S1529|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature Second Regular Session - 2000IN THE SENATE SENATE BILL NO. 1529, As Amended, As Amended in the House BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO SALARIES OF MEMBERS OF THE PUBLIC UTILITIES COMMISSION, THE STATE 3 TAX COMMISSION AND THE INDUSTRIAL COMMISSION; AMENDING SECTION 61-215, 4 IDAHO CODE, TO PROVIDE FOR A THREE AND ONE-HALF PERCENT SALARY INCREASE ON 5 JULY 1, 2000; AMENDING SECTION 63-102, IDAHO CODE, TO PROVIDE A THREE AND 6 ONE-HALF PERCENT SALARY INCREASE ON JULY 1, 2000; AND AMENDING SECTION 7 72-503, IDAHO CODE, TO PROVIDE A THREE AND ONE-HALF PERCENT SALARY 8 INCREASE ON JULY 1, 2000. 9 Be It Enacted by the Legislature of the State of Idaho: 10 SECTION 1. That Section 61-215, Idaho Code, be, and the same is hereby 11 amended to read as follows: 12 61-215. SALARIES OF PUBLIC UTILITIES COMMISSIONERS. Each member of the 13 public utilities commission shall devote full time to the performance of 14 his/her duties.and shall each receive anannual salary as follows:Commencing 15 on July 1, 1999,anthe annual salary of members of the public utilities com- 16 mission shall be seventy-five thousand dollars ($75,000), which amount shall 17 be increased on July 1, 2000, by three and one-half percent (3 1/2%), and 18 shall be paid from sources set by the legislature. 19 SECTION 2. That Section 63-102, Idaho Code, be, and the same is hereby 20 amended to read as follows: 21 63-102. ORGANIZATION -- CHAIRMAN -- COMPENSATION -- QUORUM -- HEARINGS. 22 (1) A member of the state tax commission shall be appointed by the governor, 23 to serve at his pleasure, as chairman. Each member of the state tax commission 24 shall devote full time to the performance of duties.and shall receive anCom- 25 mencing on July 1, 1999, the annual salary for members of the state tax com- 26 mission shall be sixty-five thousand dollars ($65,000), which amount shall be 27 increased on July 1, 2000, by three and one-half percent (3 1/2%). 28 (2) A majority of the state tax commission shall constitute a quorum for 29 the transaction of business. The state tax commission may delegate to any mem- 30 ber of the commission or to its employees, the power to make investigations 31 and hold hearings at any place it may deem proper, and such other matters as 32 will facilitate the operations of the commission. 33 (3) The chairman of the state tax commission shall delegate to each com- 34 missioner the responsibility for policy management and oversight of one (1) or 35 more of the taxes collected and/or activities supervised or administered by 36 the commission. The state tax commission shall perform the duties imposed upon 37 it by law and shall adopt all rules by majority decision. 38 In any case in which the state tax commission sits as an appellate body 39 upon an appeal from a tax decision from one (1) of the various administrative 40 units subject to its supervision, the state tax commissioner charged with 41 responsibility for policy management and oversight of the tax in controversy 2 1 shall not vote upon the appeal but may advise the remaining members of the 2 commission on the technical aspects of the problems before them. 3 (4) The chairman shall be the chief executive officer and administrative 4 head of the state tax commission and shall be responsible for, or may assign 5 responsibility for, all personnel, budgetary and/or fiscal matters of the 6 state tax commission. 7 SECTION 3. That Section 72-503, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 72-503. SALARY.TheCommencing July 1, 1999, the annual salary of each 10 member of the industrial commission shall be seventy-three thousand dollars 11 ($73,000),andwhich amount shall be increased on July 1, 2000, by three and 12 one-half percent (3 1/2%). Industrial commissioner salaries shall be paid from 13 sources set by the legislature. Each member of the industrial commission shall 14 devote full time to the performance of his duties.

STATEMENT OF PURPOSE RS 10152 This legislation increases the annual salaries of the Public Utilities Commissioners, Industrial Commissioners and the State Tax Commissioners by 3% percent on July 1, 2000. It also provides that on each July 1 thereafter the annual salary of each commissioner shall be increased by the change in employee compensation adopted by the legislature for classified state employees unless the Legislature designates otherwise by adoption of a Concurrent Resolution by both Houses. FISCAL IMPACT The fiscal year 2001 impact on the State General Fund is $11,102. Public Utilities Commissioners and Industrial Commissioners are paid from dedicated funds.
