S1474|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature Second Regular Session - 2000IN THE SENATE SENATE BILL NO. 1474 BY AGRICULTURAL AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO ORGANIC FOODS; AMENDING SECTION 22-1103, IDAHO CODE, TO PROVIDE 3 THAT THE DIRECTOR OF THE DEPARTMENT OF AGRICULTURE MAY NOT ISSUE A CERTIF- 4 ICATE UNDER THE PROVISIONS OF THIS ACT UNLESS THE APPLICANT HAS MET THE 5 REQUIREMENTS IMPOSED BY THE DIRECTOR TO ENSURE THE APPLICANT UNDERSTANDS 6 THE REQUIREMENTS AND HAS THE KNOWLEDGE NECESSARY FOR SUCCESSFUL FARMING; 7 AND AMENDING SECTION 22-1103, IDAHO CODE, AS AMENDED BY SECTION 4, CHAPTER 8 136, LAWS OF 1999, TO PROVIDE THAT THE DIRECTOR OF THE DEPARTMENT OF AGRI- 9 CULTURE MAY NOT ISSUE A CERTIFICATE UNDER THE PROVISIONS OF THIS ACT 10 UNLESS THE APPLICANT HAS MET THE REQUIREMENTS IMPOSED BY THE DIRECTOR TO 11 ENSURE THE APPLICANT UNDERSTANDS THE REQUIREMENTS AND HAS THE KNOWLEDGE 12 NECESSARY FOR SUCCESSFUL FARMING. 13 Be It Enacted by the Legislature of the State of Idaho: 14 SECTION 1. That Section 22-1103, Idaho Code, be, and the same is hereby 15 amended to read as follows: 16 22-1103. ADMINISTRATION AND ENFORCEMENT -- RULES AND REGULATIONS. The 17 administration and enforcement of the provisions of this chapter shall be 18 under the director. The director is authorized, in conformance with chapter 19 52, title 67, Idaho Code, to promulgate rules and regulations concerning, but 20 not limited to: 21 (1) Standards for agricultural crops and livestock produced for sale as 22 organically grown products. 23 (2) Records required of organic crop and livestock producers. 24 (3) The number of on-site inspections, announced and unannounced. 25 (4) Chemical residue analysis of organically grown agricultural products 26 and fees for conducting such analysis. 27 (5) Certification of private laboratories to conduct chemical residue 28 analyses. 29 (6) Standards that an agricultural producer must meet to be recognized as 30 a producer under the provisions of this chapter. 31 (7) Development and distribution of the organic certification seal and 32 standards for its application for use on Idaho agricultural products. 33 (8) Development and implementation of labeling standards. 34 (9) Rules establishing organic standards for poultry and poultry prod- 35 ucts, livestock and livestock products, milk and dairy products or aquaculture 36 products will be promulgated in consultation with the appropriate agricultural 37 or commodity organizations, as determined by the director. No pending or tem- 38 porary rule adopted by the department shall become final and effective before 39 the conclusion of the regular or special legislative session at which the rule 40 was submitted for review pursuant to sections 67-5224 and 67-5291, Idaho Code. 41 (10) Education. The director may not issue a certificate under the provi- 42 sions of this act unless the applicant has met the requirements imposed by the 2 1 director to ensure the applicant understands the requirements and has the 2 knowledge necessary for successful farming. 3 SECTION 2. That Section 22-1103, Idaho Code, as amended by Section 4, 4 Chapter 136, Laws of 1999, be, and the same is hereby amended to read as fol- 5 lows: 6 22-1103.
