S1497|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature Second Regular Session - 2000IN THE SENATE SENATE BILL NO. 1497 BY AGRICULTURAL AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO LEGISLATIVE APPROVAL FOR CERTAIN FEDERAL ACTIONS; AMENDING CHAPTER 3 63, TITLE 67, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 67-6302, IDAHO 4 CODE, TO REQUIRE ANY FEDERAL AGENCY TO SECURE APPROVAL FROM THE STATE LEG- 5 ISLATURE PRIOR TO INTRODUCING OR REINTRODUCING ANY SPECIES INTO THE STATE 6 OF IDAHO. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Chapter 63, Title 67, Idaho Code, be, and the same is 9 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 10 ignated as Section 67-6302, Idaho Code, and to read as follows: 11 67-6302. LEGISLATIVE APPROVAL REQUIRED FOR CERTAIN FEDERAL ACTIONS. No 12 action may be taken by a federal agency including the United States fish and 13 wildlife service, or any entity acting on behalf of a federal agency, to 14 introduce or to reintroduce any species into the state of Idaho without first 15 securing the approval of the Idaho state legislature.
STATEMENT OF PURPOSE RS 10114 Agriculture is the heart of Idaho's economy and the bedrock of rural communities. In 1994, wolves were reintroduced into Idaho by the U.S. Fish and wildlife Service, an activity opposed by the Idaho Legislature. Historically, wolves were eliminated in Idaho in recognition that an agricultural economy could not co-exist with an exploding predator wolf population. In year 2000, it is apparent that successful re-introduction of wolves has re-established a negative economic impact for farmers, ranchers, and small rural communities that are agriculturally based. The ravaging of domestic livestock will increase, no matter the faulty management tool designed to mitigate these losses, and has reached an intolerable level with no end in sight. Had this proposed legislation been in place, the State of Idaho would have had statutory leverage to oppose reintroduction of wolves, thereby eliminating unwarranted risk to Idaho's agricultural community. Predator populations that devastate Idaho's agriculture industry must be accepted or rejected at the legislative level when the need arises. FISCAL IMPACT No fiscal impact to general fund.
