in the Natural Restoration Fund on
 19    June 30, 2001, shall be deposited in the  State  Highway  Restricted  Disaster
 20    Fund, up to a maximum of $1,500,000.
                                                                        
 21        SECTION 9.  Any other provision of law notwithstanding, the State Control-
 22    ler  shall transfer $1,500,000 from the General Fund to the Permanent Building
 23    Fund.
                                                                        
 24        SECTION 10.  An emergency existing therefor,  which  emergency  is  hereby
 25    declared to exist, this act shall be in full force and effect on and after its
 26    passage and approval.

Statement of Purpose / Fiscal Impact


                 STATEMENT OF PURPOSE

          This supplemental appropriation provides one-time funding to complete the Milo
     Creek Flood Containment Project. Milo Creek is located in the Silver Valley of Northern
     Idaho. It drains the area around the Bunker Hill mine, and then flows through the cities of
     Wardner and Kellogg, and into the Coeur d'Alene River. At the time of the Milo Creek
     flood, in May 1997, the creek flowed through very old underground channels., some of
     which were wooden flumes dating back to the early mining days. The channel also
     followed no public right-of- way, as is now customary, but instead flowed underneath
     private property and buildings. The May 1997 flood caused numerous blowouts and
     spread contaminated Bunker Hill water across the two cities. This supplemental would
     complete the process of enlarging Milo Creek's underground channel, and relocating it to
     flow underneath public streets. 
          The supplemental also appropriates money to the Bureau of Hazardous Materials
     to cover deficiency warrants issued to pay for the cost of responding to hazardous
     materials incidents throughout Idaho. 
     
                           
                     FISCAL NOTE
     
          The appropriation includes $2 million in federal funds, and $1.5 million from the
     state highway disaster fund. The original request was to fund the $1.5 million portion
     from the General Fund. It has since been learned, however, that unspent funds remain in
     the state highway disaster fund, which was established to help recover from these flood
     events. As a result, the $1.5 million portion is instead funded from this fund. The bill then
     takes the $1.5 million in General Fund money that is saved, and transfers it to the
     Permanent Building Fund. 
          There is also a $22,400 General Fund appropriation to the Bureau of Hazardous
     Materials for deficiency warrants.
