That Section 49-120, Idaho Code, be, and the same is hereby 28 amended to read as follows: 29 49-120. DEFINITIONS -- S. 30 (1) "Saddlemount combination" means a combination of vehicles in which a 31 truck or truck tractor tows one (1), two (2) or three (3) trucks or truck 32 tractors, each connected by a saddle to the frame or fifth wheel of the vehi- 33 cle in front of it. The saddle is a mechanism that connects the front axle of 34 the towed vehicle to the frame or fifth wheel of the vehicle in front and 35 functions like a fifth wheel kingpin connection. A smaller vehicle mounted 36 completely on the frame of either the first or last vehicle may be used in a 37 saddlemount combination. 38 (2) "Safety glazing materials" means glazing materials so constructed, 39 treated or combined with other materials as to reduce substantially, in com- 40 parison with ordinary sheet glass or plate glass, the likelihood of injury to 41 persons by objects from exterior sources or by these safety glazing materials 42 when they may be cracked or broken. 43 (3) "Safety zone" means the area or space officially set apart within a 2 1 highway for the exclusive use of pedestrians and which is protected or is so 2 marked or indicated by adequate signs as to be plainly visible at all times 3 while set apart as a safety zone. 4 (4) "Salvage pool" means a licensed vehicle dealer engaged primarily in 5 the business of disposing of salvage vehicles, recovered stolen vehicles, or 6 both. 7 (5) "School bus" means every motor vehicle that complies with the color 8 and identification requirements set forth in the most recent edition of 9 "Minimum Standards for School Buses" and is used to transport children to or 10 from school or in connection with school approved activities and includes 11 buses operated by contract carriers. 12 (6) "Secretary" means the secretary of transportation of the United 13 States. 14 (7) "Security agreement." (See section 28-9-105, Idaho Code) 15 (8) "Security interest." (See section 28-1-201, Idaho Code) 16 (9) "Sell," "sold," "buy," and "purchase," mean and include, as used in 17 sections 49-2401 through 49-2406, Idaho Code, exchange, barter, gift, and 18 offer or contract to sell or buy. 19 (10) "Semitrailer." (See "Trailer,",section 49-121, Idaho Code) 20 (11) "Serious traffic violation" means conviction of an offense specified 21 in 49 CFR part 383 while operating a commercial motor vehicle. 22 (12) "Sidewalk" means that portion of a street between the curb lines, or 23 the lateral lines of a roadway, and the adjacent property lines intended for 24 use by pedestrians. 25 (13) "Signal." (See "Railroad sign,",section 49-119, Idaho Code) 26 (14) "Skills test" means an actual demonstration of ability to exercise 27 ordinary and reasonable control in the operation of a motor vehicle. 28 (15) "Slow moving vehicle" means any vehicle not normally operated upon 29 the highways. 30 (16) "Snow tire." (See "Tires,",section 49-121, Idaho Code) 31 (17) "Sold." (See "Sell,","buy,",and "purchase,",this section) 32 (18) "Solid rubber tire." (See "Tires,",section 49-121, Idaho Code) 33 (19) "Special license plate" means a license plate that is made available 34 to the public as a personal alternative to the standard issue license plate. 35This definition shall not includeNo special program fee shall be charged for 36 the registration or plates issued under sections 49-403, 49-403A, 49-404, 37 49-405, 49-410, 49-415, 49-415A and 49-415B, Idaho Code. 38 (20) "Special mobile equipment" means every vehicle not designed or used 39 primarily for the transportation of persons or property and only incidentally 40 operated or moved over a highway, including: ditch-digging apparatus, well- 41 boring apparatus and road construction and maintenance machinery such as 42 asphalt spreaders, bituminous mixers, bucket loaders, tractors other than 43 truck tractors, ditchers, leveling graders, finishing machines, motor graders, 44 road rollers, scarifiers, earth moving carry-alls and scrapers, power shovels 45 and drag lines, and self-propelled cranes, and earth moving equipment. The 46 term does not include travel trailers, dump trucks, truck mounted transit 47 mixers, cranes or shovels, or other vehicles designed for the transportation 48 of persons or property to which machinery has been attached. 49 (21) "Specially constructed vehicle." (See "Vehicle,",section 49-123, 50 Idaho Code) 51 (22) "Stand" or "standing" means the halting of a vehicle, whether occu- 52 pied or not, otherwise than temporarily for the purpose of and while actually 53 engaged in receiving or discharging passengers. 54 (23) "State" means a state, territory or possession of the United States, 55 the District of Columbia, the Commonwealth of Puerto Rico or a province of 3 1 Canada. 2 (24) "Stop" means the act of or complete cessation from movement. 3 (25) "Stopping" means the act of any halting even momentarily of a vehi- 4 cle. 5 (26) "Street." (See "Highways,",section 49-109, Idaho Code) 6 (27) "Street rod" means any pre-1949 vehicle which has had a significant 7 drive train update from a more modern vehicle. Changes may include engine, 8 transmission, rear axle, and other suspension components. The body will be, 9 or resemble the same as the manufacturer's original issue after its first sale 10 after manufacture. 11 (28) "Studded tire." (See "Tires,",section 49-121, Idaho Code) 12 (29) "Substandard width lane" means a lane that is too narrow for a bicy- 13 cle and a motor vehicle to travel safely side by side within the lane. 14 (30) "Supplemental lot" means a physically separate location owned and 15 maintained by a licensed dealer or manufacturer within the same or adjacent 16 county as the principal place of business which meets all the requirements for 17 a principal place of business. 18 (31) "Suspension of driver's license" means the temporary withdrawal by 19 formal action of the department or as otherwise provided in this title of a 20 person's driver's license or privilege to operate a motor vehicle on the pub- 21 lic highways, which temporary withdrawal shall be for a period specifically 22 designated by the department. 23 (32) "Suspension of vehicle registration" means the temporary withdrawal 24 by formal action of the department or as otherwise provided in this title of a 25 person's vehicle registration or, in the case of fleets of vehicles, all vehi- 26 cle registrations in each fleet operated by a company. Upon suspension, the 27 privileges of operating the vehicle or vehicles on Idaho highways is termi- 28 nated until the difficulty that caused the suspension is corrected and notifi- 29 cation is provided that the suspension has been lifted. 30 SECTION 2. That Section 49-402C, Idaho Code, be, and the same is hereby 31 amended to read as follows: 32 49-402C. SPECIAL LICENSE PLATE PROGRAMS -- STANDARDIZED PLATE COLOR AND 33 DESIGN. (1) It is the intent of the legislature that special license plates 34 issued by the department be readily recognizable as plates from the state of 35 Idaho without losing the uniqueness for which the special plate was designed 36 and purchased. In addition, the legislature finds that the department can 37 operate in a more efficient, cost-effective manner by conforming special 38 plates to a basic color and design. 39 (2) No special license plates and no special license plate programs in 40 existence on or before June 30, 1998, shall be affected by the provisions of 41 this section. On and after July 1, 1998, any new special license plate program 42 authorized or any redesign of an existing special license plate, shall use the 43 same red, white and blue background as the standard issue of license plates 44 described in section 49-443, Idaho Code, except that: 45 (a) The identification of county shall be omitted; 46 (b) The word "Idaho" shall appear on every plate; 47 (c) The inscription "Scenic Idaho" may be omitted without legislative 48 consideration and approval; and 49 (d) No slogan shall be used that infringes upon, dilutes or compromises, 50 or could be perceived to infringe upon, dilute or compromise, the 51 trademarks of the state of Idaho, including, but not limited to, "Idaho 52 Potatoes ," "Grown in Idaho ," "Famous Idaho Potatoes " or "Famous 53 Potatoes ." 4 1 The provisions of this section shall not apply to the second plate design 2 issued pursuant to the provisions of section 49-417, Idaho Code. 3 (3) Any redesign required for a special plate to conform with legislative 4 intent and the provisions of this section may be done in a manner similar to 5 that used to produce the original design. 6 (4) The special plates shall conform in all other respects with the pro- 7 visions of section 49-443, Idaho Code, relating to visibility requirements, 8 display of registration number, time period for validity of plates, and reser- 9 vation of plate numbers. 10 (5) No special license plates shall be issued to motor vehicles with a 11 registered maximum gross weight in excess of twenty-six thousand (26,000) 12 pounds, or any motor vehicle registered under section 49-434(5), Idaho Code, 13 or section 49-435, Idaho Code. 14 (6) Following an introductory period of two (2) years during which the 15 provisions of this subsection shall not apply, if, for two (2) consecutive 16 years, fewer than one thousand (1,000) plates are issued per year for a spe- 17 cial license plate program, the department shall so advise the legislature and 18 assist the legislature in adopting appropriate action to discontinue that spe- 19 cial license plate program. The provisions of this subsection shall apply only 20 to special license plate programs created on and after July 1, 1998. 21 SECTION 3. That Section 49-403, Idaho Code, be, and the same is hereby 22 amended to read as follows: 23 49-403. DISABLED VETERAN -- LICENSE PLATES. No fee shall be charged for 24 the registration or reregistration of a motor vehicle owned by a veteran who 25 has established his rights to benefits under the provisions of Public Law 662, 26 79th Congress, as amended, and Public Law 187, 82nd Congress, as amended. The 27 provisions of this section shall not apply to any vehicle with a registered 28 maximum gross weight over twenty-six thousand (26,000) pounds, nor to any 29 vehicle registered under section 49-434(5), Idaho Code. No fee shall be 30 charged for the registration or reregistration of a motor vehicle owned by a 31 veteran, who is at the time of the registration or reregistration receiving 32 compensation from the veterans administration or in lieu thereof, from any of 33 the armed forces of the United States, for one hundred percent (100%) service- 34 connected disability or for any of the following specific disabilities: Loss 35 or permanent loss of use of one (1) or both feet; loss or permanent loss of 36 use of one (1) or both hands; loss of sight in both eyes or permanent impair- 37 ment of vision in both eyes to the degree as to constitute virtual blindness. 38 These provisions shall be considered applicable not only as to the vehicle 39 originally purchased under this authorization, but also as to any vehicle sub- 40 sequently purchased and owned by the same veteran, so long as the privilege 41 shall not extend to more than one (1) vehicle at a time. Special license 42 plates shall be issued for such a vehicle, identified by the inscription 43 "D.V.", and a separate number series shall be used to further identify the 44 license plates so issued. These license plates shall not be issued by the 45 counties but shall be issued by the department. The plates shall be displayed 46 in accordance with the procedure applicable to license plates set forth in 47 section 49-428, Idaho Code. A vehicle displaying plates issued in accordance 48 with the provisions of this section shall be afforded the same privileges 49 specified in section 49-410(7), Idaho Code. 50 SECTION 4. That Section 49-403A, Idaho Code, be, and the same is hereby 51 amended to read as follows: 5 1 49-403A. PURPLE HEART RECIPIENT -- LICENSE PLATES. (1) Purple heart 2 recipient license plates are available to any applicant who is a veteran or an 3 active or retired member of any of the armed forces of the United States, 4 reserve forces or Idaho national guard, and who furnishes proof of entitlement 5 by providing one (1) of the following documents: 6 (a) A copy of form DD214 or equivalent document showing an award of the 7 purple heart medal; 8 (b) A copy of the certificate presented with the medal; or 9 (c) A copy of the military order describing the award of the medal to the 10 applicant. 11 (2) In addition to the regular registration fee, the applicant shall be 12 charged the plate fee required in section 49-450, Idaho Code. Whenever title 13 or interest in a vehicle registered under the provisions of this section is 14 transferred or assigned, the registration shall expire, but the purple heart 15 recipient may transfer his plates to another vehicle upon payment of the 16 required transfer fees. He may only display the plates after receipt of new 17 registration from the department. A purple heart recipient shall not register 18 more than two (2) vehicles under the provisions of this section. The provi- 19 sions of this section shall not apply to any vehicle with a registered maximum 20 gross weight over twenty-six thousand (26,000) pounds, nor to any vehicle reg- 21 istered under section 49-434(5), Idaho Code. 22 (3) Purple heart recipient license plates may be retained and displayed 23 on vehicles owned by the surviving spouse of a deceased purple heart recipi- 24 ent. 25 (4) The purple heart recipient license plates shall be of a color and 26 design acceptable to the military order of the purple heart association and 27 approved by the department, utilizing a numbering system as determined by the 28 department. 29 SECTION 5. That Section 49-404, Idaho Code, be, and the same is hereby 30 amended to read as follows: 31 49-404. NATIONAL GUARD MEMBERS -- DISTINCTIVE PLATES. (1) In order to 32 enhance visibility and identification of national guard members during 33 mobilizations and emergencies, any active member of the Idaho national guard 34 residing in the state of Idaho may, upon application to the department, regis- 35 ter not more than two (2) motor vehicles and receive for each vehicle distinc- 36 tive national guard license plates in lieu of regular license plates. The pro- 37 visions of this section shall not apply to any vehicle with a registered maxi- 38 mum gross weight oversixteentwenty-six thousand (126,000) pounds. The 39 national guard license plates shall be designed, subject to the approval of 40 the department, by the adjutant general. Proof of being an active member in 41 the Idaho national guard must be furnished to the department before plates 42 will be issued. 43 The Idaho national guard shall, prior to an individual's discharge from 44 active duty in the national guard, require that the national guard license 45 plates either be turned in to the department or exchanged for other proper 46 license plates as a condition of discharge. 47 (2) Whenever a member of the Idaho national guard transfers or assigns 48 his title or interest to a vehicle especially registered under the provisions 49 of this section, the registration shall expire but the member may hold his 50 national guard license plates which he may have reissued to him upon the pay- 51 ment of the required transfer fees. He may only display the plates after 52 receipt of new registration from the department. 53 (3) In addition to the regular registration fees required in section 6 1 49-402(1) or 49-434(1), Idaho Code, the national guard member shall pay the 2 plate fee specified in section 49-450, Idaho Code. 3 SECTION 6. That Section 49-404A, Idaho Code, be, and the same is hereby 4 amended to read as follows: 5 49-404A. MEMBERS OF THE ARMED FORCES RESERVE -- SPECIAL PLATES. (1) Any 6 active member of the armed forces reserves of the United States who is the 7 owner of a vehicle registered under section 49-402(1) or section 49-434(1), 8 Idaho Code, may, upon application to the department, register not more than 9 two (2) motor vehicles and receive for each vehicle special license plates in 10 lieu of regular numbered plates. The provisions of this section shall not 11 apply to any vehicle with a registered maximum gross weight oversixteen12 twenty-six thousand (126,000) pounds. The special license plates shall be des- 13 ignated by the department with the word "RESERVIST" centered along the bottom 14 edge and be numbered in sets of two (2) with a different number following 15 appropriate letters as follows: United States Army Reserve: Army (number); 16 United States Navy Reserve: Navy (number); United States Marine Corps Reserve: 17 USMC (number); United States Air Force Reserve: USAF (number); and United 18 States Coast Guard Reserve: USCG (number). Proof of being an active member in 19 the United States armed forces reserves must be furnished to the department 20 before special plates will be issued. Special license plates issued under this 21 section shall be issued under the staggered registration process provided for 22 in section 49-402(1), Idaho Code, or the annual registration in section 23 49-434(1), Idaho Code. 24 (2) Any branch of the armed forces reserves of the United States shall, 25 prior to an individual's discharge from duty in that branch of the armed 26 forces reserve, require that the special armed forces reserve license plates 27 either be turned back to the department or exchanged for other proper license 28 plates as a condition of discharge. 29 (3) In addition to the regular registration fees required in section 30 49-402(1) or 49-434(1), Idaho Code, the applicant shall pay the initial pro- 31 gram fee and the annual program fee specified in section 49-402, Idaho Code. 32 The initial program fee and the annual program fee shall be deposited in the 33 state highway account and shall be used to fund the cost of administration of 34 this special license plate program which is provided to the public as a per- 35 sonal alternative to the standard license plate requirement. When a plate 36 holder transfers or assigns his title or interest in the vehicle registered 37 under this section, the registration shall expire, but the special plates may 38 be transferred to another vehicle upon payment of the required transfer fee. 39 Special plates shall only be displayed after receipt of the new registration. 40 (4) The design and numbering scheme of the military reservist special 41 plate shall be coordinated by the department with representatives of the armed 42 forces reserves. However, the department shall have the final approval of the 43 plate design and numbering scheme to ensure conformity within existing issues 44 of plates and to contain costs within the limit of the fees received from 45 applicants. 46 SECTION 7. That Section 49-405, Idaho Code, be, and the same is hereby 47 amended to read as follows: 48 49-405. RADIO AMATEURS -- SPECIAL LICENSE PLATES. (1) In order to enhance 49 visibility and identification of radio amateurs during times of emergency any 50 radio amateur residing in the state of Idaho, may, upon application to the 51 department, register one (1) motor vehicle per radio license issued by the 7 1 federal government and receive for that vehicle special license plates in lieu 2 of regular license plates. The provisions of this section shall not apply to 3 any vehicle with a registered maximum gross weight oversixteentwenty-six 4 thousand (126,000) pounds. The number on the plates shall be the same combina- 5 tion of figures and letters that make up the radio call sign of the amateur 6 radio operator. 7 (2) Proof of holding an amateur license from the federal communications 8 commission must be furnished to the department before the plates will be 9 issued. Should the amateur's radio license expire during any given year and 10 not be renewed, the special license plates must be surrendered to the depart- 11 ment and regular license plates obtained. 12 (3) Radio amateurs will notify the department at a time to be set by the 13 department of their intention to procure special license plates under the 14 terms specified in this section. Failure to do so will result in the amateur 15 being required to accept regular license plates should the department be 16 unable to procure the special plates. Special plates may still be procured 17 when available but amateurs will be subject to the usual transfer fee. 18 (4) Whenever an amateur transfers or assigns his title or interest to a 19 vehicle especially registered the registration shall expire, but the amateur 20 may hold his special license plates which he may have reissued to him upon the 21 payment of the required transfer fees. He may only display the plates after 22 receipt of new registration from the department. 23 (5) In addition to the regular registration fees required in section 24 49-402(1) or 49-434(1), Idaho Code, the applicant shall pay the plate fee 25 specified in section 49-450, Idaho Code. 26 SECTION 8. That Section 49-407, Idaho Code, be, and the same is hereby 27 amended to read as follows: 28 49-407. YEAR OF MANUFACTURE PLATE. Pursuant to rules of the department, 29 any person who is the owner of a motor vehicle thirty (30) years or older 30 which is registered under section 49-402(1), Idaho Code, or section 49-434(1), 31 Idaho Code, may display on the rear of the vehicle an authentic Idaho plate 32 manufactured in the same year as the vehicle. The provisions of this section 33 shall not apply to any vehicle with a registered maximum gross weight over 34sixteentwenty-six thousand (126,000) pounds. 35 In addition to the regular registration fees required in sections 36 49-402(1), and 49-434(1), Idaho Code, the applicant shall pay the initial pro- 37 gram fee and the annual program fee specified in section 49-402, Idaho Code. 38 SECTION 9. That Section 49-408, Idaho Code, be, and the same is hereby 39 amended to read as follows: 40 49-408. STREET ROD. (1) Any motor vehicle manufactured prior to the year 41 1949, or designed and manufactured to resemble such a vehicle and which has 42 been certified as a street rod may be registered as a street rod under the 43 provisions of this section. However, the provisions of this section shall not 44 apply to any vehicle with a registered maximum gross weight oversixteen45 twenty-six thousand (126,000) pounds. 46 (2) Any street rod shall have all equipment in operating condition which 47 was specifically required by law as a condition for its first sale after manu- 48 facture. No law requiring any particular equipment or specifying any standards 49 to be met by motor vehicles shall apply to street rods unless it so specifi- 50 cally states. 51 (3) Upon receipt of an application on a form prescribed by the department 8 1 for a special street rod automobile plate, accompanied by other documentation 2 required in this section, the department shall issue to the applicant a spe- 3 cial street rod automobile plate which shall be displayed on the rear of the 4 vehicle. The registration certificate need not specify the weight of the 5 street rod, and the plate issued shall bear no date but shall bear the 6 inscription "Street Rod," "Idaho," a picture of a 1929 highway roadster, and 7 the registration number issued for the street rod, and the plate shall be 8 valid upon annual renewal under section 49-402 or 49-434(1), Idaho Code, as 9 long as the vehicle is in existence. The plate will be issued for the 10 applicant's use only for the particular vehicle, and in the event of a trans- 11 fer of title, the transferor may hold the plate and transfer it to another 12 qualifying street rod. 13 (4) In addition to the regular registration fees required in section 14 49-402(1) or 49-434(1), Idaho Code, the applicant shall pay the initial pro- 15 gram fee and the annual program fee specified in section 49-402, Idaho Code. 16 (5) The department has the power to revoke any registration issued under 17 this section for cause shown for failure of the applicant to comply with the 18 provisions of this section. 19 SECTION 10. That Section 49-409, Idaho Code, be, and the same is hereby 20 amended to read as follows: 21 49-409. PERSONALIZED LICENSE PLATES. (1) Any person who is the owner of a 22 vehicle registered under section 49-402 or 49-434(1), Idaho Code, may apply to 23 the department for personalized license plates in lieu of regular numbered 24 plates except that this provision shall not apply to a vehicle registered 25 under section 49-434(1), Idaho Code, with a maximum gross weight oversixteen26 twenty-six thousand (126,000) pounds or any vehicle registered under section 27 49-435, Idaho Code. In addition to the regular registration fees required in 28 section 49-402(1) and (2), section 49-422, and section 49-434(1), Idaho Code, 29 the applicant shall pay the initial program fee and the annual program fee 30 specified in section 49-402, Idaho Code. The personalized license plates shall 31 be of the same color and design as other license plates, and shall consist of 32 numbers or letters, or any combination thereof, not exceeding seven (7) posi- 33 tions. No more than one (1) particular combination of letters and numbers 34 shall be in existence at any one (1) time. The form for application of the 35 plates will be as prescribed by the director who, at his discretion, may 36 refuse to issue the plates. 37 (2) When personalized license plates are issued for a vehicle, the regu- 38 lar license plates for that vehicle belong to the registrant and may be trans- 39 ferred to another vehicle owned by the personalized plate applicant. 40 SECTION 11. That Section 49-410, Idaho Code, be, and the same is hereby 41 amended to read as follows: 42 49-410. SPECIAL LICENSE PLATES AND CARDS FOR PERSONS WITH A DISABILITY -- 43 PARKING PRIVILEGES -- CARDS FOR CERTAIN TEMPORARILY DISABLED PERSONS. (1) Any 44 person with a disability as defined in section 49-117, Idaho Code, or any par- 45 ent or guardian of a dependent child with a disability as defined in section 46 49-117, Idaho Code, without regard to the age of the dependent child, shall be 47 eligible for the use of special license plates bearing the international 48 accessible symbol, for any vehicle owned by such person or owned by a quali- 49 fied parent or guardian, but excluding any commercial vehicle with a regis- 50 tered maximum gross weight oversixteentwenty-six thousand (126,000) pounds. 51 (2) Registration and license plate fees for vehicles owned by a person 9 1 with a disability or qualified parent or guardian of a dependent child with a 2 disability, shall be as provided, respectively, in sections 49-402, 49-434(1) 3 and 49-450, Idaho Code. Nothing in this section shall be construed as abrogat- 4 ing provisions of section 49-445, Idaho Code. The use of the special card 5 issued under the provisions of subsection (4) of this section, shall not 6 exempt the owner of a motor vehicle from otherwise properly registering and 7 licensing the motor vehicle. 8 (3) Special license plates for persons with a disability and for the par- 9 ent or guardian of a dependent child with a disability, shall be the same size 10 and color as other license plates, and shall have displayed upon them the reg- 11 istration numbers assigned to the vehicle and to the owner. The plates shall 12 be numbered in a manner prescribed by the department, but the plates shall 13 display the international accessible symbol. 14 International Accessible Symbol 15 (4) The department shall issue a special card bearing the international 16 accessible symbol and other information the department may require, to: 17 (a) Any qualified person with a disability who does not own a motor vehi- 18 cle; 19 (b) Any qualified person with a disability who owns a motor vehicle, 20 without regard to weight or use of the vehicle; 21 (c) Any parent or guardian of a dependent child with a disability who 22 owns a motor vehicle without regard to weight or use of the vehicle; 23 (d) Any business entity which is engaged in transportation of persons 24 with a disability, which business shall not be required to submit a 25 physician's certification. In addition to other application requirements, 26 a business applicant shall sign a declaration that he is engaged in the 27 transportation of persons with a disability. A business entity may include 28 but not be limited to hospitals, nursing homes, federal, state and local 29 governmental agencies and taxicabs. 30 (5) Any person or business issued a special card shall affix the special 31 card to a motor vehicle in a conspicuous place designated by the department. 32 The card shall bear distinguishing marks, letters or numerals indicating the 33 vehicle is utilized by a permanently disabled person. When the card is affixed 34 to a motor vehicle and the motor vehicle is transporting a person with a dis- 35 ability, special parking privileges are granted as provided in subsection (7) 36 of this section. 37 (6) Application for special license plates, a special card, or both as 38 applicable and at the option of the applicant, shall be made upon a form fur- 39 nished by the department and shall include a written certification by a 40 licensed physician verifying that the applicant's stated impairment qualifies 41 as a disability according to the provisions of section 49-117, Idaho Code. 42 (7) Any motor vehicle displaying special license plates for a person with 43 a disability, without regard to the state of residence or displaying the spe- 44 cial card provided in subsections (4) and (8) of this section, shall be 45 allowed to park for unlimited periods of time in parking zones or areas which 46 are otherwise restricted as to the length of time parking is permitted, and to 47 park in any public parking space with metered parking without being required 48 to pay any parking meter fee. The provisions of this subsection shall not be 49 applicable to those zones or areas in which the stopping, parking, or standing 50 of all vehicles is prohibited or which are reserved for special types of vehi- 51 cles. 10 1 (8) Any person who shall submit satisfactory proof to the department that 2 he is so temporarily disabled as to be unable to move without the aid of 3 crutches or a wheelchair, shall be entitled to receive for one (1) motor 4 vehicle only, a special card to be affixed to a motor vehicle in a conspicuous 5 place designated by the department, bearing distinguishing marks, letters or 6 numerals indicating that the vehicle is utilized by a temporarily disabled 7 person. This special temporary card shall expire six (6) months from the date 8 of issuance, or sooner as specified by the department on the card. 9 (9) Any unauthorized use of the plate or card shall constitute an infrac- 10 tion punishable by a fine of fifty dollars ($50.00). The second offense shall 11 be punishable by a fine of fifty dollars ($50.00) and loss of parking privi- 12 leges for the registered owner of the vehicle displaying the plates or for the 13 person to whom the card was issued, for a period of one (1) year. 14 Law enforcement officials shall enforce the provisions of this section and 15 are empowered, using reasonable discretion, to check personal identification 16 to determine if the user of the plate or placard is authorized to use accessi- 17 ble parking privileges. Any fines collected shall be retained by the city or 18 county whose law enforcement official issued the citation. 19 SECTION 12. That Section 49-414, Idaho Code, be, and the same is hereby 20 amended to read as follows: 21 49-414. LEGISLATIVE LICENSE PLATES -- FEES. (1) Special legislative 22 license plates shall be issued by the department upon application and payment 23 of the required fees. Each legislator is eligible to register and receive spe- 24 cial license plates for one (1) vehicle whose registered maximum gross weight 25 does not exceedsixteentwenty-six thousand (126,000) pounds. The registration 26 period shall be for one (1) year, from January 1 through December 31, and may 27 be renewed, as long as the legislator holds office. The plates shall bear 28 either the inscription "House" or "Senate," shall contain a consecutive num- 29 bering from one (1) through the maximum number of members in each body with 30 the numbers to be assigned by the speaker of the house of representatives and 31 the president pro tempore of the senate, and shall otherwise comply with the 32 provisions of section 49-443, Idaho Code. 33 (2) In addition to the regular registration fees required in section 34 49-402(1) or 49-434(1), Idaho Code, the applicant shall pay the initial pro- 35 gram fee and the annual program fee as specified in section 49-402, Idaho 36 Code. 37 SECTION 13. That Section 49-415, Idaho Code, be, and the same is hereby 38 amended to read as follows: 39 49-415. FORMER PRISONER OF WAR LICENSE PLATES. (1) Any veteran, who was a 40 prisoner of war (POW) of an armed enemy of the United States during active 41 service in the armed forces of the United States, that service occurring dur- 42 ing any portion of a recognized war period enumerated in this section, and who 43 has been released or discharged from the armed forces under other than dishon- 44 orable conditions, may upon application to the department, register and 45 receive for not more than two (2) motor vehicles, special former prisoner of 46 war license plates in lieu of regular license plates. The provisions of this 47 section shall not apply to any vehicle with a registered maximum gross weight 48 oversixteentwenty-six thousand (126,000) pounds. 49 (2) In addition to the regular registration fees required in section 50 49-402(1) or 49-434(1), Idaho Code, the applicant shall pay the plate fee 51 required in section 49-450, Idaho Code. Whenever a former prisoner of war 11 1 transfers or assigns his title or interest to a vehicle registered under this 2 section the registration shall expire, but the former prisoner of war may hold 3 the special plates and may have them transferred to another vehicle upon pay- 4 ment of the required transfer fee provided in section 49-431, Idaho Code. He 5 may only display the plates after receipt of the new registration document 6 from the department. 7 (3) Former prisoner of war license plates shall bear the words "Former 8 Prisoner of War" and a declaration of the period of service, and shall in all 9 other respects be as provided by law. 10 (4) Recognized war periods for the purpose of this section shall be any 11 period of war recognized by the United States department of veterans affairs 12 for the purpose of awarding federal veterans benefits as may be defined in 13 title 38, U.S. code, chapter 1, section 101(11). 14 SECTION 14. That Section 49-415A, Idaho Code, be, and the same is hereby 15 amended to read as follows: 16 49-415A. CONGRESSIONAL MEDAL OF HONOR LICENSE PLATES. (1) Congressional 17 medal of honor license plates are available to applicants who furnish proof of 18 entitlement by certification from the United States Veterans Administration 19 attesting to their status as a congressional medal of honor recipient. 20 (2) The license plates shall be provided free of charge. The applicant 21 shall pay the regular annual registration fees required by section 49-402 or 22 49-434(1), Idaho Code. The provisions of this section shall not apply to any 23 vehicle with a registered maximum gross weight oversixteentwenty-six thou- 24 sand (126,000) pounds. If the plate holder transfers his title or interest to 25 a vehicle registered under this section, the plates may be transferred to 26 another vehicle owned by the plate holder. If the plates are unexpired, the 27 plate holder shall be given credit for the unexpired portion of the registra- 28 tion fee against the new registration fee. The transfer fee specified by sec- 29 tion 49-431(1), Idaho Code, shall apply. 30 (3) These provisions shall apply to the vehicle to which the plates were 31 originally issued and to any vehicle subsequently purchased and owned by the 32 medal of honor recipient, except that the privilege shall not extend to more 33 than two (2) vehicles at a time. 34 SECTION 15. That Section 49-415B, Idaho Code, be, and the same is hereby 35 amended to read as follows: 36 49-415B. PEARL HARBOR SURVIVOR SPECIAL PLATES. (1) Any veteran who was on 37 active duty in the armed forces of the United States and assigned or stationed 38 at Pearl Harbor, Hawaii, or within three (3) miles of the island of Oahu on 39 December 7, 1941, and who has been released or discharged from the armed 40 forces under other than dishonorable conditions, may upon application to the 41 department, register and receive for not more than two (2) motor vehicles, 42 special Pearl Harbor survivor number plates in lieu of regular number plates. 43 The provisions of this section shall not apply to any vehicle with a regis- 44 tered maximum gross weight oversixteentwenty-six thousand (126,000) pounds. 45 (2) In addition to the regular registration fees required in section 46 49-402(1) or 49-434(1), Idaho Code, the applicant shall be charged the plate 47 fee required in section 49-450, Idaho Code. Whenever a qualifying survivor of 48 the Japanese attack on Pearl Harbor on December 7, 1941, transfers or assigns 49 his title or interest to a vehicle especially registered under this section, 50 the registration shall expire, but the Pearl Harbor survivor may hold his spe- 51 cial plates which he may have reissued to him upon the payment of the 12 1 required transfer fees. He may only display those plates after receipt of a 2 new registration from the department. 3 (3) Pearl Harbor survivor plates shall bear the characters: "Pearl Harbor 4 Survivor" and shall in all other respects be as provided by law. 5 SECTION 16. That Section 49-416, Idaho Code, be, and the same is hereby 6 amended to read as follows: 7 49-416. STATEHOOD CENTENNIAL LICENSE PLATES. (1) Statehood centennial 8 license plates are available to owners of motor vehicles required to be regis- 9 tered under section 49-402(1) or section 49-434(1), Idaho Code, upon applica- 10 tion at a county assessor's office or at the department. The provisions of 11 this section shall not apply to any vehicle with a registered maximum gross 12 weight oversixteentwenty-six thousand (126,000) pounds. Availability of 13 statehood centennial plates for other classes of vehicle registrations shall 14 be as authorized by rule of the department. In addition to the regular regis- 15 tration fees required in section 49-402(1) or 49-434(1), Idaho Code, the 16 applicant shall pay the initial program fee and the annual program fee as 17 specified in section 49-402, Idaho Code. All revenues from such initial regis- 18 tration and annual renewal fees shall be deposited in the highway distribution 19 account. 20 (2) The statehood centennial license plates shall be of a color and 21 design approved by the department, utilizing a numbering system approved by 22 the board. The statehood centennial license plates must be surrendered upon 23 failure to pay the annual special fee and renewal fees. 24 (3) Any person who applies for statehood centennial license plates, may 25 also apply for personalized numbers and/or letters on those plates, as pro- 26 vided for in section 49-409, Idaho Code. 27 SECTION 17. That Section 49-417, Idaho Code, be, and the same is hereby 28 amended to read as follows: 29 49-417. IDAHO WILDLIFE SPECIAL PLATES. (1) Any person who is the owner of 30 a vehicle registered under the provisions of section 49-402 or 49-434(1), 31 Idaho Code, may apply for any one (1) of two (2) Idaho wildlife special 32 license plates. The provisions of this section shall not apply to any vehicle 33 with a registered maximum gross weight oversixteentwenty-six thousand 34 (126,000) pounds. 35 (2) In addition to the regular operating fee, the applicant shall be 36 charged a fee of thirty-five dollars ($35.00) for the initial issuance of the 37 plates, and twenty-five dollars ($25.00) upon each succeeding annual registra- 38 tion. Ten dollars ($10.00) of the initial fee and ten dollars ($10.00) of the 39 renewal fee shall be deposited in the state highway account and shall be used 40 to fund the cost of administration of this special license plate program. 41 Twenty-five dollars ($25.00) of each initial fee and fifteen dollars ($15.00) 42 of each renewal fee shall be deposited by the state treasurer in the fish and 43 game set-aside account pursuant to section 36-111, Idaho Code, for use in the 44 nongame wildlife program. This fee shall be treated as a contribution to the 45 nongame wildlife program, and shall not be considered a motor vehicle regis- 46 tration fee as described in section 17, article VII, of the constitution of 47 the state of Idaho. 48 Whenever title or interest in a vehicle registered under the provisions of 49 this section is transferred or assigned, the owner may transfer the special 50 plates to another vehicle upon payment of the required transfer fees. He may 51 only display the plates after receipt of new registration from the department. 13 1 (3) Each Idaho wildlife license plate shall be of a color and design 2 acceptable to the board of directors of the Idaho fish and wildlife foundation 3 and approved by the department, utilizing a numbering system as determined by 4 the department. The Idaho fish and wildlife foundation is authorized to design 5 more than one (1) wildlife plate, but the department may not allow more than 6 two (2) different designs to be in use at any one (1) time. Initial costs of 7 the plate program including costs of plate design shall be paid by the Idaho 8 fish and wildlife foundation. 9 (4) Sample Idaho wildlife plates may be purchased for a fee of thirty 10 dollars ($30.00), ten dollars ($10.00) of which shall be deposited in the 11 state highway account to be used to fund the cost of administration of this 12 special license plate program. Twenty dollars ($20.00) of the purchase fee 13 shall be deposited in the fish and game set-aside account pursuant to section 14 36-111, Idaho Code, for use in the nongame wildlife program. 15 SECTION 18. That Section 49-417A, Idaho Code, be, and the same is hereby 16 amended to read as follows: 17 49-417A. IDAHO TIMBER SPECIAL PLATES. (1) Any person who is the owner of 18 a vehicle registered under the provisions of section 49-402 or 49-434(1), 19 Idaho Code, may apply for Idaho timber special license plates. The provisions 20 of this section shall not apply to any vehicle with a registered maximum gross 21 weight oversixteentwenty-six thousand (126,000) pounds. 22 (2) In addition to the regular operating fee, the applicant shall be 23 charged a fee of thirty-five dollars ($35.00) for the initial issuance of the 24 plates, and twenty-five dollars ($25.00) upon each succeeding annual registra- 25 tion. Ten dollars ($10.00) of the initial fee and ten dollars ($10.00) of the 26 renewal fee shall be deposited in the state highway account and shall be used 27 to fund the cost of administration of this special license plate program. 28 Twenty-five dollars ($25.00) of each initial fee and fifteen dollars ($15.00) 29 of each renewal fee shall be deposited by the state treasurer in the depart- 30 ment of lands fund for use in reforestation activities on state lands, pro- 31 vided however, that prior to the beginning of any fiscal year, the state board 32 of land commissioners may agree that funds made available under this section 33 to the department of lands for the coming year would better further reforesta- 34 tion objectives of the management and conservation of forest resources on pub- 35 lic and private lands in the state if expended for educational efforts set 36 forth in this section. 37 Whenever title or interest in a vehicle registered under the provisions of 38 this section is transferred or assigned, the owner may transfer the special 39 plates to another vehicle upon payment of the required transfer fees. He may 40 only display the plates after receipt of new registration from the department. 41 (3) The Idaho timber license plate shall be of a color and design accept- 42 able to the members of the Idaho forest products commission and approved by 43 the department, utilizing a numbering system as determined by the department. 44 Initial costs of the plate program, including costs of plate design, shall be 45 paid by the director of the department of lands from funds appropriated to 46 that department. 47 (4) Sample Idaho timber plates may be purchased for a fee of thirty dol- 48 lars ($30.00), ten dollars ($10.00) of which shall be deposited in the state 49 highway account and twenty dollars ($20.00) of which shall be deposited in 50 the department of lands fund for use in reforestation activities or educa- 51 tional efforts as set forth in this section. 52 (5) Twenty-five dollars ($25.00) of each initial fee and fifteen dollars 53 ($15.00) of each renewal fee of each timber special license plate, and twenty 14 1 dollars ($20.00) for each sample timber special license plate, shall be depos- 2 ited with the state treasurer and credited to the department of lands. Funds 3 so deposited and subsequently directed by the state board of land commission- 4 ers for educational efforts as set forth in this section shall be expended as 5 agreed by the state board of land commissioners upon recommendations devel- 6 oped jointly by the department of lands and the Idaho forest products commis- 7 sion. Such efforts may include signs or other appropriate means designed to 8 help build public understanding of reforestation or the management and conser- 9 vation of forest resources on public and private lands in Idaho. 10 SECTION 19. That Section 49-417B, Idaho Code, be, and the same is hereby 11 amended to read as follows: 12 49-417B. IDAHO AGRICULTURE PLATES. (1) On and after January 1, 2000, any 13 person who is the owner of a vehicle registered under the provisions of sec- 14 tion 49-402 or 49-434(1), Idaho Code, may apply for Idaho agriculture plates. 15 The provisions of this section shall not apply to any vehicle with a regis- 16 tered maximum gross weight oversixteentwenty-six thousand (126,000) pounds. 17 Availability of Idaho agriculture plates for other vehicles may be authorized 18 by rule of the board. 19 (2) In addition to the regular operating fee, the applicant shall be 20 charged a fee of thirty-five dollars ($35.00) for the initial issuance of the 21 plates, and twenty-five dollars ($25.00) upon each succeeding annual registra- 22 tion. Twenty-five dollars ($25.00) of the initial fee and fifteen dollars 23 ($15.00) of the renewal fee shall be deposited in the state highway account 24 and shall be used to fund the cost of the administration of this special 25 license plate program. Ten dollars ($10.00) of each initial fee and ten dol- 26 lars ($10.00) of each renewal fee shall be transferred by the state treasurer 27 to the ag in the classroom account created by the provisions of section 28 57-815, Idaho Code. 29 (3) Whenever title or interest in a vehicle registered under the provi- 30 sions of this section is transferred or assigned, the owner may transfer the 31 special plates to another vehicle upon payment of the required transfer fees. 32 The owner may only display the plates after receipt of new registration from 33 the department. 34 (4) The Idaho agriculture license plate shall be of a color and design in 35 accordance with the provisions of section 49-402C, Idaho Code. That portion of 36 the design which features Idaho agriculture shall be acceptable to the Food 37 Producers of Idaho, Inc. and shall be approved by the department utilizing a 38 numbering system as determined by the department. Initial costs of the plate 39 program, including the cost of plate design, shall be paid from the ag in the 40 classroom account. 41 (5) Sample Idaho agriculture plates may be purchased from the department 42 for a fee of thirty dollars ($30.00), twelve dollars ($12.00) of which shall 43 be deposited in the state highway account and eighteen dollars ($18.00) of 44 which shall be transferred to the ag in the classroom account. 45 SECTION 20. That Section 49-418, Idaho Code, be, and the same is hereby 46 amended to read as follows: 47 49-418. VETERANS PLATES. (1) Any person who is the owner of a vehicle 48 registered under the provisions of section 49-402 or 49-434(1), Idaho Code, 49 may apply for and upon department approval receive special veterans license 50 plates in lieu of regular license plates. The provisions of this section shall 51 not apply to any vehicle with a registered maximum gross weight oversixteen15 1 twenty-six thousand (126,000) pounds. Availability of veterans plates for 2 other vehicles shall be subject to the rules, policies and procedures of the 3 department. 4 (2) Proof of being a current or former member of the United States armed 5 forces must be furnished to the department before special veterans plates will 6 be issued. Acceptable proof shall be a copy of form DD214 or an equivalent 7 document or statement from the department of veterans affairs. 8 (3) In addition to the regular registration fees required in section 9 49-402(1) or 49-434(1), Idaho Code, the applicant shall pay the initial pro- 10 gram fee and the annual program fee specified in section 49-402, Idaho Code, 11 and the plate fee specified in section 49-450, Idaho Code. 12 (4) Whenever title or interest in a vehicle registered under the provi- 13 sions of this section is transferred or assigned, the owner may transfer the 14 special plates to another vehicle upon payment of the required transfer fees. 15 The owner may only display the plates on another vehicle upon receipt of the 16 new registration from the department. 17 (5) The veterans license plate design shall include the colors red, white 18 and blue, shall designate one (1) of the five (5) branches of military ser- 19 vice, and display either: 20 (a) The word "VETERAN" or 21 (b) The name of a conflict or war period recognized by the United States 22 department of veterans affairs for the purpose of awarding federal vet- 23 erans benefits as defined in 38 U.S.C. 101(11). 24 The license plate design shall comply with all applicable rules of the depart- 25 ment, and shall include a separate and distinct numbering system. The design, 26 color, and numbering system shall be subject to approval of the department. 27 SECTION 21. That Section 49-418A, Idaho Code, be, and the same is hereby 28 amended to read as follows: 29 49-418A. IDAHO PUBLIC COLLEGE AND UNIVERSITY PLATES. (1) Any person who 30 is the owner of a vehicle registered under the provisions of section 49-402 or 31 49-434(1), Idaho Code, may apply for special plates featuring one (1) of 32 Idaho's public colleges or universities. The provisions of this section shall 33 not apply to any vehicle with a registered maximum gross weight oversixteen34 twenty-six thousand (126,000) pounds. Availability of Idaho public college and 35 university special license plates for other vehicles may be authorized by rule 36 of the board. 37 (2) In addition to the regular operating fee, the applicant shall be 38 charged a fee of thirty-five dollars ($35.00) for the initial issuance of the 39 plates, and twenty-five dollars ($25.00) upon each succeeding annual registra- 40 tion. Ten dollars ($10.00) of the initial fee and ten dollars ($10.00) of the 41 renewal fee shall be deposited in the state highway account to be used by the 42 department to fund highway, road and bridge construction projects and to fund 43 the cost of administration of this special license plate program. The depart- 44 ment shall transfer twenty-five dollars ($25.00) of the initial fee and fif- 45 teen dollars ($15.00) of the renewal fee for deposit to the institution des- 46 ignated on the license plate. 47 (3) Whenever title or interest in a vehicle registered under the provi- 48 sions of this section is transferred or assigned, the owner may transfer the 49 special plates to another vehicle upon payment of the required transfer fees. 50 The owner may only display the plates after receipt of new registration from 51 the department. 52 (4) All special college and university plates shall be of a color and 53 design comparable to the standard issue of license plates with blue numerals 16 1 on a red, white and blue background and shall indicate the participating 2 institution. 3 (a) The standard red, white and blue graphic shall be used, except that 4 the word "Idaho" and "Famous Potatoes" shall appear on every plate, the 5 identification of county shall be omitted, and the inscription "Scenic 6 Idaho" may be omitted. 7 (b) Each public college or university that chooses to participate in this 8 program shall provide that portion of the design which features the par- 9 ticular institution and such design shall be acceptable to the president 10 of the institution and the state board of education and board of regents 11 of the university of Idaho. 12 Each version of the special public college and university plate featuring 13 the participating public college or university shall be approved by the 14 department, utilizing a numbering system as determined by the department. Ini- 15 tial costs of the plate program, including the cost of plate design, shall be 16 paid by the participating public college or university. 17 (5) The state board of education and board of regents of the university 18 of Idaho shall adopt rules to account for receipt and distribution of revenues 19 accruing to participating public colleges and universities from the special 20 license plate program. Revenues from the special plate program shall be used 21 to: 22 (a) Fund scholarships for Idaho residents attending that college or uni- 23 versity. 24 (b) Match funds contributed in equal amounts from nonstate sources for 25 academic programs, provided that such expenditures shall be subject to 26 prior approval by the state board of education and board of regents of the 27 university of Idaho. 28 (6) Sample public college and university license plates may be purchased 29 from the department for a fee of thirty dollars ($30.00), ten dollars ($10.00) 30 of which shall be retained by the department for deposit to the state highway 31 account and twenty dollars ($20.00) shall be transferred by the department to 32 the college or university designated on the license plate. No additional fee 33 shall be charged for personalizing sample plates. 34 SECTION 22. That Section 49-418B, Idaho Code, be, and the same is hereby 35 amended to read as follows: 36 49-418B. IDAHO YOUTH PLATES. (1) On or after January 1, 2000, any person 37 who is the owner of a vehicle registered under the provisions of section 38 49-402, Idaho Code, or registered under any other section of law for which the 39 purchase of special plates is allowed, may apply for and upon department 40 approval receive special Idaho youth license plates in lieu of regular license 41 plates. Ten dollars 52 ($10.00) of each initial fee and ten dollars ($10.00) of each renewal fee 53 shall be transferred by the county assessor's motor vehicle registration divi- 17 1 sion of each county into the youth programs fund of the sheriff of that 2 county, for use in implementation of prevention and early intervention pro- 3 grams for Idaho's at-risk youth including, but not limited to: (a) providing 4 mentoring programs, (b) creating safe places and structured activities in non- 5 school hours, (c) fostering good health, (d) developing effective education 6 opportunities for marketable career skills, and (e) providing an opportunity 7 for youth to give back to their community. 8 (3) Whenever title or interest in a vehicle registered under the provi- 9 sions of this section is transferred or assigned, the owner may transfer the 10 special plates to another vehicle upon payment of the required transfer fees. 11 The owner may only display the plates on another vehicle upon receipt of the 12 new registration from the department. 13 (4) The Idaho youth license plate shall be of a color and design compara- 14 ble to the standard issue of license plates with blue numerals on a red, white 15 and blue background, except that the word "Idaho" shall appear on each plate 16 and the county designator shall be omitted to provide for distinguishing 17 designs and slogans, acceptable to the Idaho association of counties, to be 18 added to the plate. Initial costs of 20 the plate program, including costs of plate design, shall be paid by the Idaho 21 association of counties. 22 (5) Sample Idaho youth license plates may be purchased for a fee of 23 thirty dollars ($30.00), twelve dollars ($12.00) of which shall be deposited 24 in the state highway account and eighteen dollars ($18.00) of which shall be 25 deposited in the sheriff's youth program fund of the county where the plate 26 was purchased for the implementation of youth programs for at-risk youth. No 27 additional fee shall be charged for personalizing sample plates. 28 SECTION 23. That Section 49-419, Idaho Code, be, and the same is hereby 29 amended to read as follows: 30 49-419. That portion of the design which features the Idaho 53 sawtooth national recreation area shall be acceptable to the sawtooth society 19 1 and shall be approved by the department utilizing a numbering system as deter- 2 mined by the department. Initial costs of the plate program, including the 3 cost of the plate design, shall be paid by the sawtooth society. 4 (5) Sample Idaho sawtooth national recreation area plates may be pur- 5 chased from the department for a fee of thirty dollars ($30.00), twelve dol- 6 lars ($12.00) of which shall be deposited in the state highway account and 7 eighteen dollars ($18.00) of which shall be deposited by the state treasurer 8 in the park and recreation fund for use in the maintenance of parks and facil- 9 ities. STATEMENT OF PURPOSE RS 10086 The purpose of this legislation is to allow special license plates to be displayed on vehicles up to 26,000 pounds maximum gross vehicle weight. Current law limits special plates to a maximum gross weight of 16,000 pounds maximum gross vehicle weight. This would allow that owners of larger pick-up trucks or "shop trucks" could display and support specialty plates such as the Agriculture or Timber plates should they wish. FISCAL IMPACT If this legislation is enacted, increased revenue can be expected commensurate with any additional special plate sales. If 6 to 8 percent of the total 16,500 vehicles registered in the 16,001 to 26,000 maximum gross vehicle weight range choose special plates, as many as 1,000 to 1,300 additional special plate sales might be realized. The additional plate sales could generate revenue of $25,000 to $45,000 per year, to be distributed to special interest programs and the state highway account.
